Dvorak and Rick Moore Adjournment Tiffm Planning and Zoning Commission March 7, 2001 A regular meeting of the Tiffin Planning and Zoning Commission was brought to order by Chair Steve Berner at 6:30 p.m. Wednesday, March 7, 2001. Commission members present: Steve Berner`,Tina Walls and Melvin Reeve. Absent:,Terry Richardson,'and Sandy Huedepohl. Also present: Mayor Glenn Potter, hi Bartels, Mike Ryan, Greg Schott, Attorney Greenleaf, Doug Frederick, Tracy Hightshoe. Motion Walls, second Reeve to approve the printed minutes. Ayes: Reeve, Walls, and Berner. Motion carried. Joe Johnston not present. Mike Ryan explained plans for a new church sign. Discussion concerning signing desire by Grace United Methodist Church: Motion Reeve, second Berner that the request for a 32 sq. foot sign be denied to the Grace United Methodist Church as it exceeds the 25 sq. foot maximum allowed under the current ordinance. -Ayes: .Reeve,'Berner, and Walls. Absent: Richardson, and Huedepohl: Motion carried. Mr. Johnston arrived and presented copies of his rezoning request to Planning and Zoning members and was received by City of Tiffin. List of surrounding property owners did not accompany request. Fee payment did not accompany the request. Mr. Johnston making request for zoning change from R-1 (single family residential) to C-1 commercial at 230 Main Street. Joe explained that the roof recently fell in on this residential building and he would like to rebuild`it in•stages taking the back end off first, and then sliding the front part to the back part of the building.. Adding a second floor and using it for multiple apartments and then later converting it to commercial if there was a market for that use. The building inspector'indicated that a change of zoning would require adherence to the requirements of the new zone. Joe thought he would like to keep the present footprint as he thought it might be within one foot of his property line and wondered why it:would be necessary to follow new setback requirements. Building inspector Schott said if Johnston retained his'current zone with no'changeand continued current use it would not be necessary to follow C=1 setbacks, the'present buildingls existing or grandfathered to its location. Changing the zone, would necessitate following setback of the changed zone. Joe wondered if a new zoning precluded his ability to build apartments along with later commercial or if his building plans precluded zoning here. If C-1 zoning was not approved Joe thought he would have to replace the roof and continue to use this as an R-1 single-family unit. Attorney Greenleaf indicated that a building permit was regulated by the zone area, and the Planning and Zoning would need to designate a use or the most appropriate land'u'se for this location. Greenleaf said that Slim's was across the street diagonally and thus the area might be considered a commercial area Greenleaf suggested the P&Zwould need • to look not at the location but rather look for similar uses in this location. Tiffm Planning and Zoning Commission March 7, 2001 Page 2 Attorney Greenleaf has provided memo recommending notification of all surrounding property owners during rezoning petitions. List submittal is required under ordinance, however notification is not required under ordinance.. The Planning and Zoning will take this under advisement at the next regular meeting. • Planning and Zoning noted that R-1 is located to the south, east,north and west of 230 Main Street. Slim's Tavern is a grandfathered commercial use, however it is zoned R-1. The Hardware is presently used and zoned R-1. Motion Walls; second Reeve recommend that the city deny request from Joe Johnston for C-1 commercial zoning for 230 Main Street. Ayes: Berner, Walls, and Reeve. Absent: Huedepohl, and Richardson. Motion carried. As request is received during this meeting, publication requirements for Public Hearing held at the next regular meeting of the City Council is not possible. Mr. Johnston will need to provide list of all neighbors within 500 feet of rezoning request and pay rezoning request fees prior to publication for Public Hearing, Public Hearing set for the next regular city.council meeting April 11 at 6:30 p.m. at the Tiffin Fire Station if all paperwork is received in sufficient time to meet publication deadlines. Doug Frederick reported that the zoning change from R-3 to R-i on Lot 2 of Sadler Subdivision appeared to be a transcription mapping error,there did not appear to be any record of zoning change request. Motion Reeve,,second Walls to recommend approval of Lot 2, Sadler Subdivision from R-1 to R-3 multiple family zoning due to transcription mapping error. Ayes: Reeve, Berner, and Walls:,`Absent: Huedepohl, and Richardson. Motion carried. Building inspector Schott explained'that Mr. Wear would like to combine Lot 1 and'Lot 2 into one lot that could then possible allow the addition of 8 new units on this location. Planning and Zoning questioned location of front and rear of lots. The current front is to • the east facing College Street. It would not be possible to call the front another direction' when all building is combined on one lot with a determined front. Mr. Wear would not be able to call'two different directions front. Doug Frederick gave report on a possible route for the proposed Ireland`Avenue. Mayor - Potter reported that the school would appreciate effort to stay as{far east as possible for• this street. The school does not want to,see a reduction in parking lot, nor reduction m size of the ball field. Hart should review the area to see if some right-of-wayycan be taken from each side and report to city at next regular meeting. I RJ Dvorak and Rick Moore of Johnson County Zoning visited with the Planning and Zoning regarding growth plans by the city. The new fringe map includes all areas' currently desiring annexation. Dvorak and Moore expressed Johnson County support of all new growth of the community with the exception of area south of Schneider. ,Schneider is very anxious to come into the city. Dvorak explained that the city would not want the high maintenance costs that would be inevitable with 340th Street, and Tiffin Planning and Zoning Commission 3/7/2001 Page 3 upgrading costs could be extreme. If the road remains in the county, these costs could remain with the residents of Johnson County. Mr. Dvorak did not indicate when the county would be completing upgrade work, however the City of Tiffin did consider as alluded by Dvorak that the delay of annexation plans could be forestalled until after the county taxpayers have financed these very expensive upgrades. Dvorak was asked if he. thought the county could support city growth plans if the city were willing to accept full road obligation. Dvorak said no. Dvorak gave no explanation of why these enumerated high costs would want to be avoided by the city and retained by the county in this area. All commended the effort placed in the presented document with input from Hart Frederick and Johnson County Zoning officials. Dvorak and Moore recommended presentation to county officials, and planning work with Coralville. Dvorak and Moore were thanked for their work and they indicated true interest in assisting the City of Tiffin in any way they could in planning matters. Motion Reeve, second Walls to recommend approval of Johnson County/City of Tiffin jointly planned fringe area map document worked out with county officials with alteration of all labeled zone 3 to be revised to zone 2, and that the City of Tiffm proceed with annexation requests including nonvoluntary areas that will provide elimination of islands and provide for uniform boundaries as requested in session of the State Development Board. Ayes: Walls, Reeve and Berner. Absent: Huedepoh, and Richardson.. Motion carried. This jointly planned fringe area map document will be set for Public Hearing at the upcoming meeting of the Tiffin City Council, 6:30 p.m. Wednesday, March 14, 2001 at the Tiffin Fire Station. Motion Reeve, second Walls to recommend that RJ Dvorak and Rick Moore present negotiated fringe area agreement to Johnson County Board of Supervisors and the City of Tiffin arrange a time to meet with the City of Coralville and discuss concerns they have for this area that is in Coralville's growth plan agreement with the county, but not presently but requested for inclusion in the City of Tiffin growth plan agreement with the county.
