HomeMy Public PortalAboutr 97:167No. 97-167 Date of Adoption MAY 15, 1997 ENDORSING STATE CONCURRENT RESOLUTIONS NOS. 41 & 60 REGARDING UNDERGROUND STORAGE TANKS WHEREAS, the Borough of Carteret determines that abandoned properties create a significant burden to the taxpayers of the State of New Jersey, and WHEREAS, many of these properties are abandoned due to real or perceived environmental concerns including the presence of underground storage tanks containing hazardous substances, and WHEREAS, the municipality in which the abandoned sites generally becomes responsible for these abandoned properties and the underground storage tanks thereon, and WHEREAS, removal and remediation of these underground storage tanks places a severe financial and administrative burden on the municipality, WItEREAS, the People of the State of New Jersey approved in a vote on the November, 1996 ballot, the State Concurrent Resolutions Nos. 41 and 60 which dedicates four percent of the revenue annually received from the Corporate Business Tax Act for certain specific environmental purposes, and WHEREAS, the State Concurrent Resolutions Nos. 41 and 60 dedicates a minimum of one third of the dedication be allocated to underground storage tank upgrades, replacements, and closures as well as site remediation costs resulting from a hazardous substance discharge from an underground storage tank, and WHEREAS, this proposed legislation would stimulate the interest and development of these abandoned site by removing many of the real or perceived problems, NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Carteret endorses the Concurrent Resolutions and urges the State Legislature to incorporate within the necessary legislation a mechanism that would provide municipalities the opportunity to obtain grants to remove and remediate those underground storage tanks at properties that a municipality, through no fault of its own, becomes responsible for through the abandonment of the site.
