HomeMy Public PortalAbout114-1979 - REZONING - 701 NORTH 13TH STREETSPECLAL ORDINANCE NO. 114-1979 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT FOR ADMINISTRATIVE AND BUSINESS OFFICES ON PRO- PERTY LOCATED AT 701 NORTH 13TH STREET, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE OOMMONLY KNOWN AS THE ZONING ORDI- NANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article 22.012 of Chapter 22 of the Municipal Code allows for administrative and business offices by Special Use authorization as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by the Richmond City Planning Commission the day of , 1979, at which time remonstrances were heard tram all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Planning Commission was /d to 4 in favor of/' recommending the passago Ordinance No. 114-1979. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich- mond, Indiana, as follows: SECTION 1. As provided in. Article 22.012 of Chapter 22 of the Municipal Code the following described use of the following described real estate is allowed as a Special Use for administrative and business offices at 701 North 13th Street in the City of Rich- mond, Indiana; more particularly described; to wit: Lots Numbered One (1), Tvu (2), Three (3), Four (4), Five (5), Six (6), Seven (7), Eight (8), and Nine (9) in D. W. Marmon's Second Addition to the City of Richmond, Indiana, said lot number nine (9) being situate on the northeast corner. of Thirteenth and North "G" Streets in said City, the other lots adjoining on the north all fronting west on said 13th Street. ALSO: Lots Numbered Twenty-five (25) and Twenty-six (26) in Eunice Moffitt Moore's Addition to the City of Richmond, Wayne County, State of Indiana. AND ALSO: The East One-half (E 1/2) of North Thirteenth Street, adjacent to Lots Numbered 1, 2, 3, 4, 5, 6, 7, 8, and 9 in D. W. Marmon's Second Addition and Lots 25 and 26 in Eunice Moffitt Moore's Addition to the City of Richmond, Wayne County, State of Indiana. AND ALSO: Being a part of Section Thirty-three (33), Township fourteen (14) North, Range One (1) West, and beginning at the junction of the south side of North H Street, and the west line of alley running north and south between North 13th and North 14th Streets in said City, and thence south along west line of alley eighty-eight (88) feet and four (4) inches; thence west forty-six (46) feet and twD (2) inches; thence northwardly eighty-eight (88) feet to south line of North H Street at point forty-five (45) feet and eleven (11) inches west of place of beginning; thence east to place of beginning; the same being also known as and designated as Tract Four Hundred Thirty-six (436) on the Official Plat of the City of Richmond, Indiana. AND ALSO: The following described vacated alley, the same being vacated as shown by Plat Book 5, page 148, recorded July 28, 1923, in the Office of the Recorder of Wayne County, Indiana; Beginning at the southwest corner of Lot No. 10, D. W. Marmon's 2nd. Addition on the north side of North V' Street; thence running north along the west line of said Lot 10 the northwest corner; thence west across a 20 foot alley to the east line of Lot 6, same addition; thence south, along the east line of Lots 6, 7, 8, 9, to the north line of North "G' Street; thence east along the north line of North "(17" Street to the southwest corner of Lot 10, being the place of beginning. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using said real estate. a. The site plan and affidavits regarding off-street parking, landscaping, structure improvement and proposed uses accompanying the petition be identified as Exhibit "A' and made a part of Ordinance No. 114-1979. b. The Special Use authorization shall be considered null and void should the Special Use cease for a period of one (1) year or more. SECTION 3. The Zoning Adm:nistrator of the City of Richmond, Indiana, hereby authorized and directed, upon enactment and publication of this Ordinance, to record and approve the issuance of a per- mit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required. The Ccnmission found that the request meets the criteria for granting a Special Use under Article 48 of the Zoning Ordinance. The use will serve the public convenience at its proposed loca- tion and nearby property values will not be adversely affected as a result of this proposed use being approved. The Commission voted ten (10) to zero (0) to recomnend approval of the request to ConTwn Council. C., Inc, to renovate the old Nicholson School Building into a multi -service complex which would house several community- based organizations whose purpose it is to provide services to primarily low income, undereducated or untrained individuals. Essentially, all tenants of the building will be engaged in activities classified as community service endeavors. Wayne County 0..I. C. is itself a pre -vocational/ vocational, community - based, manpower training program for people who are under -skilled, under -employed or unemployed. Wayne County O. I. C. serves the community as a Center for Continuing Adult Education; training is provided which enables participants to meet the requirements for the GED examination. In effect, Wayne County O. 1. C. is a school for undereducated adults; classes such as English, math, social. studies, etc. are provided. Wayne County O. I. C. also houses the only Adult Basic Education facility in the dyne County area. Through this component, services and training are provided to those who have the lowest of educational skills. Wayne County O. I. C. also conducts a clerical skills course which provides instruction in shorthand, bookkeeping, filing and general office procedures. .In short, Wayne County 0. 1. C. is involved in the education and development of undereducated or untrained individuals; old Nicholson School building will act as a learning center for these individuals as well as an administrative center for the management and control of the programs. An administrative staff will be housed in the building to administrate and coordinate the fiscal and operational aspects of the program. In addition, Wayne County O. I. C. intends tolease those areas of the building not occupied by Wayne County 0. I. C. itself to other groups or business engaged in community service endeavors which primarily involve lower income and under -educated persons. Groups with whom Wayne County O. 1. C. is presently negotiating as potential tenants include Wayne Community Action Commission and attendant agencies such as Headstart, Manpower, Community Services Administration, Youth Development, EXHIBIT "A" ORDINANCE NO.'114-1979 FC-;79-26 Neighborhood Services Systems, and Equal Employment Opportunity planning council. .Again, these tenants are involved primarily with community service endeavors. Wayne County O. I. C. proposes to house not only the programs themselves by providing classrooms and activity centers for the participants, but also the administrative and personnel offices which coordinate and manage such programs.
