HomeMy Public PortalAboutResolution 01:091No. 01-91 Date ot' Adoptilln MARCH 15, 2001 RESOLUTION APPROVING VOICE STREAM WIRELESS CO- LOCATION ON THE SPRINT PCS MONOPOLE WHEREAS, on or about August 27, 1997, the Borough of Carteret entered into a Lease Agreement with Sprint Spectrum, L.P. whereby the Borough leases certain real property located at the Carteret D.P.W. on Roosevelt Avenue for the maintenance and use of wireless communications equipment, including a monopole antenna, by Sprint; and WHEREAS, on or about November 8, 2000 said Lease Agreement was amended to acknowledge certain agreements between the parties and to address certain outstanding issues and to include the co-location of additional antennas upon Sprint's monopole by AT&T Wireless Services and Metrocom, Inc; and WHEREAS, pursuant to the Lease and Addendum, Sprint has the right to sublease additional space on the monopole tower with the written consent of the Borough; and WHEREAS, Sprint has requested that the Borough consent to the co-location of Voice Stream Wireless to place an antenna upon the existing monopole and to install certain equipment for the operation and maintenance of same within the existing lease area; and WHEREAS, the Borough will receive a 25% revenue share from the sublease between Sprint and Voice Stream Wireless for this co-location; and WHEREAS, the Borough Engineer has reviewed the preliminary site sketches prepared by Voice Stream Wireless as part of its proposal to co-locate on the monopole antenna and has approved of the same with certain conditions as set forth in his letter dated February 28, 2001, annexed hereto. NOW, THEREFORE, be it resolved by the Mayor and Council of the Borough of Carteret that the Voice Stream Wireless application to co-locate on the existing monopole antenna located at the Carteret D.P.W. is hereby approved and the Borough Clerk is authorized to advise Sprint Spectmm and Voice Stream Wireless of this approval. BE IT FURTHER RESOLVED, that said approval is conditioned upon Voice Stream Wireless conforming with ali statutes, ordinances, roles, regulations and requirements of appropriate public authorities; obtaining all necessary government permits and/or authorizations including, but not limited to, Municipal site plan approval and satisfying the conditions contained in the Borough Engineer's letter of February 28, 2001. ce~J f/~'l as a lx~e cq~y of the ct~gdnal on M~da 16, iIDI.
