WARRANTY DEED
THE URBAN RENEWAL AGENCY OF McCALL, also known as the McCALL
REDEVELOPMENT AGENCY, Grantor, hereby conveys, grants and warrants to the CITY OF
McCALL, IDAHO, a municipal corporation, Grantee, whose address is 216 E. Park Street, McCall,
ID 83638, for the sum of TEN DOLLARS and other good and valuable consideration, the following
described real property, to -wit:
PARCEL 1:
A parcel of land situated in Block 10 and 3 of the First Addition to
the Townsite of McCall, Valley County, Idaho, a portion of vacated
McCall Avenue lying between Blocks 3 and 10 of said First Addition
and a portion of vacated Fir Street, more particularly described as
follows: Commencing at a point on the southerly boundary of Lot 1,
Block 10 of the First Addition to the Townsite of McCall, which
point is the intersection of the northerly right of way line of Pine
Street and the easterly boundary of the right of way of the Idaho
Northern Line of the Oregon Shortline railroad:
Thence northeasterly along the easterly boundary of such right of way
to a point which lies northerly a distance of 80 feet from the northerly
right of way line of Pine Street measured along a line at right angles
to such northerly right of way line of Pine Street, which point is the
real point of beginning; thence Westerly along a line which is parallel
to the North right of way of Pine Street, to such line's intersection
with the westerly boundary of such railroad right of way; thence
northeasterly along the westerly boundary of such railroad right of
way to its intersection with the centerline of McCall Avenue; thence
northerly along the centerline of McCall Avenue to the northerly
boundary of Fir Street; thence easterly along the northerly right of
way line of Fir Street to its intersection with the easterly boundary of
such railroad right of way; thence southerly and westerly along the
easterly boundary of said right of way to the Real Point of Beginning.
PARCEL 2:
A parcel of land being a portion of Lots 11 through 15, Block 3, and
vacated McCall Avenue, McCall's First Addition to the Village of
McCall, as shown on the official plat thereof on file in Book 1, Page
28 of Plats and on that particular Record of Survey on file in Book 2,
Page 183 of Records of Survey as Instrument No. 161504, in the
office of the Recorder of Valley County, Idaho more particularly
described as follows:
Commencing at the southwest corner of Lot 15, Block 3, of said
McCall's 1st Addition; thence S.81°25'00" E., 14.00 feet along the
southerly line of said Lot 15 to the easterly right of way of Mill Road,
the Real Point of Beginning; thence continuing S 81 °25'00" E., 98.15

feet along said southerly line to the westerly right of way of the
Oregon Shortline Railroad right of way, thence N. 27°54'00" E.,
150.54 feet along said Oregon Shortline right of way to its
intersection with the centerline of vacated McCall Avenue, thence
N. 8°35'00" E., 7.83 feet along said centerline to its intersection with
the southerly right of way line of vacated Fir Street; thence
N. 81 °25' 00" W., 147.96 feet along said southerly right of way line to
its intersection with the easterly right of way of Mill Road; thence
S. 8°35'00" W., 149.89 feet to the Point of Beginning.
SUBJECT TO taxes and assessments for the year 2012 and all subsequent years,
together with any and all existing easements, rights -of -way, reservations, restrictions
and encumbrances of record, to any existing tenancies, to all zoning laws and
ordinances, and to any state of facts an accurate survey or inspection of the premises
would show.
Taxes or assessments which are not shown as existing liens by the records of any
taxing authority that levies taxes or assessments on real property or by the public
records.
Any facts, rights, interest, or claims which are not shown by the public records but
which could be ascertained by an inspection of said land or by making inquiry of
persons in possession thereof.
Easements, claims of easement or encumbrances that are not shown by the public
records.
Any encroachment, encumbrance, violation, variation, or adverse circumstance
affecting the title including discrepancies, conflicts in boundary lines, shortage in
area, or any other facts that would be disclosed by an accurate and complete land
survey of the land, and that are not shown in the public records.
(a) Unpatented mining c 1 aims; (b) reservations or exceptions in patents or in Acts
authorizing the issuance thereof; (c) water rights, claims or title to water, whether or
not the matters excepted under (a), (b), or (c) are shown by the public records.
Any liens, or rights to a lien, for services, labor or material theretofore or hereafter
furnished, imposed by law and not shown by the public records.
ALSO SUBJECT TO that certain Quitclaim Deed filed for record in the office of the
Recorder of Valley County, Idaho on December 2,1985 as Instrument No. 145320.
ALSO SUBJECT TO that certain Mineral Deed filed for record in the office of the
Recorder of Valley County, Idaho on January 10, 1990 as Instrument No. 171270.
WARRANTY DEED - 2.
This conveyance shall include any and all appurtenances, tenements, hereditaments,
reversions, remainders, easements, rights -of -way and water rights in anywise appertaining to the
property herein described.
The Grantor covenants to the Grantee that it is the owner in fee simple of said premises; that
the premises are free from all encumbrances, excepting those as may be herein set forth, and
excepting those of record, and that it will warrant and defend the same from all lawful claims.
