HomeMy Public PortalAbout11-01 Ear-Based Comprehensive Plan Amendments l" Reading: January 26, 2011 2nd Reading: February 09, 2011 Public Hearing: January 26,2011 & February 09, 2011 Adopted: February 09, 2011 Effective Date: February 23, 2011 Sponsor: City Manager ORDINANCE NO. 11.01 AN ORDINANCE OF THE CITY OF OPA-LOCKA, FLORIDA TO APPROVE THE SUBMITTAL OF THE CITY'S PROPOSED EAR- BASED COMPREHENSIVE PLAN AMENDMENTS TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR THEIR REVIEW; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, §163.3167(2), Florida Statutes, requires that each local government prepare a Comprehensive Plan in compliance with the Local Government Comprehensive Planning and Land Development Act; and WHEREAS, §163.3184, Florida Statutes, requires that a local government shall submit its complete proposed comprehensive plan or its complete comprehensive plan as proposed to be amended to the state land planning agency; and WHEREAS, the City of Opa-locka ("City") desires to submit proposed EAR- Based Comprehensive Plan amendments to the Florida Department of Community Affairs for review; and WHEREAS, the City's Comprehensive Plan amendments shall include Text amendments and a Future Land Use Map amendment to increase the density of certain existing moderate density residential land; and ORDINANCE NO. 11-01 WHEREAS, the City Commission of the City of Opa-locka desires to authorize the City Manager to submit the proposed EAR-Based Comprehensive Plan Amendments to The Florida Department of Community Affairs. NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City's Comprehensive Plan amendments shall include Text amendments and a Future Land Use Map amendment to increase the density of certain existing moderate density residential land. Section 3. The City Commission of Opa-locka hereby authorizes the City Manager to submit the proposed EAR-Based Comprehensive Plan Amendments to The Florida Department of Community Affairs for review; in substantially the form attached hereto as Exhibit"A". Section 4. All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith, are hereby repealed. Section 5. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. This Ordinance shall upon adoption, become effective immediately. REQUEST: AN ORDINANCE OF THE CITY OF OPA-LOCKA, FLORIDA TO APPROVE THE SUBMITTAL OF THE CITY'S PROPOSED EAR-BASED COMPREHENSIVE PLAN AMENDMENTS TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR THEIR REVIEW. DESCRIPTION The city of Opa-locka outsourced part of the comprehensive plan specifically the EAR Based amendments. The City retained the metropolitan center of Florida International University (FIU). There has been several extensions granted by the City Manager's office to FIU who is very close to completing the transmittal of the EAR based amendments. On January 18, 2010, the Planning Council met and unanimously recommended that the attached be submitted to the Florida Department of Community Affairs. A public hearing will be held on January 26, 2011 and February 9, 2011, respectively to receive public comment regarding submittal of the EAR Based Amendments to the Florida Department of Community Affairs. It is mission essential that the EAR based amendments be reviewed and found sufficient by the Florida Department of Community Affairs. This transmittal will allow for the state to review the EAR based amendments. If the EAR based amendments are found sufficient by the Florida Department of Community Affairs. The City of Opa-locka will be in a strategic position to update their comprehensive plan at a later date. Once the amendments are found sufficient by the state certain land use amendments, rezoning applications, and creative zoning and redevelopment ordinances may be considered by the Mayor and City Commission to help guide the city's future growth and redevelopment. • FINANCIAL IMPACT This item was previously authorized by City Resolution No. 10-8018 and budgeted from account No. 37-515312.
