N019 TO ADMINISTERING AGENCY -STATE MASTER AGREEMENT NO.07-5403R FOR FEDERAL AID PROJECTS COVERING THE CONSTRUCTION PHASE OF PROJECT NO. 1330 [FEDERAL NO. STPL-5403(023)1: AVALON BOULEVARD PAVEMENT RESTORATION FROM THE I-405 FREEWAY TO 223RD STREET WHEREAS, Caltrans and City are required by the Federal Highway Administration to execute a Program Supplement Agreement to Administering Agency - State Master Agreement No. 07-5403R for Project No. 1330: Avalon Boulevard Pavement Reconstruction from the I-405 Freeway to 223rd Street. NOW, THEREFORE, be it determined by the City Council of the City of Carson, California, that: Section 1. Program Supplement Agreement No. NO 19 to Administering Agency - State Master Agreement No. 07-5403R will permit the City to be reimbursed up to $650,000.00 in Surface Transportation Program Local federal fund money for the Construction Phase of the Avalon Boulevard Pavement Reconstruction from the I-405 Freeway to 223rd Street project. Section 2. The supplement to the agreement described in Section 1 is hereby approved, the Mayor is hereby authorized to execute and the City Clerk to attest to the execution of the supplement, and the City Clerk is further authorized to deliver the executed supplement, together with a certified copy of this resolution, to the state of California. SUMMARY The City of Carson is planning to undertake Project No. 1330: Avalon Boulevard Pavement Restoration from the I-405 Freeway to 223" Street (Exhibit No. 1). The funding for this project is provided by the Surface Transportation Program Local (STPL) federal fund. According to the Federal Highway Administration (FHWA) and the California Department of Transportation (Caltrans), adoption of a resolution by the City Council authorizing the execution of a Program Supplement Agreement to Administering Agency -State Master Agreement No. 07-5403R between the state and the City is required (Exhibit No. 2). Program Supplement Agreement No. N019 to Administering Agency -State Master Agreement No. 07-5403R obligates up to $650,000.00 of the STPL federal fund for the Construction Phase of this project (Exhibit No. 3). II. RECOMMENDATION WAIVE further reading and ADOPT Resolution No. 14-058, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT AGREEMENT NO. DO NOT ADOPT Resolution No. 14-058. 2. TAKE another action the City Council deems appropriate. However, the City must execute program supplement agreements in order to receive federal funds for the Construction Phase of this project. No invoices for reimbursement can be submitted to the state until a program supplement agreement is fully executed. IV. BACKGROUND Project No. 1330: Avalon Boulevard Pavement Restoration from the I-405 Freeway to 223rd Street is listed in the City's Capital Improvement Program for FY 2013/14. The funding for this project is provided by the STPL federal fund. The Federal - Aid Highway Administration Program requires a minimum of 11.47% of non- federal matching funds for STPL federally funded projects. However, this matching fund can be waived through a separate federal program called Toll Credit. Toll Credit is federal revenue earned on existing toll facilities; for example, toll road fees, and toll bridge fees. The FHWA Section 1200) of Title 23, permits states to substitute certain previous toll -financed investments for state and City matching funds on current federal -aid projects. By using Toll Credits to substitute for the required non- federal share on a new federal -aid project, the federal share can effectively be increased to 100 percent. Staff requested that Caltrans apply federal Toll -Credits to this project for the required matching funds. Any other project costs, such as printing, advertising, utility manhole adjustments, soils investigation and material- testing will be funded by the City's Measure "R" Local fund balance. The City of Carson is entitled to receive approximately $280,000.00 of STPL federal funds after the beginning of the federal fiscal year, which starts October I" of each year. This fund is subject to lapse if not obligated within three years of the original allocation date. The current City of Carson's STPL federal fund balance is $936,178.00; of which $105,859.00 of this fund is subject to lapse if it is not obligated by September 30, 2014; and approximately $650,000.00 of the City's STPL federal fund balance will be allocated to Project No. 1330: Avalon Boulevard Pavement Restoration from the I-405 Freeway to 223rd Street. In general, the Avalon Boulevard asphalt pavement is in poor condition