A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY APPROVING RECOMMENDATIONS OF
THE PLANNING COMMISSION OF THE CITY OF TEMPLE
CITY AND GRANTING THE ZONE VARIANCE OF
RUSSELL - HARRISON IN ZONE CASE NO. 60-4.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
DOES RESOLVE AS FOLLOWS:
WHEREAS, the Planning Commission of the City of
Temple City at its regular meeting held in the City Hall, 9664
East Las Tunas Drive, Temple City, California, on September 6,
1960, a duly constituted public hearing in regard to a zone
variance request of Russell- Harrison, and
WHEREAS, more than ten days have elapsed since the
said meeting of the Planning Commission on September 6, 1960,
and no appeal has been filed from the decision of the Planning
Commission,
NOW THEREFORE, the City Council of the City of Temple
City does resolve as follows:
SECTION 1. There are exceptional and extraordinary
cir,cumstances applicable to the property of the applicant that
do not apply generally to the property or class of use in the
same vicinity.
SECTION 2. That the granting of the variance, which
shall also be deemed to be a Special Permit, wherein a Special
Permit is required, of the applicant, is not detrimental to
the public health, general welfare and convenience of the
community and will not be injurious to the property in the
same vicinity.
SECTION 3. That the variance as requested is granted
on the following conditions:
(a) That the property be developed substantially
in compliance with the plot plan on file with the case, except
that the five foot block wall indicated on the plot plan shall
be increased to six feet.
(b) That parking areas shall be developed in ac-
cordance with the requirements of Section 261 of the Temple
City Zoning Ordinance.
(c) That the occupancy of the hospital facility
proposed shall not exceed 110 beds.
(d) That the lot fronting on Double Drive provid-
ing for ingress and egress may be developed for parking in
accordance with the plot plan submitted.
(e) That all requirements of state agencies having
jurisdiction over hospitals be complied with including require-
ments of the State Fire Marshall and State Department of
health.

(f) That Welland Avenue and Double Drive shall be
improved with curb, gutter and sidewalk adjacent to the prop-
erty involved and that such improvements shall meet the stand-
ards established by the City of Temple City. (This condition
shall be considered to have been complied with for purposes
of operations carried on under this Special Permit upon the
filing with the City of a bond suitable to the City covering
the costs of these improvements).
(g) That this variance shall not be effective for
any purpose until the owner of the property involved has
filed with the City Clerk of Temple City his affidavit stating
that he is aware of and accepts all of the conditions of this
variance.
(h) It is hereby declared that if any provision
of this variance is violated or held to be invalid, or if any
law, statute or ordinance is violated, the variance shall be
void and the privileges granted hereunder shall lapse.
