Mayor Berner called the meeting to order at 6:30 p.m. Roll Call: Joann Kahler,'Mike Ryan,Jim Bartels, Peggy Upton, Royce Phillips . Also present: Attorney Raiber, Engineer Frederick, Administrator Jackson. Motion Bartels to approve the agenda, secondedKahler. Ayes=Kahler, Ryan, Bartels, Upton. Nays=Phillips. Motion carried. Motion Ryan to strike item for Klein P &Z appointment, second Kahler. Bartels mentioned Moore has a for sale sign up; might need to consider striking Moore P &.. Z appointment. Upton indicated to let everything play out. Ryan withdrew his motion, Kahler was fine with the withdrawal also. Wells Fargo did not attend to talk to Council regarding online utility payments. Ms: White did not attend to talk to Council regarding signage for Hickory Knoll. Mayor Berner opened the public hearing for the Subdivision Ordinance to allow for private sewage disposal systems at 6:38 p.m. Motion Ryan to open, seconded Bartels. All ayes. Motion carried. No written-comments or responses received. Mayor Berner closed the public hearing at 6:38 p.m.. Motion Ryan to close, seconded Bartels. All ayes. Motion carried. Mayor Berner opened the public hearing for bicycle parking ordinance at 6:39 p.m. Motion Ryan to open, seconded Kahler. All ayes. Motion carried. No written comments or responses received. Mayor Berner closed the public hearing at 6:39 p.m. Motion Ryan to close, seconded Bartels. All ayes. Motion carried. Mayor Berner opened the public hearing for lighting ordinance at 6:40 p.m. Motion Bartels to open, seconded Ryan. All ayes. Motion carried. No written comments or responses received. Mayor Berner closed the public hearing at 6:40 p.m. Motion Ryan to close;seconded Bartels. All ayes. Motion carried. Motion Kahler to approve the payables, seconded Bartels. Ayes=Upton;Bartels, Ryan, Kahler. Nays=Phillips. Motion carried. Discussion and possible action Ireland Avenue—Church: Council had discussion about conflict of interest and not wanting to delay the project any further. Attorney Raiber indicated the two options are condemnation or get another appraisal; possible outcome from suit: if judge sides with filer,the contract would be void,then we would have to go back to court for condemnation., Mayor Berner stated the City is not doing anything wrong, it is just a gray area with the conflict of interest. Phillips stated the counter is excessive. Bartels will abstain from voting because he'was a trustee previously. Motion Ryan to accept counter offer from Church and move forward with Ireland, Kahler second. Ayes=Kahler, Ryan. Nays=Upton, Phillips. Abstain: Bartels. Motion failed. Motion'Ryan to proceed with condemnation, second Kahler. Mayor Berner stated the purpose of the condemnation is not because there is no other way to move forward, but to have a decision by another party. Ayes=Bartels, Ryan, Kahler. Nays=Phillips, Upton. Motion passed. �� i Resolution 2013-190 Setting a public hearing for.adopting SUDAS standards: Motion Ryan for public hearing to be 11/13/13, second Kahler. Ayes=Phillips, Upton, Bartels, Ryan, Kahler. Motion passed. Re-passage Resolution 2013-181 Appointment to the Planning &Zoning Commission—Klein- overriding Veto by Mayor and Resolution 2013-185 Appointment to the Planning&Zoning Commission—Moore: Motion Upton to table the Resolutions for Klein and Moore to the 10/30/13 special meeting to confirm if Klein was withdrawing application and to see if Moore was moving out of town, second Ryan. Ayes=Upton, Bartels, Ryan, Kahler. Nays=Phillips. Resolution 2013-189 Approving Connor, Edwards & High Development Easements: Mayor Berner indicated easements not ready yet. Motion Ryan to put on special meeting and the next agenda item, second Kahler. All Ayes. Resolution 2013-186 Approving Award of Contract for the Jasper Ave Watermain Extension Project to Cornerstone at$183.025.45: Mayor Berner indicated easements are not completed, so cannot award contract until finished, put this item on the 10/30/13 special meeting for further discussion. Ordinance 2013-341 Amending the Zoning Ordinance to allow for Willow Ridge PAD on Lot 6-2nd reading: Motion Ryan to approve, seconded Bartels. Ayes=Kahler, Ryan, Bartels, Upton, Phillips. Second reading passed. Discussion and possible'action on addition of street light at Jasper and Highway 6: Mayor Berner indicated there needs to be an additional street light added (kitty-corner on the south-east corner). Motion