HomeMy Public PortalAbout10-20 Water and Sewer Rates 1st Reading: July 14, 2010 2"d Reading: July 28, 2010 Public Hearing: July 28, 2010 Adopted: July 28, 2010 Effective Date: July 28, 2010 Sponsor: Commissioner Holmes ORDINANCE NO. 10-20 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OPA-LOCKA, FLORIDA; AMENDING CHAPTER 21, ARTICLE II, SECTION 21-77 OF THE CITY OF OPA- LOCKA CODE OF ORDINANCES, ENTITLED "SCHEDULE OF RATES GENERALLY" BY AMENDING PROVISIONS RELATED TO WATER AND SEWER RATES FOR FISCAL YEAR 2010-2011 AND SETTING UP WATER AND SEWER RATES FOR FISCAL YEARS 2011-2012 AND 2012-2013; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR CODIFICATION AND SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, municipalities may enact reasonable regulations to promote the health, safety and welfare of citizens; and WHEREAS, the City Commission of the City of Opa-locka ("City Commission") desires to amend Chapter 21, Article II, Section 21-77 of the City of Opa-locka Code of Ordinances entitled "Schedule of Rates Generally", relating to water and sewage rates for the City of Opa- locka("City"); and WHEREAS, the City Commission has determined that it will be in the best interest of the City to amend Section 21-77 entitled "Schedule of Rates Generally" relating to increases in water and sewage rates for the City. THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS: Section 1. The recitals to the preamble herein are incorporated by reference. Ordinance No. 10-20 Section 2. The City Commission of the City of Opa-locka hereby amends Chapter 21, Article II of the City of Opa-locka Code of Ordinances entitled "Service Rates and Charges", by amending Section 21-77 entitled "Schedule of Rates Generally" as set forth herein: Sec. 21-77. Fire hydrant service charges - A fire hydrant service charge as specified in the City of Opa- locka schedule of rates, fees and charges for water and sewer service, shall apply for all customers within the city's service area. This charge covers the cost of installation, replacement, repair and maintenance of fire hydrants, in addition to the cost of upgrading water mains to provide required fire flows. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Ordinance No. 10-20 Section 5. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. This Ordinance shall upon adoption, become effective immediately. An additional tier(for a total of four) will be added to the water rate structure and the ranges will decrease. 2. The water rates in tier 1, 2 and 3 (up to 15,000 gallons) will decrease. 3. The ranges in the water rate structure will decrease. 4. The sewer rate in tier 1 and 2(up to 10,000 gallons) will decrease. 5. Both commercial water and sewer rates will increase by 3.5%. The proposed rates will bring relief to the residents while, at the same time, provide the necessary resources to allow the City to continue with planned activities. Financial Impact: The recommended rates will not have a negative impact on revenue and will allow staff to continue with adopted budgeted activities. Projections indicate that the recommended rates will result in a slight increase in water and sewer revenue. Implementation Timeline: Next rate adjustment will occur October 1, 2010. Analysis: In 2007, the City of Opa-locka hired a consultant to complete a comprehensive water and sewer rate study. That study resulted in a multi-year plan of rate increases from FY 2009 to FY 2013 that were required to meet the City's projected water and sewer financial requirements for that time period. However, since that time, the City had experienced changes (i.e. changes in the timing of capital projects and supplemental funding for capital projects) that would allow changes in utility rates without jeopardizing positive cash flow and financial stability of the water and sewer fund. In November 2009,the multi-year rate increase plan was amended as the City Commission's response to the economic downturn the country was and is still experiencing to the present. However, the prolonged effect of the economic meltdown prompted the City's leaders, once again, to respond to the concerns of the City's utility customers,thus this utility rate amendment is being proposed. The outline of the new structure is shown below: 1. Residential rates will be adjusted as follows: a. The ranges in the residential tier for water and sewer will decrease. The ranges in the residential rate structure will increase. 2. The rates in tier 1 and tier 2 will decrease. 3. An additional tier(for a total of three)will be added to the sewer rate structure. These rates will bring relief to the residents while,at the same time,provide the necessary resources to allow the City to continue with planned activities. We are also correcting an error that was made with the Ordinance 08-03. In that ordinance,the fire hydrant fee schedule was inadvertently deleted. We are putting the schedule back in the ordinance as is. There are no changes to the fees. Financial Impact: The recommended rates will not have a negative impact on revenue and will allow staff to continue with adopted budgeted activities. Projections indicate the recommended rates will not result in a negative water and sewer revenue position. Staff will commission a new rate study in FY 2010. Implementation Timeline: Next rate adjustment will occur November 1,2009. f. f Additionally, I will recommend that an Amnesty Program be approved by the Commission. It is proposed that amnesty be given to all households who are currently utilizing municipal water but unaccounted for. At this time a limited analysis leads us to the conclusion that there may exist, in the system, unaccounted users. In an effort to avoid a time consuming and costly process to identify unaccounted users, I am recommending this strategy. It is important to note that no hard evidence exists to tangibly document the magnitude of this problem, if it exists at all. However, plans are now being developed to implement a block-by-block assessment for the first time in twenty (20)years to certify the number of users on the system. The outline of the program would be as follows: 1. 60 day amnesty period. 2. All responding must pay a deposit, no questions asked. 