Kelley ORDINANCE NO. 09-21 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OPA-LOCKA, FLORIDA, AMENDING CHAPTER 7 OF THE OPA-LOCKA CODE OF ORDINANCES ENTITLED "BUILDING, HOUSING AND STRUCTURAL REGULATIONS" BY CREATING ARTICLE I, SECTION 7- 12 ENTITLED "SUITABILITY FOR HABITATION CERTIFICATE"; REQUIRING A SUITABILITY FOR HABITATION CERTIFICATE FOR SINGLE FAMILY RESIDENCES, CONDOMINIUM UNITS, TOWNHOUSES AND DUPLEXES ACQUIRED THROUGH CERTIFICATE OF TITLE, AND REQUIRING CERTIFICATION OF COMPLIANCE WITH APPLICABLE BUILDING CODES AND ZONING; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, municipalities may enact reasonable regulations to promote the health, safety and welfare of citizens; and WHEREAS, the City Commission of the City of Opa-locka("City Commission") desires to amend Chapter 7, Article I of the City of Opa-locka Code of Ordinances entitled "Building, Housing and Structural Regulations; In General", by specifically creating Section 7-12 entitled "Suitability for Habitation Certificate"; and WHEREAS, with the creation of Section 7-12, a Suitability for Habitation Certificate will now be required for single family residences, condominium units, townhouses and duplexes acquired through certificate of title, and requiring certification of compliance with applicable building codes and zoning; and Ordinance No. 0 9-21 WHEREAS, the City Commission has determined that it will be in the best interest of the City of Opa-locka ("City") to specifically create Section 7-12 entitled "Section 7-12 entitled "Suitability for Habitation Certificate." THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby creates Chapter 7, Article I, Section 7-12 entitled "Suitability for Habitation Certificate" as set forth herein: Sec. 7-12. Suitability for Habitation Certificate. (a) No structure, other than a single family residence or duplex, shall be used or any existing use enlarged, or any new use made of any land, body of water, or structure, without first obtaining a Suitability for Habitation Certificate from the City of Opa-locka Building Department. Said certificate shall also be required for each multi-family building located within the City of Opa-locka. (b) In the event that there is a question as to the legality of a use, the City's Building Official may require inspections, affidavits and such other information as he/she may deem appropriate or necessary to establish the legality of the use, before a Suitability for Habitation Certificate will be issued. Additionally, the City's Building Department shall have the right to periodically inspect premises at any reasonable time to ensure the existence of a current and valid Suitability for Habitation Certificate and to ensure compliance with the terms and conditions under which a Suitability for Habitation Certificate was issued. (c) The person or entity listed upon a Certificate of Title issued pursuant to Chapter 45, Florida Statutes as the purchaser of a single family residence, condominium unit, townhouse or duplex shall obtain a Suitability for Habitation Certificate from the City's Building Department prior to offering said residence for sale, transfer or other alienation. The Suitability for Habitation Certificate required by this subsection (c) shall be for the purpose of determining whether or not the residence in question complies with all building codes and zoning codes applicable to the residence and to provide a disclosure of those findings. The City's Building Official shall require disclosure of said findings by requiring an inspection of the property by personnel authorized by the City's Building Official to make such inspection. The inspection report and its finding therein shall be subsequently recorded in the public records of Miami-Dade County and shall include a good faith estimate of the cost to repair or remedy all code violations disclosed by the inspection. The City's Building Official shall prescribe the form of the inspection report and disclosure to ensure compliance with the intent of this Ordinance No. 09-21 section. Upon the recording of the inspection report and estimate in the public records of Miami-Dade County, the City's Building Official is authorized to issue the Suitability for Habitation Certificate required by this subsection provided there are not outstanding violations. The City's Building Official shall refer any City code violations disclosed in the report to the City's Code Enforcement Department for enforcement action. City Departments are authorized to collect fees for inspections and other administrative costs and/or for the issuance of the Suitability for Habitation Certificate as may be applicable, and as established in the Building Department's approved schedule of fees. No Suitability for Habitation Certificate shall be utilized in a manner contrary to the regulations contained in this chapter. This Ordinance shall apply only to the sale of properties after the passage of this Section. (d) The fees for inspections and other administrative costs and/or for the issuance