HomeMy Public PortalAbout12-04 Alcohol Free Zone 1 s`Reading: January 25, 2012 2nd Reading: February 22, 2012 Public Hearing: February 22, 2012 Adopted: February 22, 2012 Effective Date: February 23, 2012 Sponsored by: Vice-Mayor Johnson ORDINANCE NO. 12-04 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO ADOPT A POLICY TO MAKE THE CITY PARKS IN OPA-LOCKA AN ALCOHOL- FREE ZONE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY AND CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City Commission of the City of Opa-locka desires to keep the Parks in the City of Opa-locka safe and free of alcohol and alcoholic beverages; and WHEREAS, there is need to promote a healthful and safe environment in our Parks and recreational areas to safeguard the residents of the City of Opa-locka from the perils and other adverse effects of public drinking; and WHEREAS, the City of Opa-locka has the right to protect the community, by creating an alcohol- free environment for the residents by adopting alcohol-free policies in our City Parks. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby agrees to adopt policies to make the City Parks in Opa-locka Alcohol-Free Zones. Public Consumption of Alcoholic Beverages Prohibited; Exceptions. (a) It shall be unlawful for any person to consume or to carry in any cup, glass, can, bottle, or other open or uncovered container any alcoholic beverage in any park or recreational area open to the public or on any public street, sidewalk, trail, alley, or contiguous City property within the City. This section shall not apply to any premises duly licensed pursuant to state law on which is permitted on-premises consumption of alcoholic beverages, or on any privately owned property not within the public right-of-way. (b) Exceptions. (1) Any person, organization or corporation who or which wishes to be excluded from the prohibition of the above subsection (a) for a period of time not to exceed fourteen (14) days may apply to the City Commission for an exception. The criteria to be used by the City Commission shall include: a. The purpose for which the exception is requested. b. The dates, times and locations of such purpose. c. Provisions for security and crowd control. d. Proximity to residential areas. (2) The exception may be granted if the above criteria tend to lessen the impact of such public consumption on any neighboring residential property, and tend not to disturb the health, safety, welfare, peace and comfort of the citizens of the town. The less likely the exception to create a nuisance based upon the above criteria, the more likely the exception is to be granted. (3) This section shall not apply to events to be held on City property with the City administration's knowledge and consent that alcoholic beverages will be consumed on the premises. Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. SEVERABILITY. If any portion, section, phrase or clause of this Ordinance is held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. EFFECTIVE DATE. This Ordinance shall upon adoption, become effective immediately.
