HomeMy Public PortalAbout093-1979 - REZONING - 624 NATIONAL ROAD WESTAMENDED SPECIAL ORDINANCE NO. 93-1979 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-2 ONE -FAMILY RESIDENCE DISTRICT FOR A MEDICAL OFFICE ON PROPERTY LOCATED AT 624 NATIONAL ROAD WEST, PURSUANT TO ARTICLE 48 OF CHAPTER 21 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article 21 of Chapter 21 of the Municipal Code allows medical offices by Special Use authorization as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance wa conducted by he Richmond City Planning Commission the .� h day of 1979, at which time remonstrances were heard fra all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Planning Commission was �e to in favor of/! recommending the passage of Ordinance No. 93-1979; therefore, BE IT O.�DAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 21 of Chapter 21 of the Municipal Code the following described use of the following described real estate is allowed as a Special Use for a Medical Office at 624 National Road West in the City of Richmond, Indiana; more particularly de- scribed; to wit: Being a part of lot #r`1 as laid out and platted by the Trustees of Indiana Yearly Meeting of Friends and deeded by them to Elwood Albertson, being bounded as follows: Commencing 202 feet south of the northwest corner of said lot, running thence east 103 feet 3 inches; thence south to the south line of said lot #1; thence west along the south line of said lot #1 to the southwest corner thereto; thence north along the west line of said lot to the place of beginning, EXCEPTING THEREFROM the fallowing described real estate, to -wit: A part of lot #1 as laid out by Indiana Yearly Meeting of the Religious Society of Friends and described as follows: Beginning at the intersection of the east line of Southwest 7th Street and the south line of the alley running east and west between Southwest A Street and National Road West; thence east along the south line of said alley 95.25 feet, more or less, to the northeast corner of that part of the outlot #r1 owned by said Rebecca E. Fulghum; thence south along her east line 40 feet; thence west parallel with the south line of said alley 95.25 feet to the east line of Southwest 7th Street; thence north 40 feet to the place of beginning, excepting 8 feet wide off west side of said lot #1 for widening 7th Street. SECTION 2. As a condition of the aforesaid Special Use.,and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times he met by the owner, leasee or any person, firm or corporation using said real estate. a. The site plan accompanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 93-1979. b. The Special Use authorization shall he considered null and void should the Special Use cease for a period of one (1) year or more. c. As a condition of the Special Use authorization, eight (8) offstreet parking spaces will be provided in conjunction with the proposed medical office and shall be developed in accordance with Article 41 of the Zoning Ordinance. d. Total sign area for the praposed medical office shall be limited to 12 square feet. SPECIAL ORDINANCE NO. 93-1979 Page Two SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publication of this Ordinance, to record and approve the issuance of a per- mit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be.in full force and effect from and after its passage and approval by the Mayor, and publication as by law required. Harris; Karl J. Kolger, Agent, requesting Special Use authorization for a proposed. medical office on property zoned.R-2 Single Family Resident District, located at 624 National Road West. Nine (9) notices of public he were.sent to adjoining property owners with one (1) retu'rned in favor of the request and none in opposition. No one spoke in opposition to the request at the public hearing. Section rwo (2) of the Ordinance as presently written contains the following two (2) conditions: a. The site plan accompanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 93-1979. b. The Special Use authorization sh-all be considered null and void should the Special Use cease for a period of one (1) year or more. The Plan Commission voted nine (9) to one (1) to recommend the Ordinance be amended by adding the following two (2) conditions to Section Two (2) of the Ordinance and that the Amended Ordinance be approved. c.
