RESOLUTION REMOVING A MEMBER OF ZONING BOARD
OF ADJUSTMENT AND APPOINTING A REPLACEMENT
WHEREAS, by Resolution #96-77 of the Governing Body of the Borough of Carteret (the
"Borough") appointed William J. Kolibas, Jr. as a member of the Carteret Zoning Board
of Adjustments; and
WHEREAS, Mr. Kolibas holds an employment position with the Borough; and
WHEREAS, N.JS.A. 40:55D-69 prohibits members of the Zoning Boards of Adjustments
from "(holding) any ..... position under the municipality"; and
WHEREAS, Mr. Kolibas is not entitled to a hearing since he is not being removed for
cause, rather his appointment was and is statutorily prohibited;
NOW, THEREFORE, BE IT RESOLVED that:
1.) William J. Kolibas is hereby removed as a member of the Carteret Zoning Board of
Adjustment effective immediately as his position as a member conflicts with the
provisions ofNJ. S.A. 40:55D-69.
2) That John Riggio is hereby appointed as a member of the Carteret Zoning Board of
Adjustment, to fill the unexpired portion of Mr. Kolibas' term which expires
December 31, 1997.
Amended:
3) That James O'Brien, Jr. is hereby appointed Alternate #2, term to expire December 31,
1997.
Adopted this 15th day of May, 1997
and certified as a true copy of the
original on May 16, 1997.
