Home My Public Portal About2014_M008 Ltr Opposing HB1084 and SB578 COUNCIL MEETING February 11, 2014 MOTION 2014-008 I move to approve the letter from the Leesburg Town Council requesting that HB 1084 and any companion legislation in the Senate, including Senate Bill 578, be rejected as it is not in the best interest of the Town and its residents and other taxpayers. I further move that the Town Council request that should the legislation pass in a form that is substantially consistent with HB 1084 as proposed, it and any companion legislation be VETOED by the Governor during the veto session I further move that copies of the letter, electronic or otherwise, be sent to at least the entire General Assembly, Loudoun County Board of Supervisors, and the Virginia Municipal League. This bill will likely produce a chilling effect with respect to legislative decisions made by us, Leesburg's governing body. Given the presumption that any unconstitutional condition is the basis for an approval, it may be safest for us to simply deny an application to avoid litigation. The first priority of any local government is to protect its taxpayers and residents; the payment of compensatory damages and attorney fees will be borne by the taxpayer. If the General Assembly allows damages and attorney fees for the applicant on appeal should they prevail, the locality should be awarded the same relief. We, the Council, see the potential for large,unanticipated financial impacts. To mitigate the negative impacts, until a body of case law emerges, the town council may likely consider it is too risky to negotiate with a land use applicant to include proffers and other voluntary terms. As a result, many land use applications the town may be willing to accept may be turned down. The most harmful part of the bill is the power of the court to act like a legislative body by approving the project, after it has stripped the condition the court has found unconstitutional, after the Town and applicant have negotiated a deal. That judicial power is not conditioned on the applicant having objected in writing prior to the approval/denial. We have experienced massive growth in the past 20 years; clearly development has taken place and it is equally clear that the infrastructure to support the development has not kept pace. The remedy sought by the development community should be to work with the Town for trying to mitigate and minimize negative impacts on our existing residents and taxpayers.