3. Each unit will be inspected to determine if each water or meter connection meets codes. 4. Subsequent to the 60-day period and block-to-block assessment, all households accessing unauthorized water will be prosecuted to the full extent of the law. Orji Assistant City Manager/Finance Director City of Opa-Locka 780 Fisherman Street Opa-Locka, Florida 33054 Re: Update to FY 2007 Utility Rate and Fee Study Dear Dr. Orji: This letter is intended to provide the results of a limited update to the FY 2007 Utility Rate and Fee Study (Rate Study) conducted for the City of Opa-Locka (City) by Burton & Associates. Specifically, this update prepared revised rates for the City's water and sewer systems for FY 2011 based upon 1) updated FY 2011 revenue requirements as provided by City Staff as well as actual billing and consumption information for FY 2009, and 2) concerns of City Commissioners and customers. FY 2011 Revenue Requirements & Billing Data The Rate Study performed in 2007 provided for a multi-year plan of rate increases for FY 2009 through FY 2013 that were required to meet the City's projected water and sewer cost requirements over that time period. The annual water rate revenue increases that were identified in the Rate Study and subsequently adopted by the City Commission were 14% in FY 2009 through FY 2012, and 2% in FY 2013. The annual sewer rate increases identified in the Rate Study and adopted by the City Commission were 24% in FY 2009 through FY 2012, and 6% in FY 2013. However, given changes in the timing of capital projects and the increase of supplemental funding available for certain capital improvements (i.e. economic stimulus monies), City staff believed that revenue adjustments of only 7% and 14% for the water and sewer systems respectively were needed in FY 2010. In addition, there were certain rate structure concerns from the City Commissioners and customers. As such, an updated FY 2010 rate structure was developed in September of 2009 (referred to hereafter as the "Updated Analysis") and implemented in FY 2010. The Updated Analysis then assumed that the previously approved annual rate adjustments from the Rate Study for each system in FY 2011 through FY 2013 would be implemented as scheduled in order to ensure adequate revenues sufficient to meet the previously projected cost requirements of the enterprise fund during that time. As a result, the analysis presented herein reduced the rate increase in FY 2011 accordingly as part of preparing the rates for FY 2011 contained in this letter report. As with the Updated Analysis, the analysis presented herein assumes that the previously approved annual rate adjustments for each system in FY 2012 and FY 2013 will be implemented as scheduled for the time being. This is with the understanding that the City will perform a complete update of the Rate Study during FY 2011 in order to determine updated rate increase requirements for the water and sewer systems based upon current circumstances and updated projections of future costs and supplemental funding availability. The billing information utilized to calculate the FY 2011 rates contained herein is based upon detailed FY 2009 billing data, adjusted to reflect aggregate changes in consumption and the number of customers by customer class and by service as estimated for FY 2010 (based upon year-to-date unaudited information through April 30, 2010). It is important to note that to the extent demands do not occur as projected for FY 2011, it would likely result in a revenue shortfall to the City. While this does result in some short-term revenue risk in FY 2011 from the rates presented herein, we believe any variances should be within acceptable tolerances. Moreover, the City has committed to performing a comprehensive rate study in FY 2011 that will result in a detailed review of billed consumption by tier and will subsequently make adjustments to future revenue projections and rate increase requirements as necessary. Rate Design Changes Due to Commission and Customer Concerns The rates for FY 2011 contained herein reflect the reduced revenue requirement for FY 2011 as noted previously and also reflect certain structural changes in response to Commission and customer feedback. The initial rate structure from the Rate Study was implemented in calendar year 2008, and was developed in order to promote water conservation, shelter essential domestic water use, and maintain affordability to the greatest extent possible. Since implementation of the initial rate structure, concerns were raised regarding even greater levels of affordability, cost allocation between customer classes, and the impacts of the inclining block rate structure to larger families. As such, the Updated Analysis was performed and the present rate structure was implemented in FY 2010. However, additional concerns have been raised relative to the cost of essential domestic water consumption and maintaining affordability given the impact of the extended economic downturn to the citizens of the City. Create a new affordability tier for residential customers that would include all water use up to 5,000 gallons per month (5,000 gallons represents the average monthly residential water use). This tier would include a significant portion of the essential domestic water requirements of residential customers and would reflect a rate that is lower than the City's current first tier rate. 2. Update the block ranges of the existing inclining block rate structure based upon multiples of the current average residential monthly use and the typical discretionary use profile for residential customers (See Tables 1 & 2 below for additional details). 3. Update the uniform water and sewer consumption rates for commercial customers to reflect an inflationary-like rate increase. 4. Develop an affordability tier and update subsequent tiers for billed residential sewer consumption to be consistent with the recommended tiers for the water inclining block rate structure (i.e. an affordability tier for the first 5,000 gallons per month, while the second tier would be for use between 5,001 to 10,000 gallons per month, and the third tier would be applicable to all use above 10,000 gallons per month).
