The regular meeting of the City Council was called to order by Mayor Nunamaker at 7:30 P. M. Rev. Roger Hillis of Westminster 2. Presbyterian Church, 9642 Live Oak Ave., Temple City, gave the invocation. 3. The Mayor then led the Pledge of Allegiance to the flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford, and City Manager Woollett, APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes of the Adjourned Meeting of May 31, the Adjourned Meeting of June 5, and the Re -. gular Meeting of June 10, as mailed, Councilman Fitzjohn second- ed and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. RESOLUTION NO. 63 -289: Re- Granting zone variance to Gubler Orchid Co., 9441 E. Broadway, with conditions. City Manager Woollett read title to Resolution No. 63 -289 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANT- ING APPLICATION FOR A ZONE VARIANCE IN ZONE VARIANCE CASE NO. 63 -44 OF H. F. GUBLER PERTAINING TO THE REAL PROPERTY LOCATED AT 9441 EAST BROADWAY, TEMPLE CITY, SUBJECT TO CERTAIN CONDI- TIONS. Mayor Nunamaker asked if anyone wished to speak regard- ing this Resolution. Mr. Gubler, owner of the property involved came forward and advised the Council that he was not interested in improving his property as requested with a ten year time limit on the variance, as his present variance was for the life of the existing nursery and he is not interested under the condi- tions imposed. Following considerable discussion Councilman Tyrell moved to table and the tape be reviewed to appraise the situation, Councilman Dickason seconded. The City Attorney ad- vised if additional evidence were to be introduced we would have to have an additional public hearing. Mr. Gubler advised it was his understanding regardless of what happened the operation could be there for the life of the buildings, and he was advised by the City Attorney that this is not true but that on a non- conforming use he would only be permitted to amortize the invest ment thereon, and his non - conforming use is based on the time when the variance was granted. Also on the new ordinance the City is considering under the Master Plan it will undoubtedly control. Roll call vote to carry the motion made as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 7. PROPOSED TENTATIVE TRACT #28317:_ West fide of Encinita south of Flood Control Channel. Planning Advisor Cushman presented the proposed Tract #28317 which is a M-1 Industrial Tract with no residences permitted, a 60 ft. street with rolled curb, all buildings facing on "A" Street. Councilman Tyrell moved to approve the Tentative Tract #28317 subject to recommended conditions, Councilman-Fitzjohn seconded, and carried by the following roll call vote: 471 Council Minutes, June 24, 1963, page 2. AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 8, PRESENTATION OF CERTIFICATE OF RECOGNITION: RUSSELL W. HOLM At this time Mayor Nunamaker requested Russell W. Holm to come forward and congratulated him on the fine work done in serving the City as a Planning Commissioner, and presented him with a Certificate of Recognition. Mr. Holm accepted and expressed his appreciation. 9. APPOINTMENT OF PLANNING COMMISSIONER Mayor Nunamaker advised the Council had considered this appoint- ment and had agreed upon Mr. Kenneth C. Briggs, and Councilman Tyrell moved that Mr.'Kenneth C. Briggs be appointed Planning Commissioner, Councilman Fitzjohn seconded, and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ASSENT: Councilmen -None NEW BUSINESS: 10. GRANT QF EASEMENT FOR GOLDEN WEST AVE. -LOWER AZUSA RD. NORTH City Manager Woollett presented a letter and Agreement granting to the City of Temple City an easement for road purposes for Golden West Ave. north from Lower Azusa Rd. provided within a five year period we will improve this easement. He stated it is the intention to go to the property owners of abutting proper- ty regarding dedication of necessary property to get the street put in. Councilman Tyrell moved to accept the easement and approve and instruct the Mayor and City Clerk to sign the Agreement on behalf of the City, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 11. RESOLUTION N00 63-294: appointment part -time recreation employee. City Manager Woollett read title to Resolution No. 63 -294 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOIN ING PART -TIME AND TEMPORARY EMPLOYEES. Councilman Tyrell moved to adopt Resolution No. 63 -294, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen-None 12. ANNOUNCEMENT OF SISTER CiTY COMMITTEE & DATE OF FIRST MEETING: Mayor Nunamaker presented the following for appointment to the Sister City Commi ttee and the first meeting to be set for June 27, at noon for luncheon at the Black Watch: Mrs. Ralph Clarkson, Mrs. Dwight Coffman, Rev. Chas. P. Hamby, Mr. Paris Jackson, Mr, Junius W. Parkhurst, Dr. John Rand. Councilman Fitzjohn moved to approve, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Mayor Nunamaker requested Councilman Dickason to also sit in with the Committee the first few meetings as he attended the original meetings at the Biltmore, to which Mr. Dickason agreed. 