Mayor Berner called the meeting to order at 6:33 p.m. Roll call vote: Mayor,Joann Kahler, Mike Ryan,Jim Bartels, Peggy Upton, Royce Phillips.Absent: none.Also present: Brett Mehmen (arrived at 7:30 p.m.),Attorney Raiber, Engineer Frederick,Administrator Jackson. Motion Bartels to approve the agenda, seconded Kahler.All ayes. Motion carried. P&Z has not had time to review Subdivision Ordinance to allow private Sewage disposal systems. Motion Kahler to table until 10/09/13, second Ryan.All ayes. Motion passed. Mayor Berner opened the public hearing for The Villages-Phase 2 Rezoning at 6:35 p.m. Motion Bartels to open, seconded Ryan.All ayes. Motion carried. No written comments or responses received. Mayor Berner closed the public hearing at 6:35 p.m. Motion Ryan to close,seconded Bartels.All ayes. Motion carried. Mayor Berner opened the public hearing for_The'Villages-Phase 2 PAD at 6:35"p.m. Motion Ryan to open, seconded Kahler.All ayes. Motion carried. Engineer Frederick stated the plat of ownership and PAD in separate lots on the preliminary plat. No written comments or responses received. Mayor Berner closed the public hearing at 6:36 p.m. Motion Ryan to close,seconded Upton.All"ayes. Motion carried. Motion Kahler to approve all of the August minutes, seconded Ryan. Motion Upton to add the word "not",to the 08/28/13 minutes for 2013-155. Kahler amended her motion to include the suggestion of adding"not"to the 08/28/13 minutes;Ryan still seconded.Ayes=Upton, Bartels, Ryan, Kahler. ,. Nays=Phillips. Motion carried. Motion Kahler to approve the Financial reports for August 2013 and`payables, seconded Bartels. Question on a Public Work payable and Director is not here yet, is running late. Motion passed. • 1 ,.,.• r Resolution 2013-153 Accepting the Developer's Agreement for Hickory Knoll:Attorney Raiber commented on final updates that need to be made:the University`of Iowa Foundation does not need to sign the agreement,the paving deadline (during FY 2014-2015)for Jasper Avenue,the developer to pay the city$18,750 to go toward the upsized 12"watermain on Jasper,verbiage that once sewer is to the facility the resident must hook-up at their expense, plus easements for sewer lines are needed,the final, .,., • wording of sewer and the access need to be tied together in the homeowner fees, and the final plat` review by the Engineer with the sewer easements for location. Ryan wanted clarification that the sewer is to the edge of the property, not to their individual property lines. Mayor commented we can't access an association, it needs to be attached to each individual home owner:MMS clarified the association will own the property and the sewer will go in the Right-of-Way on Gable Way. Motion Ryan to approve the agreement, contingent upon the satisfaction of the City Attorney and resolution of all items and to ° amend the water line installation date type from 12/01/13 to 12/31/13,second Kahler.Ayes=Kahler, Ryan, Bartels, Upton: Nays=Phillips. R I Johnson County Sheriff's officer stopped by to inform Council and the public that there have been multiple car burglaries in town and if anyone notices anything suspicious to call the Sheriff's office. Resolution 2013-163 Authorizing City Administrator/Clerk to get appraisal done on LWCF area in City Park: Mayor commented to make'sure the appraiser gets the rules about the federal swap so it is done correctly. Motion Ryan to approve,second Upton.Ayes=Phillips, Upton, Bartels, Ryan, Kahler. Nays=none. Motion passed. Resolution 2013-164 Approving Alcohol Permit to Slims Saloon: Upton reminded the businesses that they need to submit an event application. Motion Ryan to approve, second Kahler.Ayes=all. Nays=none ` Motion passed. Resolution 2013-165 Authorizing the City Attorney to work with'E911 Director to correct property addresses within the City Limits for Emergency Response Safety: Mayor clarified this is to get the Iowa City and Oxford addresses that are within the City limits to a Tiffin address. Motion Upton-to amend with the additional wording of"following a coherent numbering system and naming of location for emergency personnel", second Ryan.Voting on amendment: all ayes. Motion passed. Resolution 2013-167 Setting a Date for Public Hearing on Amending the Ordinance for PAD Submission Review:Administrator Jackson commented that P&Z recommended a clarification of verbiage to have the PAD review to be for only two (2) regular meetings. Discussion and possible action on Willow Ridge Highway 6 turn lanes:Request from developer to split tiie completion of the project into two phases due to turn lane issues and completion times. Discussion and possible action on Parks&Splash Pad: Public Works Director Mehmen and Administrator Jackson have already started research.Jackson to check into CDBG funds for funding. Ryan:wantsv_it,. visible in town. Possible location for small pad is at Potter Park between basketball courts and the ' memorial. Public works will get a few cost options. Attorney Raiber reported:Talking to Railroad for the parcel of land at Railroad.The Railroad will lease the property to the City until everything'cleared;then the City will assume ownership. Ireland update: sent The Depot a proposal,waiting for church rebuttal andwaiting for appraisal to be completed on :final business.
