HomeMy Public PortalAbout060-1979 - REZONING - RICHMOND MUNICIPAL AIRPORTNDED GENERAL ORDINANCE NO. 60-1979 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF THE RICHMOND MUNICIPAL AIRPORT FROM R-1 SINGLE FAMILY RESIDENCE DISTRICT TO AZ AIRPORT ZONE DISTRICT AND AD AIRPORT DEVELOPMENT DISTRICT. WHEREAS, the Zoning Map -which is a part of Ordinance No. 2325-1968 desig- nates and describes as R-1 Single Family Residence District the Richmond Municipal Airport in the City of Richmond, Indiana; and, WHEREAS, it is the intent and purpose hereof to change the zoning classi- fication of the Richmond Municipal Airport from R-1 Single Family Residence District to AZ Airport Zone District and AD Airport Development District; and, WHEREAS, a study of this Ordinance was Plan Commission the 28th day remonstrances were heard from affected by this Ordinance. conducted by the Richmond City of August, 1979, at which time all parties interested in or WHEREAS, the vote of the Richmond City Plan Commission was eight (8) to zero (0) in favor of recommending the passage of Amended ordi- nance No. 60-1979. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich- mond, Indiana as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to AZ Airport Zone District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A tract of land situated in a part of Section 26 and 35, Township 13 North, Range I West, Boston Township, City of Richmond, Wayne County, Indiana, more particularly described as follows: The North Half of Section 25, the South Half of Section 26, and a part of the Northwest Quarter of Section 26, said fractional quarter being described as follows; Be- ginning at the Southwest corner of said quarter section; Thence North along the West line of said quarter section a distance of 191.90 feet to a point in the center of Sulla Road;. Thence East along a line being parallel to the South line of said quarter section a distance of 2336.89 feet to a point; Thence South parallel to the West line of said quarter section a distance of 191.90 feet to a point on the South line of said Northwest quar- ter said point being 313.50 feet West of the Southeast corner of said quarter section; Thence West along the South line of said quarter section to the point of be- ginning, containing in all 651.89 acres, more or less, subject however, to all legal highways and/or right-of- ways thereunto belonging. EXCEPTING THEREFROM: A tract of land situated in a part of Section 26, Township 13 North, Range 1 West, Boston Township, City of Richmond. Wayne County, Indiana, more particularly described as follows: Commencing at the Northwest corner of the South Half of Section 26; Thence East along the North line of said Half Section a distance of 2,336.89 Feet to the Point AMENDED GENERAL ORDINANCE NO. 60-1979 Page Two of Beginning; Thence continuing East along the South Right -of -Way of Bulla Road to a point on a line being parallel to and 750 Feet from the conterline of Runway "5-23" of the Richmond Municipal Airport; Thence South 55 Degrees of 06 Minutes 00 Seconds West along said line to a point on a line being parallel to and 25C Feet from the centerline of Runway "10-28" of the Richmond Municipal Airport; Thence North 79 Degrees 54 Minutes 00 Seconds West along said line to a point on a line being parallel to and 400 Feet from the centerline of Runway "14-3211 of the Richmond Municipal Airport; Thence North 34 Degrees 54 Minutes 00 Seconds West along said line to the South Right -of -Way line of Bulla Road; Thence East and Southeasterly along said Right -of -Way to a point being 2,336.89 Feet East of the West line of Section 26; Thence South to the Point of Beginning and containing 68.57 acres, more or less, subject to all legal easements and/or right-of-ways of legal record. SECTION 2. That the zoning classification of the property described below be, and the same is hereby changed to AD Airport Develop- ment District, and that said property be regulated in accord- ance with the Zoning Ordinance of the City of Richmond, Indianaand all amendments thereto. A tract of land situated in a part of Section 26, Township 13 North, Range 1 West, Boston Township, City of Richmond, Wayne County, Indiana, more particularly described as follows: Commencing at the Northwest corner of the South Half of Section 26; Thence East along the North line of said Half Section a distance of 2,336.89 Feet to the Point of Beginning; Thence continuing Fast along the South Right -of -Way of Bulla Road to a point on a line being parallel to and 750 Feet from the centerline of Runway "5-23" of the Richmond Municipal Airport; Thence South 55 Degrees 06 Minutes 00 Seconds West along said line to a point on a line being parallel to and 250 Feet from the centerline of Runway 10-28" of the Richmond Municipal Airport; Thence North 79 Degrees 54 Minutes 00 Seconds West along said line to a point on a line being parallel to and 400 Feet from the centerline of Runway "14-32" of the Richmond Municipal Airport; Thence North 34 Degrees 54 Minutes 00 Seconds West along said line to the South Right -of -Way line of Bulla Road; Thence East and South- easterly along said Right -of -Way to a point being 2,336.89 Feet East of the West line of Section 26; Thence South to the Point of Beginning and containing 68.57 acres, more or less, subject to all legal easements and/or right-of-ways of legal record. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. WHEREAS, Ordinance No. 60-1979, as presently written would rezone the Richmond Municipal Airport from R-T Single Family Residence District to AZ Airport Zone District and AIP Airport Industrial Park District; and, WHEREAS, Ordinance No. 60-.1979 has been tabled by the Common Council of the City of Richmond awaiting the further deliberation of the Richmond City Plan Commission; and, WHEREAS, the Richmond City Plan Commission,. through Ordinance No. 90-1979, has recommended to Common Council that Article 37 of the Zoning Ordinance be amended by pro- viding development standards and changing the name of Article 37 from Airport Industrial Park District to Airport Development District; and, WHEREAS, Amended Article 37, as set forth in Ordinance No. 90- 1979, provides for development to occur within in the Airport Development District in an orderly fdshion utilizing sound land use planning techniques; and, WHEREAS, the Richmond City Plan Commission held a pubiic hearing on August 28, 1979, to consider rezoning 68.57 acres of the Richmond Municipal Airport to AD Airport Development District; and, WHEREAS, during the conduct of the public hearing, all parties interested in or affected by the proposed rezoning were given an opportunity to remonstrate. NOW THEREFORE BE IT RESOLVED? that the Richmond City Plan Commis- sion hereby recommends that Ordinance No. 60-1979 be taken off the table and amended by changing any reference to the.AIP.Airport Induustrual Park District to AD Airport Development District where it appears in Ordinance No. 60- 1979. BE IT FURTHER RESOLVED that a copy of the recommended Amended General Ordinance No. 60-1979 be marked Exhibit A hereof and attached hereto. PASSED, ADOPTED AND APPROVED this 28th day of August, 1979.
