The following members of Council were present: James Burke, Jack Youmans, Whitley Reynolds, Walter Crawford, Jason Buelterman and Richard Barrow. City Attorney Edward Hughes and City Manager Bob Thomson were also present. Deacon F. Crider gave the invocation. The Pledge of Allegiance was recited. Mayor Parker asked James "Peewee" Ray, DPW laborer to come forward and be recognized for his honesty and how much Tybee appreciated his actions. Mayor Parker presented the oldest Council member with a deluxe spittoon telling Youmans that we appreciates is wisdom, humor and are glad he is ours. Judge Emory Bazemore addressed Council and told them thank you for last years Santa's tent out front of City Hall. Bazemore said he would like the City Hall to be fully decorated this year, maybe get the different choirs from the island to come and sing from 7:30 P.M. until 8:30 P.M. each night. Santa will be there from December 20th until the 24th. Parker told Bazemore that they have all been good little boys this year. Crawford said that he will make a recommendation to form a Christmas Citizens Committee and asked Bazemore if he would chair the committee. Bazemore answered yes, would be happy to chair, we are all blest to live here. Jimmy Williams presented Council with a petition from the Captain Row's homeowners protesting the swapping of Hollywood dune crossover for the crossover at the end of Van Horn. Parker said that this was discussed at the pre session and that Council will take no action on decision that was made at the October meeting. A meeting will be set up as soon as possible with members of Council, Captain's Row homeowners and Lighthouse Point Condo Association. Mallory Pearce addressed Council on the Weed and Rodent ordinance that is before them tonight for a second reading. Pearce asked that Council reconsider, this is an invasion of private property. A five -foot buffer would be all right. Also this ordinance will be hard to enforce. Pearce explained about the different types of rats and where they live. The Norway and Black rats infest human house and junk piles. Crawford asked if Pearce was familiar with the City of Savannah ordinance on rank vegetation on unattended lots. Pearce answered no, but Tybee needs to be very specific. Anne Monaghan agreed with Pearce. Betty Beeson said that she was present presenting the Tybee Beautification Committee and they request that the City continue financial support for 2003 as they have for 2002. An Anti -Litter campaign will be started in the spring with 10,000 disposal bags. There will also be two beach sweeps scheduled in 2003. Jack Boylston tanked Council for the support of Symphony by the Sea and said that the DPW crew that helped put their hearts and soul into the event. Henry Levy spoke to Council on the Park of the 7 Flags issue concerning ownership of the vee section that Arby's says they own. Levy said that the City owns that property and that he had personally spoke with all the owners in the area about he park. Rusty Fleetwood asked if the City had any improvement plans for the north beach parking area. Parker said not at this time. Fleetwood would like to propose a long -range 1 1 1 plan and he has people who want to work on it. Fleetwood asked if Council would consider a citizens committee with Burke and Buelterman serving as ex- officio members. Parker told Fleetwood to get the names to the city. Kathryn Williams introduce Kelly Lewis as the new Marine Science Director. Mayor Parker opened the public hearing on the 2003 proposed budget. City Manager Thomson introduced Chris Lightle of the audit firm of Karp, Ronning and Tindol. Lightle gave a presentation on what the budget means, why the City adopts a balance budget and the state laws that go with it. Copy of the power point presentation becomes a part of these minutes. Lightle said that this is in no way to be a budget process. This is the process with services and how to finance, with citizens input. Parker closed the public hearing. There were no comments from the audience. Mayor Parker opened, asked for comments and closed the following public hearings according to State law and Tybee ordinances. Zoning Administrator Donald "Dee" Anderson presented the following petitions for a public hearing with no comments from the audience. Chu Terrace PIN 9 -4 -7: Variance for Jeff Cramer for front stairs of 7 feet at 109 General George Marshall Blvd. PIN 1 -8 -12: Site Plan for Joe Dabit at 202 Butler Avenue PIN 4 -4 -2: Variance for the Shore Protection Act in order to build a fence for privacy for Hannavas, L.P. 1107 Bay Street PIN 21- 16 -11; Special Review and Site Plan for a Guest Cottage for Ann Haskell at 3 Moore Avenue PIN 2 -2 -10: Variance for a 4 foot side setback for Jane & Tom Philbrick at # 2A 11th Place PIN 7 -2 -18: Zoning text Amendment for Substandard Lots of Record on its first reading. Minor Subdivision for Curtis Hanks at # 11 18th Street PIN 9 -6 -7. Anderson said the existing house sits on 2 lots and Hanks is proposing to move and elevate the house to comply with FEMA. The Planning Commission vote 6 to 2 in favor of the minor subdivision, and 