AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
OPA- LOCKA, FLORIDA AMENDING ORDINANCE 86 -8, THE
LAND DEVELOPMENT CODE, TO INCLUDE AUTO BROKERS AS
A PERMITTED USE IN THE FOLLOWING INDUSTRIAL ZONING
DISTRICTS: I -1; I -2; AND I -3 DISTRICTS; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT
AND REPEALER; PROVIDING FOR CODIFICATION AND
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Planning Council of the City of Opa -locka has approved a
recommendation amending Ordinance 86 -8, the Land Development Code; and
WHEREAS, the Planning Council recommended amending Zoning Ordinance 86 -8,
sections 6.10 (B); 6.11 (B); and 6.12 (B), to allow auto brokers as a permitted use in the I -1, I -2
and I -3 zoning districts, respectively; and
WHEREAS, the Planning Council's recommendation promotes identification of areas
where Auto Broker will become a permitted use in light industrial operations areas as well as
heavy industrial operations areas, without creating a hazard to the general public or interfering
with neighboring uses; and permitting this use will encourage better designed light industrial
uses; and
WHEREAS, the Planning Council recommends that the following conditions be
imposed for this permitted use: 1) All vehicles for sale will be displayed inside a wholly
enclosed building (warehouse, warehouse bay, etc.); 2) No "For Sale" signs or any other
signs will be placed outside the building to suggest that vehicles are for sale in the area;
3) All business advertising will be conducted by mail blitz, internet, or newspaper, etc.;
no advertising will be posted at the site; and 4) No mechanical work, body work, nor auto
painting shall be performed on any vehicles under this license at the Auto Broker
approved site inside or outside of the building:

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, AS FOLLOWS:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby amends Zoning
Ordinance 86-8 to include Auto Broker as a permitted use in I-1, I-2 and 1-3 zoning districts,
subject to the following conditions:
1. All vehicles for sale will be displayed inside a wholly enclosed building
(warehouse, warehouse bay, etc.).
2. No "For Sale" signs or any other signs will be placed outside the building
to suggest that vehicles are for sale in the area.
3. All business advertising will be conducted by mail blitz, interne, or
newspaper, etc.; no advertising will be posted at the site.
4. No mechanical work, body work, nor auto painting shall be performed on
any vehicles under this license at the Auto Broker approved site inside or
outside of the building;
Section 3 All ordinances or Code provisions in conflict herewith are hereby
repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, district and independent provision and such
holding shall not affect the validity of the remaining portions of this Ordinance.
Section 5. This Ordinance shall be codified in the Code of Ordinances when the code
is recodified.
Section 6. This Ordinance shall, upon adoption, become effective as specified by the
City of Opa-locks Charter and Code of Ordinances.

RE: Ordinance of the City Commission of the City of Opa-locka, Florida,
Amending Ordinance 86-8, to include Auto Brokers as a permitted use in
Industrial Zoning districts to lawfully expand the range of uses in the
industrial districts.
Request: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, AMENDING ORDINANCE 86-8, THE LAND DEVELOPMENT
CODE, SECTIONS 6.10 (B); 6.11 (B); and 6.12 (B); TO INCLUDE AUTO BROKERS AS
A PERMITTED USE IN THE LIMITED INDUSTRIAL DISTRICT (I-1); LIBERAL
INDUSTRIAL DISTRICT (1-2); AND INDUSTRIAL PLANNED DEVELOPMENT
DISTRICT (I-3).
Description: The Community Development staff has received many requests, from
business persons, to be allowed to sell vehicles to the public from industrial property and
has made a presentation to the Planning Council concerning their request for review of
this use being permitted in the industrial zoning districts. After review of this information
the Planning Council has recommended amending Ordinance 86-8 to include Auto
Brokers as a permitted use in the 1-1; 1-2: and 1-3 Zoning Districts. This use is not
recommended for the Liberal Industrial (Junkyard & Salvage Area) I-2A Zoning District.
The current code allows automobile sales, as "New and Used Car Lots", with the
requirements listed in the Commercial Intensive Business District (B-3) most notable of
which is an outside display area. The recommendation of the Planning Council is to allow
an Auto Broker to offer vehicles for sale in the Industrial Zoning Districts as an office and
storage use with the following conditions:
(1) All vehicles for sale will be displayed inside a wholly enclosed building, i.e. a
warehouse, warehouse bay, etc.
(2) No "For Sale" signs or any other signs will be placed outside the building to
suggest that vehicles are for sale in the area.
(3) All business advertising will be conducted by mail blitz, Internet, or newspaper,
etc; no advertising however will be posted at the site.
(4) No mechanical work, body work, nor painting shall be performed on any vehicle
under this license at the Auto Broker approved site inside or outside of the
building.
The Planning Council recommends amending the Zoning Code 86-8 to include Auto
Broker as a permitted use in light and heavy industrial operations areas to encourage
better designed light industrial uses without creating hazards to the general public or
interfering with neighboring uses.
Financial Impact: There are no direct costs associated these changes as
implementation requires staff review as with any occupational
license request.
Implementation Time Line: Immediately.