of the Suitability for Habitation Certificate shall be as follows: (i) For initial registration as the owner of a property obtained in accordance with Chapter 45, Florida Statutes and to obtain the Disclosure and Findings Report the amount shall be$250.00 (ii) Upon approval of the Disclosure and Findings Report by the City's Building Official - The Disclosure and Findings Report must be recorded with Miami-Dade County Clerk of Courts / Public Records Division before issuance of the Suitability for Habitation Certificate by the City's Building Official. The fees for recording are paid by the property owner in accordance with the fee schedule established by Miami-Dade County. (iii) Upon approval of the Disclosure and Findings Report by the City's Building Official - For issuance of the Suitability for Habitation Certificate by the City's Building Official the amount shall be $100.00 (iv) Upon rejection of the Disclosure and Findings Report by the City's Building Official the fee for re-submittal shall be $50.00 Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent Ordinance No. 0 9-21 jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. This Ordinance shall, upon adoption, become effective as specified by the City of Opa-locka Code of Ordinances and the City of Opa-locka Charter. Finnie DATE: August 27, 2009 Interim City Manager FROM: Daniel Abia, Building Department Director SUBJECT: Foreclosure Ordinance &Gerald Lee, Community Development Planner Our recommendation concerning the foreclosure ordinance/registry is that we implement an ordinance in the same manner presented by Miami Dade County. The action steps are as follows: 1. Create the ordinance which requires any individual/institution that obtained a certificate of title (foreclosures and judgments), in accordance with Chapter 45, Florida Statutes be required to obtain a certificate of use (CU) from the Building & License Department for residential properties in the City of Opa-locka. This new ordinance requires the establishment of a new certificate of use process for such properties. • This process will require that affected individuals/institutions obtain a CU, prior to the offering of such property through a sale, transfer, or alienation of such property. The request for the CU through this process establishes the registry of foreclosed property owners. It will also establish a fee schedule for this process. • The CU required is for the purpose of determining whether or not the residence in question complies with all building codes and zoning codes applicable to the residence and to provide disclosure by requiring an inspection by authorized personnel. The authorized personnel's inspection report will include a good faith estimate of the cost to repair or remedy all code violations disclosed by the report. • The Building Department Director (or his designee) must verify the documentation of such inspection submitted by the authorized personnel and upon approval; the disclosure document will be recorded in the public records of Miami-Dade County. • This CU process requirement is a consumer protection legislation, and as such documents and discloses to the potential buyer, the extent to which residential properties, i.e. single family, condominium, townhouse, or duplex acquired in this manner comply with all applicable building codes and zoning codes. 2. Address in the ordinance the fee schedule for registry and for the staff inspections to verify findings of the disclosure report. Description: Currently approximately 92 homes in Opa-locka are in foreclosure. When foreclosures are returned to the market typically, they are sold "as is, " and few or no inspections are completed. Very often foreclosed properties have been stripped of any items of value, i.e. electrical wiring, appliances, and fixtures, by the previous homeowner or by neighborhood burglars. The foreclosure process undertaken by the Financial Institution to obtain title to the property may take up to one year. Often the homeowner leaves the property before the foreclosure process is complete which leaves the property vacant, unattended, and not maintained. Implementing this Ordinance will address the aforementioned challenges. The Ordinance requires a building and zoning inspection by the City Staff to confirm the status of the property in relation to building and zoning codes. The Ordinance also requires the lender to register with the Building & Licensing Department to begin the process of obtaining a Certificate of Use which alerts the City Staff as to who is responsible for the maintenance of the f property. The assessment completed by the Lending Institution's designated personnel identifies system deficiencies and provides an accurate estimate of the repair costs. ASSOCIATED FEE SCHEDULE • The initial registration as the owner of a property obtained in accordance with Chapter 45, Florida Statutes and to obtain the Disclosure and Findings Report documents $250.00 • When the Disclosure and Findings Report is approved by City Staff and the Building & License Department Director issues the Certificate of Use $100.00 • In cases where a Disclosure and Findings Report is rejected by the Building & License Director and the document must be re- submitted ...