HomeMy Public PortalAbout04/15/97 CCM81 MEDINA CITY COUNCIL MEETING MINUTES OF APRIL 15, 1997 The City Council of Medina, Minnesota met in regular session on April 15, 1997, at 7:32 p.m. in the City Hall Council Chambers. Mayor John Ferris presided. Members present: John Ferris, John Hamilton, Jim Johnson, and Ann Thies. Members absent: Phil Zietlow. Also present: Public Works Director Jim Dillman, City Engineer Shawn Gustafson, Zoning Administrator Loren Kohnen, City Attorney Ron Batty, and City Clerk -Treasurer Paul Robinson. Paul Robinson asked what time the April 22, 1997 Special Meeting was to begin. Consensus of the City Council was that it should start at 7:00 p.m. 1. Minutes Moved by Ann Thies, seconded by John Hamilton, to approve the minutes of the regular meeting of April 1,1997, as submitted. Motion passed unanimously. Moved by John Hamilton, seconded by Ann Thies, to approve the minutes of the local board of review of April 9, 1997, as submitted. Motion passed unanimously. 2. Planning Commission Comments Loren Kohnen said that Bob Bradley resigned from the Planning Commission. Kohnen said this issue would probably be on the next City Council Agenda. There was some discussion about court ordered clean-up of Tim Hoover's property. Ron Batty said there was some disagreement about the completion date ordered by the court. Staff was encouraged to proceed quickly on this issue. NEW BUSINESS 3. Spring Hill Golf Course John Ferris said that the Spring Hill Golf Club would like the city council to grant a conditional use permit subject to the environmental assessment worksheet approval, the watershed approval, as well as approval from the City of Orono. John Ferris said that the additional issue being raised was that of Big Woods. John referenced a letter in the City Council information from Elizabeth Weir concerning Big Woods. He said that he had conversations with both Ron Batty and Loren Kohnen regarding Big Woods and the outcome of these conversation was that there was no ordinances the city council could use to regulate the golf courses use of this area. Ferris said that Phil Zietlow had spoken with Tom Crosby, attorney representing the Spring Hill Golf Club, and he said that the Club would be willing to contribute some money to the city towards a reforestation project. Ferris said that this was just an understanding that the city council would have with the Spring Hill Golf Club. Andy Hunter, president of the Spring Hill Golf Club, said that it was important for them to move forward with this process. They would like to begin moving trees in eahiy May through June. It was important for them to move the trees before July, since the success rate of moving trees diminishes the closer it gets to the middle of summer. An early resolution to their requests would allow them to take full advantage of their tree conservation measures. There was some discussion about how trees would be moved, which trees would be moved, and what types of reforestation efforts the Spring Hill Golf planning to undertake. There was some discussion about what a potential tree ordinance would entail. Andy Hunter said that what they were currently doing would probably go far beyond what would be required in a tree ordinance. Tom Crosby gave a brief overview of the variances they were requesting from the City of Orono. There was some discussion about why the Spring Hill Golf Club would need the City of Medina's approval at this point. Representatives of the Spring Hill Golf Club said that Medina's approval would give them some momentum in gaining approval from the City of Orono. There was some additional discussion about a tree ordinance and about the PI. Commission minutes that were included in the city council information. The Pla Commission minutes included their recommend conditions for approval of the S Hill Golf Club. Loren Kohnen said that if any property owner in Medina owned a 40 acre area, t would be able to remove as many trees as they would like and there would be n in the city ordinances that would stop them from doing that. nning ning ring ey thing Ron Batty briefly outlined the current tree ordinance. He said the ordinance wavery brief and only applied to residential developments. In general, the ordinance st-tes that where possible, save trees, and don't replace or replant trees with varieties hat are susceptible to disease. John Ferris said that Spring Hill Golf Course would be willing to provide a reasonable contribution to the reforestation effort in Medina. Tom Crosby said that they would willing to provide a contribution for reforestatio would be consistent with a citywide ordinance to be adopted. that Medina City Council Meeting Minutes April 15, 1997 83 Shawn Gustafson stated that he would recommend the city council add a condition that the Spring Hill Golf Club provide drainage and utility easements. Tom Crosby said that easements consistent with the natural drainage would not be a problem. Jim Johnson moved that the city council grant a conditional use permit with the 11 conditions from the Planning Commission, adding number 12, drainage easements and utility easements, and adding number 13, a reference to a tree ordinance to be adopted. There was some discussion about whether the city council was passing a resolution of support or asking staff to draft a resolution to bring back to the next city council meeting. The consensus of the city council was that the city council approve a conditional use permit this evening, but that the final wording of the resolution be approved at the city council's upcoming special meeting on April 22. John Hamilton seconded the motion subject to approval of the final wording at the April 22 city council meeting. Motion passed unanimously. 4. Hamel Rodeo Signs Loren Kohnen said that Hamel Rodeo would like four temporary sign locations, the same locations as in years' past. Ann Thies said that next year this issue could be on the consent agent. Moved by Jim Johnson, seconded by Ann Thies, to approve the temporary sign request for Hamel Rodeo. Motion passed unanimously. 5. Schoell & Madson Report on Landfill Loren Kohnen said that he would like to set up a meeting with the city attorney, BFI and the Minnesota Pollution Control Agency to discuss the Schoell Madson report on well testing at the landfill. He said that the Schoell Madson report pointed out some discrepancies between the sampling currently being done by BFI and the sampling required in the conditional use permit. Loren said that he would set this meeting up. 6. Speed Limit on County Road 19 Jim Dillman said that he had received a letter from Roger Adams, at 2725 County Road 19 to have the speed limit on County Road 19 changed or at least reviewed. There was some discussion about that portion of County Road 19. After some additional discussion no motion made to pass a resolution requesting the county to study the speed limit on this section of the highway. Medina City Council Meeting Minutes April 15, 1997 84 7. Clean-up Day Assignments Jim Dillman said that he had a number of volunteers for Clean-up Day. He said that he still needed someone, bright and early, to take care of tree sales. John Hamilton volunteered. 8. 1997 Budget Paul Robinson presented a copy of the 1997 Budget document. He briefly described the various sections of the city budget document. Robinson pointed out that thetax capacity used in the budget was from the end of January 1997, and not the one used by the city council when they determined the 1997 budget. The actual tax capacity rate was $47,000 lower than when the city council put together the budget. This raised the 1997 tax rate from 14.58% to 14.68%. Robinson discussed some of the upcoming shortfalls in the debt service funds. There was a short discussion about the funds needed to pay for these shortfalls. He said that many of the issues raised in this budget document will also be raised as part of he audit presentation next month. One of the issues is the deficit in the sewer fun . The main reason for this has been expenditures for depreciation. Robinson said th he and Jim Dillman will be reviewing this schedule and probably extend the life of t e sewer system's assets out further than is currently projected. John Ferris said that currently that many of the assets are projected at a life of 7 to 40 years, when in actuality, the sewer will probably last more like 70 years. Robinson noted that in the back of the budget document was a chart showing in what fund and at what percentage each employee's salary was being distributed. 9. Pay The Bills Moved by Jim Johnson, seconded by Ann Thies, to approve order checks numbers 17006-17061 for $ 39,160.52 and payroll checks 15188-15198 for $ 9,764.73. Motion passed unanimously. 10.
