HomeMy Public PortalAbout09-17-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, SEPTEMBER 17, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, September 17, 2007, in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GLOVER President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the meeting of September 4, 2007 and the Memorandum of Committee of the Whole on September 5, 2007, with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 9 -2007 — A RESOLUTION SUPPORTING THE APPROVAL OF A LATE FILED APPLICATION FOR A REAL ESTATE TAX ABATEMENT FOR ROSE CITY BUSINESS PARK, LLC. The Clerk Resolution No. 9 -2007 by title only. This Resolution would allow Rose City Business Park to file a late Statement of Benefits form. The total value of improvements made to Real Estate has exceeded the projection stated in Ordinance No. 11- 2006. Councilor Wissel moved to amend Resolution No. 9 -2007 to reflect the estimated New Value of Real Estate at $5,065,000, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Tax Abatement Committee recommended approval of Resolution No. 9 -2007 as amended. Councilor Wissel moved to approve Resolution No. 9 -2007 as amended, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR ■ The Government Citizen Academy — Richmond 101 held its first session on September 11 and was well attended. ■ Mayor Hutton thanked the Richmond Fire Department, other City Departments (i.e., Street, Sanitary, Police) and surrounding community Fire Departments who responded to the fire at Primex. ■ The Indiana Department of Transportation notified the City that the intersection of 170 and US27 will be closed approximately six months. Common Council Minutes September 17, 2007 Page 2 of 5 ■ Cans will again be collected during the month of October — "Cans for Cash ". In 2006, the City of Richmond received an award of $5,000 for having the largest number of cans collected. The funds were used for the Fire /Police Training Facility. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the August 30. 2007 meeting was accepted as presented. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS - None MISCELLANEOUS BUSINESS Councilor Welch moved to amend the agenda by reversing the order of Ordinances being heard on second reading, with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 50, 61, 62, 63 & 64 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 50 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET The Clerk read Ordinance No. 50 -2007 on first reading by title only. This Ordinance is an amendment of the 2007 Police Department Budget. Councilor Wissel moved to advance Ordinance No. 50 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 50 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 50 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 50 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 50 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 50 -2007 on third reading by title only. Ordinance No. 50 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 61 -2007 — A SPECIAL ORDINANCE VACATING A DEDICATED ALLEY (N of Seton Catholic School) The Clerk read Ordinance No. 61 -2007 on first reading by title only. This Ordinance is a petition to vacate portions of the alley between South 5th and South 6th Streets north of Seton Catholic School for help facilitate the development of a gymnasium for the school. Common Council Minutes September 17, 2007 Page 3 of 5 Ordinance No. 61 -2007 was referred to the Plan Commission for public hearing on September 27, 2007 ORDINANCE NO. 62 -2007 — A SPECIAL ORDINANCE VACATING A DEDICATED ROADWAY (100 blk of NW 20th St) The Clerk read Ordinance No. 62 -2007 on first reading by title only. This Ordinance is a petition to vacate portions of the uncompleted NW 20th Street to facilitate the development of eight residential lots in the 100 block. Ordinance No. 62 -2007 was referred to the Plan Commission for public hearing on September 27, 2007. ORDINANCE NO. 63 -2007 — A SPECIAL ORDINANCE VACATING A DEDICATED ALLEY (east -west alley north of Seton Catholic School) The Clerk read Ordinance No. 63 -2007 on first reading by title only. This Ordinance is a petition to vacate portions of the east -west alley between South 5th and South 6th Streets adjacent to the Seton Catholic School property to facilitate the development of a gymnasium for the school. Ordinance No. 63 -2007 was referred to the Plan Commission for public hearing on September 27, 2007. ORDINANCE NO. 64 -2007 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 55- 2006 KNOWN AS THE 2007 SALARY ORDINANCE The Clerk read Ordinance No. 64 -2007 on first reading by title only. This Ordinance reflects a proposed job title change from Equipment Operator to Maintenance Technician which would be an amendment of the 2007 Street Department Budget. Councilor Welch moved to advance Ordinance No. 64 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 64 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 64 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 64 -2007 with a second by Councilor Glover. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 64 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 64 -2007 on third reading by title only. Ordinance No. 64 -2007 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 48 -2007 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR SERVICES FROM THE RICHMOND SANITARY DISTRICT, RICHMOND POWER & LIGHT, MOTOR VEHICLE HIGHWAY, AND PARK AND RECREATION DEPARTMENT FUNDS TO THE GENERAL FUND IN 2008 The Clerk read Ordinance No. 48 -2007 on second reading by title only Common Council Minutes September 17, 2007 Page 4 of 5 This Ordinance would authorize payment for services from various departments to the General Fund in fiscal year 2008. Ordinance No. 48 -2007 was held on second reading. ORDINANCE NO. 47 -2007 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2008 The Clerk read Ordinance No. 47 -2007 on second reading by title only. This Ordinance contains the proposed compensation for all elected city officers for fiscal year 2008 Councilor Welch moved to amend Ordinance No. 47 -2007 to forego the 3% increase in salary for all elected officials, with a second by Councilor Klose. Upon a vote viva voce, the motion passed. Councilor Parker moved to amend Ordinance No. 47 -2007 as amended and exclude the Mayor and Clerk from the Amendment, with a second by Councilor Elstro. The motion failed with a 5 -4 vote. Dissenting were Councilors Lundy, Wissel, Sharp, Welch and Pappin. Council President Pappin declared Ordinance No. 47 -2007 as amended on second reading and public hearing. Speaking in favor of Ordinance No. 47 -2007 as amended was Allen Williams of Wayne Political Action Committee, Centerville, Indiana. There being no comments against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 47 -2007 as amended with a second by Councilor Welch. The motion failed with an 8 -1 vote. Dissenting was Councilor Glover. Ordinance No. 47 -2007 as amended will be held on second reading. ORDINANCE NO. 46 -2007 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2008 SALARY ORDINANCE The Clerk read Ordinance No. 46 -2007 on second reading by title only This Ordinance contains the proposed salaries for civilian employees for fiscal year 2008 Councilor Welch moved to amend Ordinance No. 46 -2007 by changing the number of Equipment Operators in the Street Department to 15 and adding one Maintenance Technician, with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. Council President Pappin declared Ordinance No. 46 -2007 as amended on second reading and public hearing. Speaking in opposition of Ordinance No. 46 -2007 as amended was Byron Klute, 323 So. 19th Street, Richmond. Mr. Klute spoke to the section of this Ordinance regarding the Human Rights Commission. Councilor Wissel moved to hold Ordinance No. 46 -2007 as amended on second reading, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 45 -2007 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2008 BUDGET The Clerk read Ordinance No. 45 -2007 on second reading by title only. This Ordinance is the proposed budget for fiscal year 2008. Councilor Sharp moved to reduce the Human Rights Commission portion of the 2008 Budget from $127,224 to $94,000, with a second by Councilor Elstro. The motion passed with a 6 -3 roll call vote. Dissenting were Councilors Lundy, Glover and Klose. Common Council Minutes September 17, 2007 Page 5 of 5 Council President Pappin declared Ordinance No. 45 -2007 as amended on second reading and public hearing. Speaking in opposition to Ordinance No. 45 -2007 as amended were the President of the Richmond Human Rights Commission Bob Hunter, Richmond Pastor Kenneth Wright, Richmond Human Rights Commission Director Ron Chappell, Allen Williams and Byron Klute. Ordinance No. 45 -2007 as amended was held on second reading until the Budget Adoption Hearing, September 27, 2007. The time for this meeting was moved to 7:00 P.M. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, the meeting was adjourned.