$50.00 • The Disclosure and Findings Document once approved must be recorded with the Miami-Dade County Clerks Office before the Certificate of Use is issued. Recommendation(s): Staff recommends that the City Commission approve this ordinance implementing the requirement for A Certificate of Use (Foreclosures & Judgments) Analysis: The approval of this ordinance requires the issuance of a Certificate of Use by the Building & License Department when residential properties in the City of Opa-locka are acquired through a Certificate of Title (Foreclosures & Judgments), in accordance with Chapter 45, Florida Statutes. The purpose of the CU process is to document and disclose to the public the extent to which residential properties (i.e. single family, condominium, townhouse, or duplex) acquired in this way comply with all applicable building codes and zoning codes. The CU process includes preparation of a disclosure of findings report, which identifies building code or zoning code violations for each property and contains a good faith estimate of the-cost to remedy any deficiencies. Building code violations will be referred to the Building & Licensing Department for enforcement and zoning code violations will be referred to the Code Enforcement Department to address compliance. Registration for this process identifies the line of responsibility for property maintenance during the foreclosure process. (b) In the event there is a question as to the legality of a use,the Director may require inspections, affidavits and such other information he may deem appropriate or necessary to establish the legality of the use, before a certificate of use will be issued. Remaining provisions are now in effect and remain unchanged. • Amended Agenda Item No. 7(B) Page 2 Additionally, the Department shall have the right to periodically inspect premises at any reasonable time to ensure the existence of a current and valid C.U., and to ensure compliance with the terms and conditions under which a C.U.was issued. >>(c) The person or entity listed upon a Certificate of Title issued pursuant to Chapter 45, Florida Statutes as the purchaser of a single family residence, condominium unit. townhouse or duplex shall obtained a C.U. from the Department prior to offering said residence for sale,transfer or other alienation. The C.U. required by this subsection (c) shall be for the purpose of determining whether or not the residence in question complies with all building codes and zonine codes applicable to the residence and to provide a disclosure of those findings. The Director shall require disclosure by requiring an inspection of the property by personnel authorized to conduct such inspections by the Director and to subsequently record in the public records of Miami-Dade County the inspection report. Said report shall include a good faith estimate of the cost to repair or remedy all code violations disclosed by the inspection. The Director shall prescribe the form of the inspection report and disclosure to ensure compliance with the intent of this section. Upon the recording of the inspection report and estimate in the public records of Miami-Dade County, the Director is authorized to issue the C.U.required by this section (c). The Director shall refer any County Code violations disclosed in the report to the proper County Department for enforcement action. County Departments are authorized to collect fees for inspections and other administrative costs and/or for the issuance of the C.U., as maybe applicable, and as established in the Departments' approved schedule of fees<< Except for C.U.'s required by code or zoning resolution to be renewed annually, and except for C.U.'s issued on a temporary basis, certificates of use shall remain valid for an unlimited time unless revoked for cause. The C.U. is only valid for the specific address, business name, corporate name and type of business for which it was issued. A new C.U. shall be required for any changes in; use, name, ownership, expansion of square footage occupied, the inclusion of additional uses, or when changes to the structure have been approved by final building inspection. No certificate of use shall be utilized in a manner contrary to the regulations contained in this chapter. Section 2. If any section; subsection, sentence, clause or provision of this ordinance Ordinance No. 08-133 Amended Agenda Item No. 7(B) Page 3 is held invalid,the remainder of this ordinance shall not be affected by such invalidity. Section 3. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance, including any sunset provision, shall become and be made a part of the Code of Miami-Dade County, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article,"or other appropriate word. Section 4. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
