Mayor Walter Parker called the meeting to order at 7 P.M. The following
members of Council were present: James Burke, Jack Youmans, Shirley Sessions, Pam
O'Brien and Mallory Pearce. Anne Monaghan was out of town. City Manager Tom
Cannon and City Attorney Edward Hughes were present.
Mayor Parker opened the meeting for business legally presented stating that the 2
items on the agenda were 2001 Millage Rate and the question on the gym/pool for
referendum.
Burke moved to set the Millage rate for 2001 at 4.500. Sessions seconded for
discussion. Parker said that he slight roll back of 4.656 would keep the income constant.
Finance Director James King said that there is more to the five -year history than you see
before you. King said that for each $1,000 of the assessed value it cost $4.65. King had
information sheets for each Council member that are attached and becomes a part of these
minutes. O'Brien asked about the budget needs for next year — infrastructure, etc.
Cannon said that he spoke with Michael Gibboni, Water Sewer Director, and he estimates
about $500,000. and that is operation and capital. Youmans said that water sewer has
nothing to do with the millage; they have to operate on their own income. O'Brien asked
Cannon about budget needs for 2002. Cannon said that he has not met with William Pye,
Director of Public Works, but has discussed certain issues with Bill Lovett of H, G. B. &
DeY about storm drainage. Cannon said his estimate is $700,000 a year with water sewer
included for the next 10 years, and the City needs to look for other sources of income.
Maybe talk with Representative Burke Day about a 1% sales tax for Tybee Island by
changing that State law. Parker informed Council that there would have to be an
amendment to the Constitution. Youmans stated that storm drainage is to be paid out of
SPLOST. Burke asked King how 4.500 would affect the budget vs. the 4.656. King
answered about $32,000 less. Vote by Council was 2 in favor (Burke and Youmans0; 3
opposed (Sessions, O'Brien and Pearce). Pearce moved to adopt 4.656 as the millage
rate for the year 2001. Sessions seconded. Vote by Council was 3 in favor (Sessions,
O'Brien and Pearce); 2 opposed (Burke and Youmans).
Mayor Parker announced that there is $435,000 in the reserve Gym account and
that $9,900 is added each month — these monies come from the rental of space on the
water towers for the cell phone companies. Parker said he does not know how much
longer these revenues will be coming to the City.
Burke said the City could build the pool at no cost by using the $435,000. Youmans said
that is earmarked for a gym and that there is also money from the SPLOST available
towards a gym. Youmans said he and Cannon went to Bryan County and looked at a
gym they built for $500,000. and we could pay for that tomorrow. Parker said to keep in
mind the maintenance and operation of the gym, Chatham is in trouble because they did
not include in the budget. O'Brien asked the yearly estimate on the M &O. Cannon
answered around $200,000 and it is in the referendum question. Hughes said that a
decision is needed tonight because this must go to the Justice Department before it can be
placed on the ballot and that usually takes about 60 days. Youmans said this will allow
the citizens to decide. O'Brien asked if it fails can the City use the reserve for something
else. Hughes said yes, but in the motion to accept the leases it was noted that the

proceeds go towards a gym, the SPLOST money would have to stay with the gym
because it was earmarked in the agreement Pearce moved to adopt the resolution.
O'Brien seconded. Vote by Council was unanimous.

R E S O L U T I O N
WHEREAS, the fiscal year of the City of Tybee Island begins on
January 1 and ends on December 31; and
WHEREAS, Title 3 of the Code of Ordinances for the City of Tybee
Island, Georgia, and specifically Section 3 -2 -11
provides in part that the millage rate for annual ad
valorem tax upon all real and personal property within
the City shall be established each year by Resolution
of the Mayor and Council; and
WHEREAS, the Mayor and Council desire to set the millage rate
for the year beginning January 1, 2001 and ending
December 31, 2001 in compliance with the terms of the
laws of Georgia and the Ordinances of this City;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
City of Tybee Island, in open meeting assembled, that the millage
rate of the fiscal year January 1, 2001 through December 31, 2001
be set at 4 o 451 mils.

