HomeMy Public PortalAbout3181-1977- AMENDING ORDINANCE 2325-1968 KNOWN AS THE ZONING ORDINANCEORDINANCE NO. 3181--1977 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. WHEREAS, Article 31.002(3) now classifies "Bicycle stores, including rental and repair, as a permitted C-2 Community Business Use, and; WHEREAS, It is the intent of this Ordinance to reclassify "Bicycle Shops, including rental and repair, as a permitted C-1 Neighborhood Business Use, and; WHEREAS, a study of this Ordinance was conducted by the Richmond City Planning Commission on the --- P, day of 1977, at which time remonstrances were heard from all parties in- terested in or affected by this Ordinance, and; WHEREAS the vote of the Richmond City Planning Commission was e to b in favor of the passage of this Ordinance No. 3181-1977. NOW THEREFORE be it ordained that: SECTION I. Zoning Ordinance No. 2325-1968 be, and the same hereby is, amended so that Article 30.002 thereof shall read as follows, to wit: Retail and service uses as follows: (1) Antique Shops. (2) Art Galleries. (3) Barber Shops. (4) Beauty Shops. (5) Bicycle Shops, including rental and repair. (6) Book and stationery stores. (7) Camera and photographic supply stores. (8) China and glassware stores. (9) Clothes pressing establishments. (10) Coin and philatelic stores. (11) Custom dressmaking and millinery shops. (12) Drug stores. (13) Dry cleaning and laundry receiving stations, processing to be done elsewhere. (14) Dry goods stores. (15) Florist shops and conservatories. (16) Food stores, including grocery stores, meat markets, bakeries, candy and ice cream shops, delicatessens and frozen food stores including locker rental in conjunction therewith. (17) Garden supply and seed stores. (18) Gift shops. (19) Haberdasheries. (20) Hardware stores. (21) Hobby shops, for retail of items to be assembled or used away from the premises. (22) Jewelry stores, including watch repair. (23) Laundries, and dry cleaning establishmentslusing only coin - operated machines. These machines are to be used by the customers or a single patron employee. The dry-cleaning machines are to use non-flammable, non -explosive solvents and a dry cleaning establishment located in this district is limited to a steam generator with a maximum of two horsepower capacity. No boiler of any type is permitted and no dry-clean- ing establishment as described above is to be located in the same buildng with a residential use. (24) Leather goods and luggage stores. (25) Locksmith shops. (26) Medical and dental clinics. (27) Medical and dental offices. Ordinance No. 3181-1977 Page 2 (28) Optician shops. (29) Paint and wallpaper stores. (30) Schools, including music, dance or business. (31) Shoe and hat repair stores, (32) Tailor shops. (33) Tobacco shops. SECTION 2. Article 31.002 be, and the same is hereby amended to delete Article 3.1.002 number (6), Bicycle stores, including rental and repairs. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and publication as by law required. March 2, 1977 Mr. James Carter, President Members of Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 3181-1977 - Plan Commission Case 77-2, Richmond City Council requesting an amendment to Zoning Ordinance 2325-1968 Section 30.002 Dear Mr. Carter, Members of the Council and Mrs. Trimble: The Richmond City Plan Commission held a public hearing on Tuesday, February 22, 1977, at 7:30 P.M. in the Council Chambers of the Richmond Municipal Building to hear the request of the Richmond City Council requesting an amendment to Zoning Ordinance 2325-1968 Section 30.002; namely, to allow Bicycle Shops, including rental and repair in a C-1 Neighborhood Business District. The petition was represented by Mr. Robert O'Maley, Attorney, and no remonstrators were present to speak in opposition. The Plan Commission voted unanimously, five (5) to zero (0), to recommend approval of the petition to Common Council. Commissioners Austerman, Bartz, Kyle and Meredith were absent.
