Home My Public Portal About12-01 Amending Section 21-80 Deposit of the code of Ordinance 1st Reading: 12/14/2011 2nd Reading: 01/11/2012 Public Hearing: 01/11/2012 Adopted: 01/11/2012 Effective Date: 01/12/2012 Sponsored by: City Manager ORDINANCE NO. 12-01 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AMENDING SECTION 21-80, DEPOSITS, OF THE CODE OF ORDINANCES OF THE CITY OF OPA-LOCKA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY AND CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City bills for Water and Sewer services, and deposits that are placed on the accounts are found to be necessary and useful in assisting the City in its efforts to maintain and collect for said services; and WHEREAS, Section 21-80 of the Code of Ordinances of the City of Opa-locka needs to be amended, so that utility deposits are in line with current rates, in order to ensure payment of the final utility bills for customers who disconnected service or abandoned their account. NOW, THEREFORE, BE IT DULY ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. Section 21-80, Deposits, of the Code of Ordinances of the City of Opa- locka, is hereby amended as follows: (a) Water service. Upon the request of the owner or consumer making such deposit or their assigns, for discontinuation of service and upon payment of all charges arising out of any service on said premises, the deposit shall be refunded. Existing consumers who prior to the effective date of this section have deposited minimum deposits with the city in accordance with the provisions of the Code of Ordinances shall be permitted to maintain said minimum deposit unless the said account is in default, delinquent, or a lien is filed by the city against the property served. Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Ordinance No. 12-01 Section 6.
