HomeMy Public PortalAboutResolution 61-164CITY OF TEMPLE CITY RESOLUTION NO. 61 -164 TEMPLE CITY IMPROVEMENT NO. 1 WOOLLEY STREET (A PRIVATE STREET) CONSTRUCTION OF SANITARY SEWERS A RESOLUTION INSTITUTING PROCEEDINGS ACKNOW- LEDGING WAIVER OF DEBT LIMIT INVESTIGATION PROCEEDINGS AND DIRECTING PREPARATION OF PLANS AND SPECIFICATIONS. WHEREAS, a petition for the construction of sanitary sewers in Woolley Street and other rights of way, signed by persons represent- ing ownership of 65% of the area of lands in the district hereinafter proposed to be assessed for the improvement, has been presented to the City,Councii of the City of Temple City; and WHEREAS, said petition contains a waiver of debt limit investi- gation proceedings, signed by all the owners of more than 60% of the area of the property subject to assessment for said proposed improve- ment, whose names appear on the Assessor's roll, as provided in Sec- tion 2804 (3),Division 4, Streets and Highways Code; and WHEREAS, the present intent of the City Council is to acknow- ledge the waiver of debt limit investigation proceedings pursuant to the provisions of said Section 2804, institute proceedings and direct preparation of plans and specifications for the proposed improvement; and WHEREAS, the County Engineer has been appointed City Engineer of the City of Temple City and will thus provide certain acts, services and forms in these proceedings; and WHEREAS, the County of Los Angeles must be compensated by the pity of Temple City for these acts, services and forms provided by the County Engineer in these proceedings; and WHEREAS, the City of Temple City will be reimbursed in whole or in part for this compensation from the incidental charges advanced by the contractor. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESOLVES AND DETERMINES THAT: 1. The public interest and convenience require the improvement, and proceedings are hereby instituted for the construction of sanitary sewers and appurtenant work in Woolley Street (a private street) and other rights of way within the dis- trict as shown, in general, on a map attached hereto. 2. The district of lands proposed to be assessed to pay the cost of said improvement shall include in general, the area within the boundary of the district as indicated on said man. 3. Said petition filed with the Clerk of the City Council is adequate' and signed by the required number of owners to waive the debt limitations prescribed by Division 4, Streets and Highways Code. Therefore, the provisions of said Div - ision' 4 do not apply. 197 4, The City proposes to pay no money toward the total cost of the improvement from any source other than special assess- ments upon benefited property. 5. The proceedings for the improvement shall be conducted un- der and in accordance with provisions of Division 7 of the Streets and Highways Code of the State of California: 6, This project shall be known as Temple City Improvement No. 1, Woolley Street (a private street) and other rights of way. 7, The City Engineer is hereby requested to provide all nec- essary resolutions, reports, plans, specifications, esti- mates, maps, notifications, proposal forms, contract forms, bond forms and any other acts,. services or forms necessary to assist the City of Temple City in completing this project. 8: The City of Temple City will reimburse the County of Los Angeles for all costs incurred by the County Engineer on this project in accordance with the General Services Agree- ment. 9 The City Clerk is directed to forward one certified copy of this resolution to the County Engineer.
