AN ORDINANCE TO AMEND ORDINANCE NO. 2858-1973 Y-NOWN AS AN ORDINANCE REGULATING
WASTE WATER TREAT.ENT FOR THL. SANITARY DISTRICT OF THE CITY 4F RICHMON➢, 1N11TANA.
WHEREAS, there has been constructed certain interceptor and collector sewers and
drains outside the territory known as the Richmond Sanitary District which are
connected to the Richmond.Sanitaxy Sewer System and Waste Water Treatment Plant;
and,
WHEREAS, there are territories adjacent to the Richmond Sanitary District which
drain into and pollute rivers, streams, and water courses in said Sanitary District;
and,
WHEREAS, it has been determined and expressed by resolution of the Board of
Sanitary Commissioners of the City of Richmond, Indiana, that it is not economically
feasible to incorporate said territories into the Richmond Sanitary District; and,
WHEREAS, Section 204 of Ordinance No. 2958-1973 provides that no person or pro-
perties outside the corporate limits of the City of Richmond may connect to the
Richmond Sanitary District wastewater treatment system without providing for
annexation to the Richmond Sanitary District; and,
WHEREAS, the Board of Sanitary Commissioners has determined and expressed by
resolution of said Board that Indiana State and United States laws require the
Richmond Sanitary District to control the flow of wastewater into the rivers,
streams and watercourses which are situate in said Richmond Sanitary District,
specifically I.C. 19-2-14-3_
STOW THEREFORE, BE IT ORDAINED by the Common Council ox the Gity of Richmond,
Indiana,
1. That section 204 of Ordinance 2858-1973 of the City Of
Richmond, Wayne County, Indiana, be repealed and deleted
from said ordinance and that a new section to be known as
section 204.1 of said ordinance be added to said ordinance
2858-1973 and that said section 204.1 shall read as follows:
204.1. Connections to Sewer system of Richmond Sanitary District
Outside the Territorial Limits of the Richmond Sanitarl District.
No person or corporation or entity owning any property shall connect or
permit to be connected any sewer or drain to the wastewater treatment system or
the storm water drainage system owned by or operated by or existing in the Richmond
Sanitary District except that such person, corporation, or ouming such property
outside the Richmond Sanitary District and desiring to connect to the wastewater
treatment system of the Richmond Sanitary District shall enter into a contract
with said Richmond Sanitary District which contract shall provide for;
(a) a connection charge
(b) a user charge
(c) compliance with the other provisions of this
ordinance No. 2858-1973
(d) future annexation to the City of Richmond, if
determined to be feasible
That the terms and conditions of said ordinance shall be in accordance
with the terms hereinbefore set out and in accordance with I.C. 19-2-14-3, para-
graph (17) which does provide for the Richmond Sanitary District to connect
sewers and drains outside the Richmond Sanitary District.
SECTIDN 2. This Ordinance shall be in fall force and effect from and after
its passage and approval by the Mayor.
