AN ORDINANCE RflMTNG GJAPTER 22 OF THE IMCIPAL CODE, BEING ORDINANCE
NO. 2325-1968, COMMY KOM AS THE ZONING ORDMNCE OF THE CITY OF
RICHWIVD, INDLMITA, ADOPTED JUKE 3, 1968, 'PROVIDING FOR THE ADDITION OF
ARTICT,E 45.051 TO THE TEXT OF SAID CHAPTE[t.
WHEREAS, Article 45 of the Zoning Ordinance does not provide for modify-
ing the requirments and standards relating to a Development
Unit Project; and,
U4ERW, it is desirable from the standpoint of sound planning, in
specific cases, to grant modifications from the requiranents
and standards relating to a Development Unit Project where the
general public health,safety and welfare will not be adversely
affected and where strict compliance to the said requirements
and standards cause undue and unnecessary hardship; and,
WHERFA,S, it is the intent and purpose hereof to an end Qlapter 22 of the
Mmicipal Code, commonly known as the Zoning Ordinance, by
adding Article 45.051 which sets forth the procedure to modify
the requirements and standards relating to Development Unit Pro-
jects; and,
WHEREAS, a study of this Ordinance was conduct d by the Richnond City Plan
Cmm4ission the -2 kq day of 1979, at which
time remonstrances were heard tram all IMrties interested in or
affected by this Ordinance.
UMRFAS, the vote of the Richdnond City Plan Coamission was to
p in favor of recommending the passage of Ordinance No.
8:3 -1979.
BE IT ORDA= by the Comm Council of the City of Rid:mond, Tndiana, as
follows:
SECTION 1. It is hereby ordained that Article 45.051 shall be added to
Chapter 22 of the 'lmicipal Code and read as follows:
45.051 Nkbdification of Requirements and Standards:
lvbdification of any of the requirements and
standards relating to Development Unit Projects
may be authorized by Comr Council, upon recomlyenda-
tion of the Plan Comxnissi.on., in specific cases where
undue hardship may result from strict compliance.
The Plan Cammi_ssion shall determine that Wanting

standards. . Applications for such modifications
shall be filed in writing by the developer at the
same time the preliminary plan for the Development
Unit Project is filed and shall explain in detail

SECTION 2. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.

The Richmond City Plan Commission held a public hearing on Tuesday,
August 28, 1979. on its own initiative to consider amending Article
45 of the Zoning Ordinance.
The proposed amendment would add Section 45.051 allowing Common
Courcil, upon recommendation of the Plan Commission, to authorize
modifications of the requirements and standards relating to De-
velopment Unit Projects in cases where undue hardship may result
from street compliance. Common Council presently has the authority
to impose additional conditions upon a Development Unit Project in
cases where they are needed to safeguard adjoining property.
The proposed amendment will give Council another element of flexi-
bility in approving Development Unit Projects by alloying modifica-
tions so long as they do not nullify the intent of the requirements
and standards relating to Development Unit Projects, and so long as
the general public health, safety and welfare is not adversely
affected.
No one spoke in opposition to the requested amendment at the public
hearing. The Plan Commission voted eight (8) to zero (0) to recommend
.the Ordinance be approved.
