WHEREAS, the Planning Council of the City of Opa-locka, Florida, has approved the vacation of the right-of-way of the parcel of land at the east end of property at 160 Ali Baba Avenue, East of the intersection of Veterans Way and Douglas Road; and WHEREAS, the legal description of the property is recorded in Miami-Dade Public Records, and is show on the attached Exhibit"A"; and WHEREAS, Aramark requests the City of Opa-locka to transfer ownership of said property for utilization by their business; and WHEREAS, the parties have previously entered into an agreement for the conveyance of the property and for compensation for the conveyance. NOW, THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: ORDINANCE NO. 10-12 Section 1. The recitals to the Preamble herein are incorporated by reference. Section 2. The right-of-way of the parcel of land at the East end of the property located at 160 Ali Baba Avenue(as set forth on the attached Exhibit"A")is hereby vacated,for the purpose of transferring ownership to Aramark Uniform Services, in accordance with the agreement of the parties.. Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. SEVERABILITY. If any portion,section,phrase or clause of this Ordinance is held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. EFFECTIVE DATE. Aramark Uniform & Career Apparel, LLC made a formal request for transfer of ownership concerning the paved area on the south-side of Veterans Way and the northwest corner of the Aramark building. (See Attached Map) The business makes use of this area to unload their trucks; this Opa-locka and is part of the expanded area of Veterans Way. The rAramark Corporation City nhasy roe posed to improve this area by installing new curbing and sidewalk that would follow the curve of the road, they have also proposed to improve the area by adding landscaping. Staff has reviewed this request and determined right of way must be vacated. Requested Vacation: This request is to vacate approximately 8,700 square feet, or .199 acres of Veterans Way, from the right of way area beginning at the northwest corner of the Aramark office building which is also the south side of Veterans Way, this area is triangular in shape. (See Attached Map) Full Information relative to time and method of transfer to public usage: On May 29, 1928 Ali-baba Avenue was plotted on the plat "OPA LOCKA PLAT NO. TWO" Plat Book 28, Page 72, Public Records of Miami-Dade County, Florida. The title to the boulevards, streets and alleys, including Ali-baba Avenue, were dedicated to the perpetual use of the public for proper purposes. Therefore on May 29, 1933 Ali-baba Avenue was transferred to public usage. On April 11, 1936 Ali-baba Avenue West was plotted on the plat "Second Revised Plat No Two of Opa-locka " which is a re-subdivision Plat No. Two of Opa-locka as recorded in Book 28, Page 72, of the public records of Dade County, Florida. Therefore on May 29, 1928 and on April 11, 1936 Ali-baba Avenue was transferred to public usage. Please see the attached copy of the Plats Names of all owners, with locations, having any type interest in the proposed vacation: Aramark is the owner of the property on the South side of Veterans and on the north side of Veterans Way. Therefore, Aramark is the only party with a vested interest in the proposed vacation. Impact of Vacation on traffic: The right of way is currently used to unload uniforms and work apparel from company vehicles. Regular traffic makes use of the two-lane undivided local street. Pedestrian traffic makes use of the sidewalk area on the north or south side of Veterans Way. According to Aramark, they propose that they would install new curbing and sidewalk that would follow the curve of the road of the vacated area, and would provide landscaping and other improvements to beautify Veterans Way. The vacation will not affect the vehicular traffic on Veterans Way because the area being vacated is not used for vehicular traffic. The vacation will not negatively impact the pedestrian traffic because the sidewalk will be installed at the North side of the vacated area and follow the curve of the roadway. The sidewalk may not be used during the new installation. Impact on utility installation: Within the vacation area any overhead power lines that Aramark requires moved must be at Aramark's expense. This policy is also applicable to any infrastructure that may be underground, specifically including water lines, sewer lines, drainage infrastructure, etc. Code Requirements: Per section 108 of the City of Opa-locka Code of Ordinances, "The City Commission may by ordinance make, from time to time, other additions to or modifications of the official map by placing thereon the location of vacation. Any such proposed addition to or modification of the official map shall be referred to the Planning Council for approval, but if the Planning Council disapproves or fails to act within 30 days, the City Commission by a majority vote of its members may overrule such disapproval." Per Section 97(a) (3) of the City of Opa-locka Code of Ordinances, the Planning Council shall "Draft for the commission an official map of the city and recommend or disapprove proposed changes in such map." Staff Recommendations: After review of the information presented staff finds that the vacation and abandonment of the area described at the north west section of the property identified as 160 Veterans Way (formerly known as Ali Baba Avenue) which is an extended right of way on the south side of Veterans Way, would not create an undue hardship on adjacent property owners or traffic patterns of local residents. Staff finds that the vacation and abandonment of this area and the installation of the changes proposed by Aramark would enhance and beautify the area for business and residents. Therefore, staff recommends that the Planning Council recommend the vacation of the described section of Veterans Way to the City Commission. Conditions of this approval: 1. Pay market value for the cost of this land 2. Infrastructure relocation is at the owner's expense 3. Allow an option for an easement in lieu of infrastructure relocation 4. The first request was made during Aramark's presentation informing the City of our intent to build a new processing facility adjacent to the current building. One discussion was how Aramark could utilize the surface area over a large diameter underground water line located at the Western edge of our property. A typical treatment of this situation would be to cover area with grass with no other improvements to allow full access by City and/or county utilities. Aramark would like to pave a one hundred feet long section of this area to allow for parking. No other improvements other than a perimeter fence would be placed over the water line. There would be no landscaping,curbing, storm drain or other improvements hindering access. The remaining one hundred sixty feet would be covered by grass only. The current arrangement has our building covering one hundred twenty feet of this line. Aramark would lose eight to ten parking spaces if we were to grass over the entire length. The loss of these parking spacing may require some employees to park in the existing lot on the North side of Ali Baba Avenue. A key facet of the proposed project is to keep all activities on the South side of Ali Baba Avenue. The benefit to the city would be that all Aramark related foot traffic across Ali Baba would be eliminated. Another potential benefit would be the sale of the Aramark property on the North side of All Baba Avenue at the completion of the construction. Aramark asks that the City consider our request and provide guidance on how we can honor access to the water line while keeping all functions on the South side of All Baba Avenue. The second request is in regard to the paved area fronting Ali Baba Avenue at the Northwest corner of our building. We are currently using this area to unload our service trucks,however it is owned by the City. Please refer to the simple drawing attached to this letter. Aramark would like to discuss having the City allow us the use of this area or possibly transfer ownership to Aramark. Aramark would like to improve this area during our parking area construction phase so that it will match improvements made to the other areas of the Aramark property. We would install new curbing and sidewalk that would follow the curve of the street. However,there needs to be agreement between Aramark and the City of Opa-Locka before we make the desired improvements.