A RESOLUTION OF THE
MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND
CALLING A BOND ELECTION
IN AND FOR THE CITY OF TYBEE ISLAND
TO BE HELD ON NOVEMBER 6, 2001, AND FOR OTHER PURPOSES
WHEREAS, the Mayor and Council of the City of Tybee Island (the "Mayor and Council "),
the governing body of the City of Tybee Island (the "City "), a municipality and a political
subdivision of the State of Georgia, deems it necessary and in the best interests of the City to incur
bonded debt for the purposes set out in the notice of said election which is attached hereto as Exhibit
A and which is hereby authorized to be published.
NOW, THEREFORE, be it resolved by the Mayor and Council of the City of Tybee Island in
meeting assembled and it is hereby resolved by authority of same that:
I. An election is hereby called to be held in the City of Tybee Island on November 6, 2001, at
which election there shall be submitted to the qualified voters of the City of Tybee Island, for their
determination. the question of whether City of Tybee Island General Obligation Bonds shall be
issued for the purposes shown in said notice of said election which is attached hereto as Exhibit A.
II. The bonds shall be general obligations of the City of Tybee Island. The principal amount
of the bonds to be issued shall not exceed $1,500,000. The maximum rate or rates of interest on such
debt shall not exceed six percent (6.00 %) per annum. The maximum amount of principal to be paid
in each year during the life of the debt shall be as shown in the notice of said election which is
attached hereto as Exhibit A.
III. Due provisions shall be made at the holding of said election so that those voting at said
election who favor the issuance of such bonds may vote for the issuance thereof, and those voting at
said election who oppose the issuance of such bonds may vote against the issuance thereof, and the
question to be voted on in said election shall appear on the ballots or ballot labels in substantially the
following form:

$1,500,000 to pay the cost of acquiring, constructing,
and equipping a gymnasium, swimming pool and
activities center complex, the payment of principal and
interest on which is projected to require a millage
increase of approximately 1.4 mills during the life of the
bonds, exclusive of operating and maintenance costs
which are estimated to be approximately 5200.000
annually, as shown in the published advertisement of
this election?
IV. The Board of Elections of Chatham County is hereby appointed and reaffirmed as the
Election Superintendent for the City of Tybee Island.

V. The election hereby called shall be held in accordance with the provisions of O.C.G.A. §
36 -82 -1, et seq., by the same persons, in the same manner, and under the same rules and regulations
that elections for officers of the City of Tybee Island are held, and the managers of such
election shall make returns thereof to the Board of Elections of Chatham County, as Election
Superintendent, and to the Mayor and Council, which, in the presence of and together with the
managers of said election, shall consolidate said returns and declare the result of said election, and
the City Clerk and the Election Superintendent shall be, and hereby are, requested to publish the
notice of said election in terms of law in the newspaper in which sheriffs advertisements for
Chatham County are published for a period of not less than 30 days immediately preceding the day of
the election, and the notice of the election shall be in substantially the form attached hereto as
Exhibit A.
VI. If said issue of bonds is authorized, the Mayor and Council of the City of Tybee Island
will levy a tax sufficient in amount to pay the principal of said bonds at their respective maturities
and the interest thereon as the same become due as required by the Constitution of the State of
Georgia.
VII. The City Clerk is hereby authorized and directed to deliver to the Election
Superintendent, a certified copy of this resolution.
VIII. All resolutions or parts of resolutions, if any, in conflict herewith shall be and the same
hereby are repealed.

NOTICE OF BOND ELECTION
TO THE QUALIFIED VOTERS OF THE CITY OF TYBEE ISLAND
1. Notice is hereby given by the Mayor and Council of the City of Tybee Island, governing
body of the City of Tybee Island (the "City "), and by the Board of Elections of Chatham County, as
Election Superintendent for the City of Tybee Island, that on November 6, 2001, an election will be
held in the City to determine the question of whether general obligation bonds shall be issued to
provide funds needed to pay the cost, in whole or in part, of acquiring, constructing, and equipping a
gymnasium, swimming pool and activities center complex in the City. The approval of such
question shall constitute authorization for the Mayor and Council to purchase such property, real or
personal, and any interest therein, including easements. rights -of -way and franchises needed in
connection therewith or necessary therefor or incident thereto, and to pay expenses incident thereto.
2. The question to be voted on in said election shall appear on the ballots or ballot labels in
substantially the following form:

Council of the City or by any other person, firm, corporation or association with the knowledge and

Mayor and Council of the City concerning the use of bond funds.
5. Due provisions shall be made at the holding of said election so that those voting at said
election who favor the issuance of any such bonds may vote for the issuance thereof, and those
voting at said election who oppose the issuance of such bonds may vote against the issuance thereof.
6. The election shall be held in accordance with applicable law by the same persons, in the
same manner, and under the same rules and regulations that elections for officers in the City of
Tybee Island are held.
7. The polls will be open from 7:00 a.m. until 7:00 p.m. on the election day, Tuesday,
November 6, 2001.
8. The last day to register to vote in the election is October 9, 2001. Anyone desiring to
register may do so by applying in person at the Chatham County Voter Registrar's Office, 415 W.
Broughton Street, Room 105, Savannah, Georgia, or at Tybee Island City Hall, 401 Butler Avenue,
Tybee Island, Georgia, or by any other method authorized by Georgia law.
