HomeMy Public PortalAboutResolution 61-165RESOLUTION NO. 61 -165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, VACATING EASEMENT WITHIN TRACT 26522 PURSUANT TO ORDINANCE NO. 61 -43 AND PUBLIC SERVICE EASEMENTS VACATION LAW. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESO.T.VE AS FOLLOWS: SECTION 1. On May 22, 1961 the City Council of the City of Temple City adopted Ordinance No. 61 -43, wherein and whereby the City Council of the City of Temple City declared its intention to proceed to vacate that certain easement hereinafter described in Section 2, pursuant to Article 5, Title 5, Division 1 of the Government Code. (Public Service Easements Vacation Law) (Gov. Code 50430 - 50445) SECTION 2. The easement, subject of Ordinance No. 61- 43 and this Resolution is described as follows: An easement for light and air over the easterly 30 feet of Lots 16, 17, 18 and 19, and the southerly 30 feet of Lots 20, 21, 22, 23, 24, 25 and 26, and the westerly 30 feet of Lots 27, 28, 29 and 30, of Tract No. 10558, Book 178, Pages 4 & 5 of Maps, included within certain strips of land 6o feet wide lying between the lines designated as "build- ing set back lines," such strips to be kept open and free from building and structures of any kind excepting irrigation and sprinkling systems and appurtenances thereto, as shown upon and as dedi- cated by the map of said Tract No. 10558. SECTION 3. The easement described in Section 2 immedi- ately above is shown on that certain map described as TRACT NO. 26522 on file with the City Clerk of the City of Temple City, located in the City Hall of the City of Temple City at 9664 East Las Tunas Drive, Temple City, California, and has been on file at all times on and after May 22, 1961. SECTION 4. On June 12, 1961 at 7 :30 p. m. in the City Hall of the City of Temple City at 9664 East Las Tunas Drive, Temple City, California, the City Council duly held a public hearing in accordance with Ordinance No, 61 -43. SECTION 5. The City Council of the City of Temple City expressly finds from all of the evidence submitted that the easement described in Section 2 of this Resolution and as shown on Tract Map 26522, referenced above in Section 3 of this Resolution, is unnecessary for present or prospective public use and the City Council does hereby order the vact- tion thereof. SECTION 6. The Clerk shall cause a certified copy of this Resolution, to be recorded in the office of the County Recorder of Los Angeles County, California.