Upton to install light, second Ryan. All Ayes. Motion passed. Discussion and possible action Richard Pasch: Phillips read minutes from 09/22/12 indicating the seeding to Pasch was approved. Motion Phillips to approve the seeding and payment of the $1,000 invoice, second Ryan. Ayes=Phillips, Upton, Bartels, Ryan. Nays=Kahler. Motion carried. Resolution 2013-191 Authorizing Mayor and City Administrator/Clerk to prepare a 28E proposal agreement with the school for a sidewalk and property acquisition: Mayor Berner attended the 10/16/13 School Board meeting. Since there was no 28E agreement for them to review, no agreement was reached. Discussion about the City assisting with paying 25%of the trail-sized sidewalk from the West of the school's property line to the new Ireland Avenue, who is responsible for payment of the updates, safety of students crossing Highway 6. Motion Upton to approve, seconded Ryan. Ayes=Upton, Bartels, Ryan, Kahler. Nays=Phillips. Motion passed. Resolution 2013-192 Setting a public hearing for Repealing the Access Regulation Ordinance: Mayor Berner indicated this needs to be repealed due to conflicts with SUDAS. Public hearing on 11/13/13:Motion Ryan to repeal, seconded Upton. Ayes=Phillips, Upton, Bartels, Ryan, Kahler. Motion passed. Discussion and possible action for Jon's Ice Cream water leak issue: Informed incorrectly about location of water line issues and would like some financial assistance. Philips,clarified he is asking only$3,000 of the $12,000 due to the city's misdirection of location of water line. Public Works Mehmen was not at meeting to discuss issue. Motion Kahler to adjourn to the 11/13 meeting, second Upton. Ayes=Phillips, Upton, Ryan, Kahler. Nays=Bartels. Motion carried. f , Approval of Hunting application: Motion Kahler to approve, second Ryan. No aerial map included with application. Motion Kahler to withdraw motion, Ryan concurred. Motion Upton to adjourn until the 10/30 meeting to get the aerial map. Upton withdrew motion. Motion Ryan to approve, pending an accurate aerial map, no second received. Motion died. Discussion and possible action for Affordable Housing:Administrator Jackson indicated that it is a County-wide initiative to discuss this topic in each city. Council commented on a lot of building going on now intown, we would prefer single family over multi-family, other cities have higher priced homes than Tiffin, need to get all of the cities in the county involved. Ordinance 2013-342 Amending the Subdivision Ordinance to allow for Private Sewage Disposal Systems-1St reading: Discussion on the pros and cons of a super majority to approve. Council confident that the super majority option is'good for future developments. Motion Ryan to approve, second Bartels. Ayes=Phillips, Upton, Bartels, Ryan, Kahler. Reading passed. Ordinance 2013-343 Amending Section 8.01 and 8.06 of the Zoning Ordinance—Exterior Lighting- 1st reading: Motion Upton to adjourn until the 11/13/13 council meeting to review the red-line, second Phillips. All ayes. Motion passed. Ordinance 2013-344 Amending Section 7.04 of the Zoning Ordinance—Bicycle Parking-1St reading: Mayor Berner indicated this is P &Z's recommendations. Council would like a memo from P &Z Chair for why this is Ordinance is necessary. Motion Upton to adjourn until the 11/13/13 meeting, second Bartels. Ayes=Kahler, Bartels, Upton. Nays = Phillips, Ryan. Motion carried. Discussion and possible action to drill the lock box at Solon State Bank: Motion Ryan to drill lock box not to exceed $250, second Kahler. All ayes. Motion approved. Discussion and possible action for the tunnel under Highway 6: Mayor Berner indicated we need to request a 5 year extension. Engineer Frederick said VJ Engineering will need to be hired to do the inspections at a cost of around $500. Motion Upton for 5 year extension to the tunnel with inspections, second Ryan. All ayes. Motion approved. Discussion and possible action for cell tower rental to Verizon at the water tower: Motion Upton to table until Verizon can come to a meeting, second Ryan. All ayes. Motion passed. Resident Connor indicated he lives next to the water tower and requested not to rent space until there is some research completed on the safety of radio waves. Mr. Connor also indicated that it may distract future potential of selling his home in the future. Motion Ryan to adjourn at 8:46 p.m:, seconded Upton. All ayes. Motion carried.
