AN ORDINANCE AMENDING ARTICLE 37 OF CHAPTER 22 OF THE MUNICIPAL CODE,
BEING ORDINANCE NO. 2326-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968.
WHEREAS, it is the intent and purpose hereof to amend Article 37 of
Chapter 22 of the Municipal Code, commonly known as the
Zoning Ordinance of the City of Richmond, Indiana; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the 28th day of August, 1979, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance.
WHEREAS, the vote of the Richmond City Plan Commission was eight (8)
to zero (0) in'favor of recommending the passage of Ordinance
No. 90-1979.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich-
mond, Indiana, as follows:
SECTION 1. That Article 37 of Chapter 22 of the Municipal Code shall
read amended as follows:
ARTICLE 37
AD - AIRPORT DEVELOPMENT DISTRICT
37.00 PRINCIPAL PERMITTED USES: No building or structure
shall be erected, altered, enlarged or used which is
arranged or designed, or used for other than the
following uses; nor shall any property or improvement
thereon be used for any but the following uses, except
as provided herein and in Article 16,
37.001 General: Any use, which use would not conflict with
the operation of the airport because of its proximity
to the airport facilities and which use is established
in accordance with the provisions -of Article 40 here-
in and which use does not violate the rules and
regulations of the Aeronautics Commission of Indiana
or Federal. Aviation Administration.
37.01 ACCESSORY USES: Accessory uses, buildings or structures
customarily incidental to any aforesaid principal use
shall be permitted in conjunction with such use so long
as the accessory uses, buildings or structures do not
violate any rule or regulation of the Aeronautics
Commission of Indiana or of the Federal Aviation Administra-
tion.
37.02 REQUIRED CONDITIONS:
37.021 Distance From Property Lines: No building or structure
shall be less than fifty 50) feet distance from any
perimeter property line.
37.022 Storm Drainage Plan: Prior to the issuance of an Im-
provement Location Permit for any structure or use
within the Airport Development District, the owner
shall submit a master storm drainage plan, prepared
and certified by a licensed professional engineer or
by an architect or land surveyor who has demonstrated
expertise in drainage plans, for the approval of the
City Engineer and/or the County Engineer, indicating
the manner in which surface water shall be handled for
the entire area proposed to be developed within the
Airport Development District.

37.023 Sanitary Sewage Treatment and Disposal Plan: Prior
to the issuance of an Improvement Location Permit
for any structure or use within the Airport Develop-
ment District, the owner or leasee shall submit a
sanitary sewage treatment and disposal plan, pre-
pared and certified by a licensed professional
engineer, for the approval of the Richmond Sani-
tary District and/or the Wayne County Health
Department.
37.03 PROHIBITED USES:
37.031 Offensive Uses - Not to he Authorized: No use shall
be permitted or authorized to be established or
maintained which, when conducted under adequate
conditions and safeguards, in compliance with the
provisions of this Ordinance and any additional
conditions or requirements prescribed by other agencies
of local, state or federal government is, or may
become noxious or offensive by reason of odor, dust,
smoke, cinders, gas, fumes, noise, vibration, heat
Frequency, refuse matter or water -carried waste.
37.04 WEIGHT, LOT AREA FRONTAGE AND YARD REQUIREMENTS:
Height, lot area, frontage and yard requirements
for all principal and accessory buildings, struc-
tures or uses shall be regulated. by and in accord-
ance with the rules and regulations of the Aeronautics
Commission of Indiana and the Federal Aviation Administra-
tion.
SECTION 2.. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.

A public hearing was held on Tuesday, August 28, 1979, on the
Initiative .of the Richmond City Plan Commission to consider
amending Article 37 of the Zoning Ordinance. The amendments
to Article 37 are proposed for purposes of definition and
clarity and include ,changing the name of the zoning district
from Airport Industrial Park District to Airport Development
District and the addition of Sections 37.02, 37,021, 37.022,
37.023, 37.03 and 37.031 to the text of the Article..
At the public hearing, three property owners living in proximity
to the Richmond Municipal Airport expressed their concern over
the proposed Airport Development District.
The Plan Commission voted eight (8) to zero (0) to forward an
Ordinance to Council recommending Article 37 be amended in the
fashion indicated above.

Re: Zoning - Richmond Municipal Airport
The purpose of this memo is to set the agenda to achieve the zoning
reSUlt for the Richmond Municipal Airport - that which wat:suggested at the
work session of Cormon Council., September 10, 1979. The desired result is
that the entire airport be rezoned AZ.
The following steps will be necessary:
1. Report Ordinance #90-1979 back to Common Council
2. Motion to strike Ordinance #90-1979.
3. Vote to strike Ordinance #90-1979.
4. Bring Ordinance #60-1979 "off table".
5. A member of Council will make the following motion:
a) "to -delete from Section 1 of Ordinance #60 that part of
the said section beginning with the words 'EXCEPTING nEREPROM:'
to the end of Section-1";
b) "and further to delete.Section 2 of Ordinance k6o in its
entirety";
c) ' "and to alter the section designation 'Section 3' to be
'Section 2'
d) "and to delete from the title of said ordinance in the last
line thereof the words 'AND AIP AIRPORT INDUSTRIAL PARK DISTRICT' ".
6. Pass amended General Ordinance #60.
7. Let -Ordinance 059 stand as written. -
Amended General Ordinance #60 which you received in your packet several
weeks ago is the resulting ordinance after the aforesaid amendments.
