SPECIAL PLANNING COUNCIL MEETING November 10, 2009 The City of Opa-locka Planning Council met in special session on Tuesday, November 10, 2009, in the City Commission Chambers, 777 Sharazad Boulevard, Opa-locka, Florida, 33054 at 7:00 p.m. I. ROLL CALL Ella Cobb, Elio Guerrero, Alvin Burke were present. Sheila Pruett and Chairman Calvin Russell were absent. Mr. Alvin Burke was selected to chair the meeting since Mr. Russell was not present. II. INVOCATION AND PLEDGE OF ALLEGIANCE: The invocation was said by member Ella Cobbs and the Pledge recited in unison. III. PC Minutes 11/10/09 Page 1 of 4 Planning & Community Development Director Octavien A. Spanner introduced Karen Friedman and Shelley Eichner from Calvin Giordano & Associates. Lavelle Jenrette, Public Works Director; Ms. Judine Johnson, Public Works Engineer; and Fritz Armand Code Enforcement Director. They will be making the presentations on behalf of the City. The City Attorney, Burnadette Norris-Weeks was also present. Member Burke wanted to find the document verifying that the residents were notified of the hearing. For the record the 375 radius mail out to the residents was available as proof. The City Attorney mentioned that this is a quasi judicial hearing and asked Mr. Lee, the Clerk, to swear in the people who will be testifying. Mr. Fritz Armand came forward and was sworn in. He said this was a simple process to close a section of Dunad Avenue directly on the north side of Sherbondy Park according to the packet submitted which shows the survey, the legal description and sketch of lot and block of Dunad Avenue, the plat map, the impact of traffic, and impact of utilities, and the project itself. Next page shows Sherbondy Park whereby the lot located on the north side of the park and vacation of Dunad shows the new park. All requirements are up to code. The administrative building will be gone in order to have a better project and acquire some funding from the county which requires we unify the north side to the south side into one park. Mr. Spanner explained how this concept came along. Two years ago staff notified the County that they wanted to expand the project. Based on a study and recommendation from F1U to increase green space and beautify the environment. In order for the funding to be expanded the city needed to connect the administrative building (the former library) to Sherbondy Park. Therefore, vacating the street would be the ideal concept to present to Miami-Dade County. The traffic was looked as to how it would be converted. Banu Street will not be blocked and it will not become an unnecessary inconvenience or affect the residents living there or any emergency traffic. Member Burke asked about the staff recommendations. Spanner said they received the report from Calvin Giordano. He asked Ms. Eichner or Ms. Freidman to explain the recommendations. Ms. Eichner said that as a positive impact this vacation in the community in terms of developing this larger park staff determined that the vacation and abandonment of one block of Dunad Avenue does not create an undo hardship on adjacent property owners or traffic patterns of local residents. Instead this vacation and abandonment of one block of Dunad Avenue and the development of the expanded Sherbondy Park and community center will enhance the quality of life of the Opa-locka residents and extend recreational opportunities. Therefore, staff recommends that the Planning Council recommends the vacation of Dunad Avenue. Public Hearing for anyone who wants to speak for or against the project can do so now. Two residents came forward, Joan Gaura, 705 Sharar Avenue, was concerned whether her street was going to be affected. She was told that it would not affect her street. She was also concerned about shootings at Sherbondy Park, and the northern expansion of the park will affect their safety and shootings will be closer to her home and she is concerned about the safety of her six (6) children. Mr. Spanner explained that this project was in the books for over seven (7) years and it has to move forward or we will lose the funds. Mr. Lamar Jackson, Jr.650 Dunad Avenue questioned what the project entailed. Mr. Spanner said this project will be built in phases. It includes a pool, a gymnasium and a community center. With no one else to come forward to speak, Mr. Burke closed the public hearing. ROLL CALL: Motion passed 3-0 Ella Cobbs - yes Elio Guerrero—yes Alvin Burke— yes V. OTHER BUSINESS: Mr. Spanner briefly said the PC meets once a month. Right now the city is in a moratorium. Any development that comes before the Council must meet several requirements imposed by the City and Miami-Dade County and DERM. We don't want to bring any items that will stay for a year before getting approval. Knowing that staff needs basic support in terms of reviewing plans and legal issues the Commission decided to enter into an agreement with our planning consultants, Calvin Giordano and Associates. Therefore any items to come before the Planning Council they receive the documents and review them and make recommendations. This does not mean that staff doesn't have additional