ORDINANCE NO" 9
AN ORDINANCE AMENDING ORDINANCES NUMBER 50 AND 51 PROVIDING
FOR INVESTIGATION OF APPLICANTS, DENIAL OR REVOCATION OF
LICENSES, RESTRICTIONS UPON LICENSES; APPEALS TO THE CITY
COUNCIL
BElT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL
AIRE, KANSAS:
SECTION 1. AMENDMENTS
Ordinance number 50 and ordinance number 51 of the Ci ty of
Bel Aire, Kansas are hereby amended to include additional'
sections in each ordinance providing for investigations of
applicants, denial or revocation of licensing, restrictions
upon licensing, and appeal to the City Council.
SECTION 2. INVESTIGATION OF APPLICANT-DENIAL OR REVOCATION
OF LICENSE-RESTRICTIONS UPON LICENSE-APPEAL
Upon receiving any application for a license herein, the
City Clerk shall request the Chief of Police to investigate
the background of any person, partnership, corporation, or
employee of any business applying for a license hereunder.
Upon receiving results of such investigation the City Clerk
may in his or her discretion, pursuant to the policy adopted
by city resolution, deny, revoke, or restrict the issuance
of any license for good cause upon finding that such
refusal, revocation, or restriction is in the best interest
of the City of Bel Aire and its citizens.
Any person, corporation, partnership or business that has
been refused licensing, revoked or restricted in any manner
hereunder may appeal to the City Council by filing a written
request to be heard on the subject within 30 days of the
denial, revocation, or restriction by the City Clerk. Upon
receiving such request the matter shall be placed on the
Ci ty Council agenda immediately following receipt thereof,
whereupon the City Council may, by majority vote, approve
the denial of the request for licensing, approve the
revocation of a license, approve restrictions placed on a
l:i.cense by the City Clerk, order the Clerk to issue a
license hereunder, or modify the terms of a license
hereunder.
SECTION 3. EFFECT OF ORDINANCE NUMBER 50 AND 51

All other provisions of ordinances number 50 and 51 of the
City of Bel Aire, Kansas shall remain in full force and
effect and these provisions shall apply in addition thereto.

SEC'l'ION 4. EFli'ECTIVE DATE
This Ordinance shall take effect and be in force from and
after its publication in the official City Newspaper.
Adopted and passed by the Council of the City of Bel Aire,
