ORDINANCE NO. 12-02
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA,TO RESCIND ORDINANCE NUMBER 06-03,
ADOPTING THE EMPLOYMENT AGREEMENT WITH
DEBORAH S. IRBY AS CITY CLERK; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission adopted Ordinance 06-03 on March 8,2006,authorizing
an Employment Agreement with Deborah Irby as the City Clerk of the City of Opa-locka; and
WHEREAS, the City Commission of the City of Opa-locka desires to rescind Ordinance
06-03.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. Ordinance No.06-03,authorizing the Employment Agreement with Deborah
S. Irby as City Clerk, on terms and conditions set forth therein, is hereby rescinded.
Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4. SEVERABILITY. If any portion,section,phrase or clause of this Ordinance is
held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the
remainder of this Ordinance.

Section 5. EFFECTIVE DATE. This Ordinance shall upon adoption, become effective
immediately.

ORDINANCE NO. 06-03
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA,FLORIDA,AUTHORIZING AN EMPLOYMENT AGREEMENT WITH
DEBORAH S. IRBY AS CITY CLERK,ON THE TERMS AND CONDITIONS
SET FORTH HEREIN; CONTAINING A REPEALER PROVISION AND A
SEVERAI3ILITY CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Opa-locka,Florida provides that the City
Commission shall appoint or remove a City Clerk; and
WHEREAS, the current City Clerk has served for an extended period of time without a
written contract, memorializing the terms of his employment; and
WHEREAS, the City Commission is desirous of formalizing the terms of employment
with the City Clerk.
NOW,THEREFORE, BE IT DULY ORDAINED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA,FLORIDA:
Section 1. The recitals to the preamble herein re incorporated by reference.
Section 2. The City Commission hereby enters into an employment agreement with
Deborah S. Irby,on the terms and conditions contained in the employment Agreement
attached hereto and made a part hereof,as Exhibit"A".
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 4. If any section, sentence,clause or phrase of this ordinance is held to be
invalid or unconstitutional by any court of competent jurisdiction than said holding shall in
no way affect the validity of the remaining portions of this ordinance.
Section 5. The ordinance shall become effective in the manner provided by law.
PASSED AND DULY ADOPTED THIS 8th day of March , 2006.
