RESOLUTION NO. 06-056
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARSON, CALIFORNIA, AMENDING THE GENERAL
PLAN LAND USE DESIGNATION OF CERTAIN
PROPERTY (GENERAL PLAN AMENDMENT NO. 76-05)
THE CITY COUNCIL OF THE CITY OF CARSON HEREBY FINDS, RESOLVES, AND
ORDERS AS FOLLOWS:
Section 1. An application to change the Land Use Element of the General
Plan from General Commercial to Medium Density Residential was duly filed by the
applicant, Lyon Realty Advisors, Inc., with respect to real property described in Exhibit
"A" attached hereto, and requesting approval of General Plan Amendment (GPA) No.
76-05. The subject property is located at 1281 E. UNIVERSITY DRIVE, CARSON,
CALIFORNIA.
Section 2. A public hearing was duly held on May 15, 2006, at Carson
Community Center, Hall 13, 801 East Carson Street, Carson, California. A notice of the
time, place, and purpose of the aforesaid meeting was duly given. Evidence, both
written and oral, was duly presented to and considered by the City Council at the said
hearing. Following the aforesaid public hearing the City Council announced its decision
to recommend approval of the amendment and zone change applications.
Section 3. The City Council hereby finds that:
a) The proposed High Density Residential land use designation for the 5.11
acres is compatible with the surrounding area, including the industrial uses
to the east, the university to the north and west, and the single-family
homes to the south. This project is consistent with the Housing Element
goal of providing market -rate and senior rental housing.
b) The proposed project has been reviewed by the City Traffic Engineer and
is consistent with the Transportation and Infrastructure Element goals and
policies. The project site is located on the northwest corner of Central
Avenue and University Drive, which are major and secondary highways,
respectively. These roadways have adequate capacity to handle
projected traffic levels.
c) The proposed project will improve a vacant, underutilized property that is
part of the Dominguez Technology Center Specific Plan. Previous
attempts by the applicant to develop the site for commercial and industrial
uses have been unsuccessful due to low traffic volume on adjacent roads
and incompatibility with the neighborhood to the south. The current
proposal is not dependent on high traffic volumes, would not substantially

increase local traffic, and would be compatible with surrounding and
proposed uses for the area.
d) The proposed project is consistent with the Land Use Element goal under
Residential Land Uses and will achieve the City's long-term housing and
land use objectives by providing rental housing. Final development plans
will be reviewed and approved by the Planning Commission to ensure that
the project is well designed and aesthetically pleasing.
e) State law requires compatibility between land use zoning classifications
and the General Plan. Therefore, a zone change is included to change
the zone district to DTCSP (Dominguez Technology Center Specific Plan)
in order to be consistent with the proposed General Plan land use
designation of High Density Residential.
f) The General Plan Housing Element indicates that the city is in short
supply of housing. In order to facilitate additional housing opportunities, it
is necessary to include a provision in the Land Use Element allowing for
increased density within specific plan areas. Specific plans regulate the
design and development of land uses, and thus, are an appropriate
mechanism to ensure high quality, attractive development. Therefore, the
city finds that allowing increased density within specific plan areas is
appropriate.
g) On March 28, 2006, the Planning Commission adopted a mitigated
negative declaration (MND) pursuant to Section 15070 et seq. of the
California Environmental Quality Act (CEQA) Guidelines.
Section 4. Based on the aforementioned findings, the City Council finds that:
a) The General Plan Land Use Element be amended to change the
designation of certain property as legally described in Exhibit "K and
shown in Exhibit "B", attached hereto, from General Commercial to High
Density Residential.
b) Section 4.3, Land Use Designations, of the General Plan Land Use
Element be amended to allow for increased density within specific plan
areas by adding the following underlined text at the end of the last
paragraph of the High Density Residential (HD) subsection:
This land use category will be implemented by the RM(25) -
Residential Multiple Family zone and specific plan zones, with a
maximum density of 25 du/ac, except that specific plan zones may
exceed 25 dulac.

Section 5. The Secretary shall certify to the adoption of the Resolution and
shall transmit copies of the same to the applicant.
