Hearing: 10/27/2010 Adopted: 10/27/2010 Effective Date: 10/27/2010 Sponsored by: City Manager ORDINANCE NO. 10-27 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA,APPROVING AN AGREEMENT WITH FLORIDA INTERNATIONAL UNIVERSITY (FIU) BOARD OF TRUSTEES AND THE CITY OF OPA-LOCKA TO BECOME PARTIES IN CONDUCTING A WORK RELATED STUDY OF THE "PEAK FLOW MANAGEMENT STUDY" PROJECT, IN AN AMOUNT NOT TO EXCEED TWENTY THOUSAND DOLLARS ($20,000.00) PAYABLE FROM ACCOUNT NUMBER 64-533312; PROVIDING FOR INCORPORATION OF RECITALS;PROVIDING FOR REPEAL OF ALL PRIOR ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFIECTIVE DATE. WHEREAS,the City Commission of the City of Opa-locka,Florida approved Resolution 10-8118,to enter an Agreement with Florida International University of Environmental Engineering for the Peak Flow Management Study; and WHEREAS,Florida International University of Environmental Engineering has accepted the offer to enter into an agreement to provide their services for the Peak Flow Management Study Project; and WHEREAS,the attached agreement for the"project period" will be in effect from October 1, 2010 and will terminate December 30, 2011; and WHEREAS,performance may be extended and/or renewed for additional periods by mutual written agreement of the parties; and Ordinance No. 10-27 WHEREAS, the City Commission of the City of Opa-locka desires to authorize the City Manager to utilize the services of Florida International University (F1U) for the Peak Flow Management Study and to execute the attached agreement: NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby authorizes and directs the City Manager to execute the attached agreement between Florida International University Board of Trustees and the City of Opa-locka, effective October 1, 2010 until December 30, 2011for the Peak Flow Management Study Project, in an amount not to exceed Twenty Thousand Dollars, payable from account number 64-533312. Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. If any section,subsection,sentence,clause,phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,such portion shall be deemed a separate,distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance.