13. RESOLUTION NO, 63 -295: Warrants & Demands. Councilman Tyrell moved to adopt Resolution No. 63 -295, Warrants & Demands Nos. 2689 through No. 2734, in the amount of $4,928069 Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen-None ABSENT: Councilmen -None 1+72 Council Minutes, June 24, 1963, page 3 14. SET PUBLIC HEARING: curb & gutter The City Manager advised petitions for curb & gutter were re- ceived for the north side of Key west, Doreen to Pal Mal, and the south side of Olive from Noel Dr. to Sultana and requested a public hearing be set for July 8, at 8 :00 P. M., Councilman Tyrell so moved, Councilman Merritt seconded, and carried. COMMUNICATIONS: 15. The City Manager presented letters from the L. A. County Boundarl Commission re proposed annexations #333 and #334 to the City of El Monte. Councilman Fitzjohn moved to receive and file, Council man Tyrell seconded, and carried. 16. TiME FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE COUNCIL: No one came forward at this time. 17. MATTERS FROM CITY OFFICIALS: Councilman Tyrell asked about the recording machine. The City Manager referred to the information furnished the Council re- operation and costs of various machines. Following discussion Councilman Fitzjohn moved to buy a Tauberg tape recorder, Mod. 4 at $250. and 200 reels of 1 mil tape at 2.24 or $448., total of $698., Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Merritt recommended any restaurant owner or food handler be required to take the course the County offers through the health dept. as he felt some places were quite lax in this respect. The City Manager advised him if he had any place in mind to report it and he would have the Health Dept. check it out as they were inspected periodically for this purpose. City Mana9er Woollett presented the recommendation from the Parks & Recreation Commission concerning the new Live Oak Park area to be known as Andrist Square, and the recommendations are that a ceremony be held Sunday, July 28. Councilman Tyrell so moved Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None. The City Manager recommended a committee of Al Lindberg of the Parks & Recreation Commission, Lou Merritt of the Council and one of the members of the Traffic Commission to which the Council agreed. The City Manager requested a public hearing be set for a petition received for curb and gutter with 100% signed up for the east side of Pal Mal from Arrowwood St. to Key West, for July 8, at 8:15 P. M. Councilman Dickason so moved, Councilman Tyrell seconded, and carried. The City Manager requested the City Council proclaim the month of July as Parks & Recreation Month. Councilman Tyrell so moved Councilman Dickason seconded and carried. in response to the request of the Council the City Manager re- ported on the detergent legislation that it had been referred to the interim Committee, which means the legislation is dead until 19650 The City Manager reminded the Council that the current licenses for the Jolly Coachman expire on June 30, 1963, and the Council should discuss and get the City Attorneys opinion regarding the Councils ability to cancel or re- issue. The City Attorney recommended that the Council continue in force and effect the 473 Council Minutes, June 24, 1963, page 4 licenses heretofor issued to Hal Broadhead for a temporary period only based on two considerations: 1, a public hearing be held to determine whether license should be renewed 2. the city reserve the right to determine the licenses forth- with after the Superior Court of Los Angeles has determined the revocation of licenses is a valid revocation, and in the event of revocation that licensee may not apply for a perfod of six months for renewal of the license which would auto- matically date back to the date of adoption of the resolu- tion before he could re- apply, The City should issue a special temporary license based on these two things which license would remain in effect until affirmed by Superior Court, and if not affirmed the Public Hearin would be held. This Public Hearing should be set tonight and it can be cancelled if necessary. Ten days notice must be given licen- see and he recommended notice of the residents in the general area of the Jolly Coachman as you would notice them on a variance and further have published in the Temple City Times adequate notice of the Public Hearing. Councilman Tyrell moved the Council grant Hal Broadhead a tem- porary license for a period of time not to exceed the time of a Public Hearing set for July 22, 1963, at 8 :30 P. M., at the City Hall, and to terminate forthwith if the City Council action shall be sustained by Superior Court, and the City should re- quire the regular $25. as a deposit for the license and if not issued refund should be pro- rated, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None The City Attorney will prepare the temporary license and the necessary notice to Mr. Hal Broadhead. 18. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman Fitzjohn seconded, and carried, Council adjourned at 8 :25 P.
