ORDINANCE NO. 102
AN ORDINANCE LEVYING AND ASSESSING SPECIAL
ASSESSMENTS ON CERTAIN LOTS, PIECES AND
PARCELS OF LAND LIABLE FOR SUCH ASSESSMENTS
TO PAY THE COSTS OF CERTAIN INTERNAL
IMPROVEMENTS IN THE CITY OF BEL AIRE,
KANSAS, AS HERETOFORE AUTHORIZED BY
RESOLUTION NO. R-85-10 OF THE CITY; AND
PROVIDING FOR THE COLLECTION OF SUCH SPECIAL
ASSESSMENTS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL
AIRE, KANSAS:
SECTION 1. For the purpose of paying the costs of the
following described improvements in the City:
Drainage Improvements to Eagle Lake Addition;
to the City of Bel Aire, Kansas; as heretofore authorized by
Resolution No. R-85-10 of the City of Bel Aire, Kansas, there
are hereby levied and assessed against the properties liable
therefor the several amounts set forth on Exhibit A attached
hereto.
SECTION 2. The amounts so levied and assessed as set
forth on Exhibit A of this Ordinance shall be due and payable
from and after the date of publication of this Ordinance; and
the City Clerk shall notify the owners of the above described
property of the amount of their assessment. Pursuant to
certain Waiver and Consent documents signed by and filed with
the City by all of the owners of the property listed on Exhibit
A attached hereto, which documents are on file in the Office of
the City Clerk for public inspection, the City Clerk shall
certify to the County Clerk, in the same manner and at the same
time 3S other taxes are certified, for a period of fifteen (15)
years, all of the abOve assessments, together with interest on
such 3mount thereof at a rate not exceeding the maximum amount
therefor as prescribed by the laws of the State of Kansas; and
such amounts so certified shall be placed on the tax rolls and
shall be collected as other taxes are collected over said
periOd of fifteen (15) years, the levy fOr each year being for
a portion of the principal amount of the assessment plus one
(1) year's interest on the a~ount remaining Unpaid.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage, approval and publication once
in the official city newspaper.
PASSED AND APPROVED by the Governing Body of the City of
Bel Aire, Kansas, on November 5, 1985.