1/2 foot height variance on ridge of roof. Anderson said a portion of the roof is being removed. Mr. Hanks said the addition was built in 1996 to store the heat/air conditions and the hot water heater and it is similar to an elevator. The house predates 1912 and he plans to continue to restore. Hanks said he would have to destroy tongue and groove heart pine in ceiling if made to remove the addition. Burke said if you removed the 6.8 -foot door and reduce the entrance to 3 feet. Michael Graham, former owner of the property, said that when he did the addition in 96 it complied with all the zoning ordinances — he said he had to figure a way to get this in the attic, there is a small stairway up into the attic that you have to duck down and set over the return portion of the unit. Graham said there are two water heaters, and the only furniture is a drafting table. Chuck Powell said that it would be 5 feet over the height limit and that all the owners that have built in that area have adhered to the height regulation. Hanks said that he would not be able to meet FEMA regulation without the height variance. Hanks said this is only a small variance. Mayor Parker opened the meeting for business legally presented. Crawford moved to approve the consent agenda consisting of minutes from October 10th and 24th City Council: Green Space Form letter to MPC by November 19th — each City get share based on population - $17,000. estimated for Tybee Island: Concerned Boating 1 1 1 Committee members — Henry Meyer, Dick Smith, James Moore, Jeff Schroeder, Jody Sadowsky and Alan Piper: Ante Litem — Sand Castle — denied: Charlie Waggoner — rewrite senior citizen grant for DCA — not to exceed $1,000.: Santa at City Hall December 20 through 24, 2002. Youmans seconded. Vote by Council was unanimous. Burke moved to approve the minor subdivision for Alexander at 1515 Butler Avenue PIN 8 -7 -3. Youmans seconded. Vote by Council was 5 in favor (Burke, Youmans, Crawford, Buelterman and Barrow); 1 abstained (Reynolds). Crawford moved to approve the variance of 5 feet side yard for Bart at 1505 Chatham PIN 10 -3 -12. Burke seconded. Vote by Council was unanimous. Crawford moved to approve the site plan and 10 foot front yard setback variance for Chu at # 16 T.S. Chu Terrace PIN 9 -4 -7. Burke seconded. Vote by Council was unanimous. Crawford moved to approve 7 -foot front setback variance for stairs for Cramer at 109 General George Marshall Blvd. Burke seconded. Vote by Council was 5 in favor (Burke, Youmans, Crawford, Buelterman and Barrow); 1 abstained (Reynolds). Burke moved to approve the site plan for Dabit at 202 Butler Avenue PIN 4 -4- 2, contingent upon all concrete surfaces to be pervious. Youmans seconded. Vote by council was unanimous. Buelterman moved to accept and approve Planning Commission's recommendation for Hanks minor subdivision "approve request, with the exception of the height variance for the cupola, stating elevate to minimum requirements specified by FEMA, exclusive of any thing above the main ridge line of house ". Crawford seconded. Vote by Council was 5 in favor (Burke, Youmans, Crawford, Buelterman and Barrow); 1 abstained (Reynolds). Burke moved to deny a variance from the shore protection act for a fence at 1107 Bay Street Hannavas, L.P. PIN 21- 16 -11. Youmans and Crawford seconded at same time. Vote by Council was 3 in favor of denial (Burke, Youmans and Crawford); 2 opposed (Buelterman and Barrow); 1 abstained (Reynolds). Burke moved to approve special review and site plan for a guest cottage for Haskell at 3 Moore Avenue PIN 2 -2 -10. Youmans seconded. Vote by Council was 5 in favor (Burke, Youmans, Crawford, Buelterman and Barrow); 1 abstained (Reynolds). Crawford moved to approve a 4 -foot side yard setback variance for Philbrick at # 2A 11th Place PIN 7 -2 -18. Burke seconded. Vote by Council was unanimous. Youmans moved to adopt the zoning text amendment on substandard lots of record on its first reading. Burke seconded. Vote by Council was unanimous. The Planning Commission did not have time to study the ordinance but will bring their recommendations to Council at the December meeting prior to second reading. Youmans moved to approve the alcohol beverage license for the Beach Club, Wanda Parker, 1518 Butler Avenue. Reynolds seconded. Vote by Council was unanimous. Crawford moved to approve the alcohol beverage for Alan Burns, A -J's Dockside Restaurant, 1315 Chatham Avenue. Burke seconded. Vote by Council was unanimous. Buelterman moved to deny the first reading on the proposed 2003 budget. Crawford seconded stating that he has gotten three different budgets and has not had time to study the last one. Crawford said that Council need to consider Lightles' 1 1 1 recommendation to pay off the two loans. Vote by Council was unanimous. Workshops will be set up. Council will let Brown know when it is convenient for them to meet. Crawford introduced Richard Kautzman of the drainage task force saying that the other two members could not attend the meeting tonight. Buelterman gave an update of the water sewer committee recommendations: 1 a tier fee charge for