and now requires attention. FISCAL IMPACT The total estimated construction cost of this improvement project is $700,000.00. Funds in the amount of $850,000.00 are included in the FY 2013/14 STPL and Measure "R" Local fund budgets. If no costs have been invoiced for a six-month period, ADMINISTERING AGENCY agrees to submit for each phase a written explanation of the absence of PROJECT activity along with target billing date and target billing amount. ADMINISTERING AGENCY agrees to submit the final report documents that collectively constitute a "Report of Expenditures" within one hundred eighty (180) days of PROJECT completion. Failure of ADMINISTERING AGENCY to submit a "Final Report of Expenditures" within 180 days of PROJECT completion will result in STATE imposing sanctions upon ADMINISTERING AGENCY in accordance with the current Local Assistance Procedures Manual. 4. The Administering Agency shall not discriminate on the basis of race, religion, age, disability, color, national origin,_ or sex in the award and performance of any Federal - assisted contract or in the administration of its DBE Program Implementation Agreement. The Administering Agency shall take all necessary and reasonable steps under 49 CFR Part 26 to ensure nondiscrimination in the award and administration of Federal -assisted contracts. The Administering Agency's DBE Implementation Agreement is incorporated by reference in this Agreement. Implementation of the DBE Implementation Agreement, including but not limited to timely reporting of DBE commitments and utilization, is a legal obligation and failure to carry out its terms shall be treated as a violation of this Agreement. Upon notification to the Administering Agency of its failure to carry out its DBE Implementation Agreement, the State may impose sanctions as provided for under 49 CFR Part 26 and may, in appropriate cases, refer the matter for enforcement under 18 U.S.C. 1001 and/or the Program Fraud Civil Remedies Act of 1986 (31 U.S.C. 3801 et seq.). 5. As a condition for receiving federal -aid highway funds for the PROJECT, the Program Supplement 07 -5403R -N019- ISTEA Page 2 of 3 � O 07-LA-0-CRSN 06/10/2014 STPL-5403(023) SPECIAL COVENANTS OR REMARKS Administering Agency certifies that NO members of the elected board, council, or other key decision makers are on the Federal Government Exclusion List. Exclusions can be found at www.sam.gov. 6. Award information shall be submitted by the ADMINISTERING AGENCY to the District Local Assistance Engineer within 60 days of project contract award and prior to the submittal of the ADMINISTERING AGENCY'S first invoice for the construction contract. Failure to do so will cause a delay in the State processing invoices for the construction phase. Please refer to Section 15.7 "Award Package" of the Local Assistance Procedures Manual. 7. Any State and Federal funds that may have been encumbered for this project are available for disbursement for limited periods of time. For each fund encumbrance the limited period is from the start of the fiscal year that the specific fund was appropriated within the State Budget Act to the applicable fund Reversion Date shown on the State approved project finance letter. Per Government Code Section 16304, all project funds not liquidated within these periods will revert unless an executed Cooperative Work Agreement extending these dates is requested by the ADMINISTERING AGENCY and approved by the California Department of Finance. ADMINISTERING AGENCY should ensure that invoices are submitted to the District Local Assistance Engineer at least 75 days prior to the applicable fund Reversion Date to avoid the lapse of applicable funds. Pursuant to a directive from the State Controller's Office and the Department of Finance; in order for payment to be made, the last date the District Local Assistance Engineer can forward an invoice for payment to the Department's Local Programs Accounting Office for reimbursable work for funds that are going to revert at the end of a particular fiscal year is May 15th of the particular fiscal year. Notwithstanding the unliquidated sums of project specific State and Federal funding remaining and available to fund project work, any invoice for reimbursement involving applicable funds that is not received by the Department's Local Programs Accounting Office at least 45 days prior to the applicable fixed fund Reversion Date -will -not be paid. These unexpended funds will be irrevocably reverted by the Department's Division of Accounting on the applicable fund Reversion Date.
