FULL RELEASE AND ASSIGNMENT
WHEREAS, Hartford Fire Insurance Company (hereinafter the Underwriter) is Surety on
Bond/Policy Number 72 BPE CH6278, in favor of City of Carson, Carson Redevelopment
Agency (hereinafter the Insured) in the penalty of One Hundred Thousand and 00/100
($100,000.00) Dollars, effective July 1, 2006.
Said bond/policy agrees to indemnify the Insured for losses sustained by it, among other things,
due to Computer and Funds Transfer Fraud.
The insured represents it to be a fact that it has sustained a loss under said bond/policy due to
Computer and Funds Transfer Fraud in the sum of One Hundred Forty Four Thousand Four
Hundred Forty Five and 16/100 ($144,445.16) Dollars, as more fully appears in and by its Proof
of Loss sworn to on the 26th day of July, 2007.
NOW, THEREFORE, in consideration of the payment of the sum of One Hundred
Thousand and 00/100 ($100,000.00) Dollars to the Insured by the Underwriter the receipt
whereof is hereby acknowledged:
(1) The Insured releases and discharges, and forever releases and discharges, the
Underwriter from any and all liability, claims, demands, debts, dues, accounts,
cause or causes of action or whatsoever kind or nature that it now has, had had, or
may hereafter have under said bond/policy by reason of the aforementioned loss,
(2) The Insured has assigned and does hereby assign, sell, transfer and set over
to the Underwriter all its right, title and interest in relation to any and all items
claimed in and by the said proof of loss, and all money that may be recovered by
reason thereof.
(3) The Insured has appointed and does hereby appoint the Underwriter as its
attorney-in-fact to ask, demand, receive, receipt for, and sue for, in the name of
the Insured or the Underwriter, and take any and all lawful ways and means for
the recovery of any and all such sums of money at the Underwriter's expense.