comments for you. This is the Planning Council and the members are appointed by the commission to serve and represent the community; therefore, staff makes recommendations to the best of their ability and making sure that with legal counsel that the members are advised on legal matters. Another issue is the time Planning Council meets. They meet the first Tuesday of the month at 7 pm. Mr. Spanner suggested if they could meet earlier, like 5:30 or 6 pm instead of 7. The council members were concerned regarding the citizens who may be working at that time. City Attorney said there may not be a need to meet unless something that needs to come before the Planning Council. As it stands the City has to get updated as far as the Evaluation and Appraisal Report (EAR), its Comp plan. The City is behind in its Comp plan and the review from the South Florida Regional Planning Council. There are a lot of things that need to be done which they are working on at this end. So there are different things that people may be proposing that require more density in different projects that are simply not ready to go and the City is not in a position to receive these projects because the State has to review them and make sure that we are meeting requirements of State law. There may not be a lot going on in the future that may necessitate a meeting. She does not want the staff to be in an uncomfortable position of maybe having explained it very well and wondered if this is the time to bring the Planning Council up to date as far as knowing where the City is. Member Burke asked why we would be behind on the EAR and Comp plan when we have a firm working on them. Spanner said we hired FIU Metropolitan Center to work on the EAR report and the Comp plan. The contract was signed in 2006. In 2007 unfortunately with property taxes being cut, that impacted several agencies including FIU Metropolitan Center. They had to cut staff and make some changes as well as South Florida Regional Planning Council. In the process of doing so and making changes in staff, our EAR process has been delayed which was out of our control. The city of Opa-locka EAR has been found sufficient. It has to be transmitted to DCA with whom they are communicating. The last communication received was this week before meeting with them. We will need this update in writing. The following step is to present an agenda item for payment to do the EAR based amendment. That item will go before the Commission in December. That process will take approximately 12 to 18 months. Mr. Lee said that in 1996 although EAR was found sufficient it had no EAR based amendments. Because that was not done, DCA is still looking at the 1996 EAR and asking where are the amendments. The contract PC Minutes 11/10/09 Page 3 of 4 with FIU, they understand that they needed to address the amendments never done and look at the things needing to be addressed. Mr. Spanner added that to DCA and the state we were in default. When he came on board in 2006 we immediately started the process because no development can happen or move forward without having the Comp plan updated. The next step is to do the amendments. Member Burke asked if the other items that have to come before the Planning Council will be affected. Mr. Spanner said yes because there are 2 projects with density issues, an ALF project on Sharazad and Biscayne Housing Group (Georgia Ayers). What we have done is work very closely with SFRPC in formulating a letter with the manager's signature requesting for us to move forward with these projects pending the EAR based amendments being completed. That could be a yes or a no. Ms. Friedman said that since the plan has not been updated for over 10 years there is a lot of new data and information that has to be brought current. If we were to do the Comp plan in a very quick time frame she would estimate 12 months. She also pointed out that there is a constitutional amendment on the ballot of next November called Hometown Democracy, and that ballot language will say is that every Comp plan amendment anywhere in the state of Florida will have to go to a referendum of all voters of that city. They have been in touch and discussing the matter with staff and the manager, and the recommendation will be to quickly ensure that the update of the EAR based amendment will be completed and adopted prior to November of 2010. Otherwise if the amendment passes at the November ballot we will then have to wait for the city's next election or schedule a special election to put it up to a referendum of the voters. Opa- locka is not alone; many other cities have not kept up to date their comp plans, but we need to move forward quickly into the future. Mr. Spanner submitted a time line to the City Manager that would be realistic. There is one issue because he has been 1 year with the City, there are contracts pending. We do have a contract with FIU to do the EAR based amendments in 2006. They sent us a proposal and if they decide to accept, it moves forward, if not and the Commission decides differently, it will be rescinded and staff recommendation would be to rescind and move forward.