commercial users: 2. Take revenues from the cell antennas at a future date and earmark for water sewer capital improvements: 3. a transfer of ownership fee. Crawford moved to adopt a resolution read by Thomson concerning encouraging homeowners to use shallow wells instead of sprinkler systems. Buelterman seconded. Vote by Council was unanimous. Buelterman informed Council that the revised aid to construction fee that was adopted by Council in July has brought produce $10,000 in additional revenue for the City. Youmans asked permission to have the zoning text amendment on the C -2 setbacks be advertised for the December meeting for a public hearing. Crawford seconded. Vote by Council was unanimous. Crawford moved to approve the longevity pay for the employees to be paid with the payroll ending November 20, 2002. Buelterman seconded. Vote by Council was unanimous. Crawford said that he is satisfied with information on the Beach Task Force at this time and will revisit the issue in a few months. Crawford moved to form a Christmas Citizens committee with Bazemore as Chair and to take $5,000 from contingencies to purchase decorations. Barrow seconded. Vote by Council was unanimous. Hughes explained Dr. Gail Lamb's request to purchase a portion of Lovell Avenue and asked Council if they wished hi to advertise a public hearing at the December meeting. Buelterman moved to deny having a public hearing to consider the selling of a portion of Lovell Avenue to Lamb. Burke seconded. Council voted 4 in favor of denial (Burke, Crawford, Buelterman and Barrow); 1 opposed (Youmans): 1 abstained (Reynolds). SPOLST items will be discussed at the budget workshops with a money amount attached. Crawford said that the parking decal only is just one of the 18 or so items mentioned by the Parking Committee. A list of these recommendations will be given to Mayor, Council, City Attorney, Clerk of Council and Parkin Director Conaway. Conaway said by making beach side of Butler from Center to le Street decal only the City would lose about $65,000 in revenue. Burke said that the parking lots should be charges by the hour. Barrow said that the planner should make recommendations so that everybody will be on the same sheet of music. Burke moved to approve the 3 studies for retirement amendments. Crawford seconded. Vote by Council was unanimous. Burke moved to have the Mayor, the Mayor Pro tem and the City Manager authorized for signing of checks and the C.D of $300,000 at the Bank of America. Reynolds seconded. Vote by Council was unanimous. Crawford moved to give the authority to handle the $600,000 CD at the Savannah Bank to Thomson to max the interest and to follow recommendations of auditor Chris Lightle. Reynolds seconded. Vote by Council was unanimous. 1 1 1 Reynolds moved to approve direct deposit for the employees. Burke seconded. Vote by Council was unanimous. Hughes will meet with GMA attorney Doug Durr to discuss personnel issues and to take about safety sensitive positions in order to update the drug policy for random drug testing. On November 15, 2002. Barrow moved to put a $4,000 a month cap on the outside accounting by Karp, Ronning and Tindol until a permanent City Treasurer/Purchasing Agent is hired. Reynolds seconded. Vote by Council was unanimous. Burke moved to accept the 2 contracts with RDC for the Short Term Work Program in the amounts of $2,625 for the update and $4,875 for the Comprehensive Plan. Crawford seconded. Vote by council was unanimous. Burke moved to approve Section 5 -2 -8 Weeds, grass and other Growth on second reading. Youmans seconded. Vote by Council was 5 in favor (Burke, Youmans, Reynolds, Crawford and Barrow); 1 opposed (Buelterman). THEREFORE, it is distinctly understood and mutually agreed as follows: I. PERFORMANCE OF SERVICES: The City hereby agrees to engage the CGRDC and the CGRDC hereby agrees to perform the services stipulated in this agreement in accordance with the terms and conditions contained herein. The parties understand that, pursuant to DCA rules, the STWP Update will be prepared using the DCA "PlanBuilder STWP Tool." SCOPE OF WORK: The CGRDC shall do, perform, and complete in a satisfactory and proper manner the following work and services: A. Assist the City in forming an Advisory Committee. The Committee will be responsible for working with CGRDC staff and County staff to produce the proposed STWP update, and will advise the City Council of issues and recommendations. The CGRDC will assist the Committee, along with the City in conducting a public hearing. Through the hearing and the STWP update process the CGRDC will assist in (1) educating the community about the benefits of incorporating the DCA's "Quality Community Objectives" (QCO's) as part of the plan implementation process and (2) reviewing the appropriateness of incorporating these "smarter growth" principles into the Plan. 1 Contract Page Two B. Prepare a "Report of Accomplishments" working with local staff and the Committee. The report should address the status of each item in the 1998 STWP. Attend one meeting of the City Council for the purpose of answering questions.
