ORDINANCE NO. 11-09
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA AMENDING
ORDINANCE 86-8, THE LAND DEVELOPMENT CODE,
SECTION 6.10 (B) (19) TO INCLUDE RETAIL USE IN THE
I-1 INDUSTRIAL ZONING DISTRICTS UPON APPROVAL
BY THE CITY FOR A SPECIFIC LOCATION WITHIN SAID
DISTRICTS AS A SPECIAL EXCEPTION. SITE PLAN
REVIEW IS REQUIRED, AND AN ANNUAL LICENSE
MUST BE OBTAINED TO CONTINUE OPERATIONS;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR CONFLICT AND REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, it is necessary from time to time to update zoning and regulations to
provide clarification or create additional standards related to specific uses; and
WHEREAS,the City Commission of the City of Opa-locka desires to permit retail use in
the I-1 Industrial Zoning District; and
WHEREAS, this change promotes identification of areas where retail use will be
permitted, only after site plan approval as a special exception, in limited industrial operations
areas without creating hazards to the general public or interfering with neighboring uses; and
permitting this use will encourage better designed light industrial uses; and
WHEREAS, the following conditions are also imposed for this permitted use: (1)
Formal site plan review is required and this use is permitted as a special exception. (2) The
retail use structure should have a floor plan of at least one thousand square feet. (3) The site plan
must meet all parking requirements for approval. (4) An annual license must be obtained for
operation:
NOW, THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF OPA-LOCKA,FLORIDA,AS FOLLOWS:
Section 1. The recitals to the preamble herein are incorporated by reference.

Section 2. The City Commission of the City of Opa-locka hereby amends Zoning
Ordinance 86-8 Section 6.10 (B) (19) to include Retail Use as a permitted use in I-1 zoning
districts, as a special exception with the above listed conditions.
Section 3 All ordinances or Code provisions in conflict herewith are hereby
repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions of this Ordinance.
Section5. This Ordinance shall, upon adoption, become effective as specified by the
City of Opa-locka Code of Ordinances and the City of Opa-locka Charter.
