HomeMy Public PortalAbout12-07 Magnolia Apartment to Rezone 1st Reading: March 14, 2012 2nd Reading: April 11, 2012 Public Hearing: April 11, 2012 Adopted: April 11, 2012 Effective Date: April 12, 2012 Sponsored by: City Manager ORDINANCE NO. 12-07 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, TO APPROVE THE REQUEST OF MAGNOLIA APARTMENT, LLC, TO REZONE THE PROPERTY DESCRIBED BY FOLIO 08-2122-003-0040 FROM R-2 (DUPLEX) ZONING DISTRICT TO THE MAGNOLIA NORTH REDEVELOPMENT OVERLAY (MNRO) ZONING DISTRICT WITH SPECIAL EXCEPTIONS TO OPERATE A MULTIFAMILY HOUSING USE AT THE SITE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY AND CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on October 12, 2011 the City Commission adopted Ordinance 11-17, approving the Magnolia North Redevelopment Overlay Ordinance to encourage revitalization; and WHEREAS, the property owner of Magnolia North Apartment, LLC, located at 15050 Duval Street, Opa-locka, Florida, has requested a zoning change from the R-2 (Duplex) Zoning District to Magnolia North Redevelopment Overlay District, with special exceptions to operate a multi-family housing use at the site; and WHEREAS, the subject property was acquired on October 10, 2010 and is currently being renovated as multi-family housing development; and WHEREAS, the MNRO Ordinance enables developers to expedite mixed-use residential development on current designated commercial zone areas in Magnolia North; and WHEREAS, rezoning the property to the MNRO is required in order for the property to be used as a multi-family or mixed-used development; and WHEREAS, the property will be rezoned from R-2 Zoning to the Magnolia North Redevelopment Overlay, with special exceptions to operate a multi-family housing use at the site. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The property located at 15050 Duval Street, Opa-locka, Florida, Folio 08-2122-003-0040, is hereby rezoned from R-2 (Duplex) Zoning to Magnolia North Redevelopment Overlay (MNRO) Zoning District, with special exceptions to operate a multi- family housing use at the site, with all appropriate impact fees to be paid. Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. SEVERABILITY. If any portion, section, phrase or clause of this Ordinance is held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. EFFECTIVE DATE. Finnie, City Manager DATE: January 31, 2012 RE: Request from Magnolia North Apartments, L.L.C., property owner, for a zoning change from the R-2 (Duplex) zoning district to the Magnolia North Redevelopment Overlay (MNRO) District with Special Exceptions. The subject property location is 15050 Duval Street, Opa-locka, FL, specifically described by Folio No. 08-2122-003-0040 and contains 9,474 square feet. Request: An ordinance of the City Commission to approve the request of Magnolia North Apartments, LLC, to rezone the property described by folio 08-2122-003-0040 from R-2 (Duplex) zoning district to the Magnolia North Redevelopment Overlay (MRNO) zoning district with special exceptions, to operate a multifamily housing use at this site. The following are those special exceptions: 1. Allow the subject property to be used as a multi-family apartment 2. No more than fourteen (14) units total be allowed. 3. Minimum lot width shall not be less than 29 feet. 4. Building height shall not exceed 35 feet. 5. Minimum floor area shall not be less than 274 sq. feet for 1-bed room apartments and no less than 501 sq. feet for 2-bed room apartments 6. Minimum front setback shall not be less than ten (10) feet 7. Minimum side (major and minor setbacks) shall not be less than five (5) feet or as determined by Florida Building Code. 8. Minimum rear setback shall not be less than five (5) feet. Summary The subject property is an existing 14-unit apartment building. The current property is zoned R-2 for duplexes only. The subject property has been vacant for more than one (1) year and has lost it's grandfather status. Without rezoning to the appropriate zoning district, in this case the Magnolia North Redevelopment Overlay, the existing building cannot be re-occupied as a 14-unit apartment building. This rezoning action will allow the developer to legally lease and manage an existing apartment building at the subject property. Rezoning this property to the MNRO district is required in order for the property be used as a multi-family or mixed-use development with special exceptions. At that meeting, the item received a recommendation of approval. There was no opposition present against the application. As you know, the Mayor and City Commission adopted the Magnolia North Redevelopment Overlay Ordinance on October 12, 2011. The MNRO ordinances will enable developers to expedite mixed-use residential development on currently designated commercial zoned areas in Magnolia North. In the case of this application, it is critical that the property be rezoned from R-2 (duplex zoning district) to the MNRO, with special exceptions. Magnolia North Apartments, LLC, acquired the subject property on October 10, 2010 and is currently renovating the property to be used as a multi-family housing development. Rezoning this property to the MNRO district is required in order for the property be used as a multi-family or mixed-use development. The MNRO provides the vehicle for redevelopment of underused residential areas that will allow and encourage mixed residential and commercial uses while promoting pedestrian-friendly designs and efficient land use and promote better utilization of passive open space and active recreational space. Financial Impact: No short-term financial impacts. Possible positive long term financial impact due to revenues from an increased tax base and fees such as building and landlord permits. Section 2. The Land Development Code of the City of Opa-locka, Ordinance 86-8, is hereby amended to create the Magnolia North Redevelopment Overlay (MNRO) Ordinance, as follows: Magnolia North Redevelopment Overlay Ordinance A.Purpose and Intent .1. To encourage the revitalization of underused commercial and residential areas into pedestrian-oriented developments that provide a complementary mix of uses, including a variety of residential options, within convenient walking distance. 2. To encourage efficient land use and redevelopment plans forming a live-work-play environment that offers residents the opportunity to fulfill their daily activities with minimal use of single-occupant automobiles. 3. To encourage contiguous development and maximize land use allowing for increased use of alternative transportation modes such as bus transit, rail transit, ridesharing, bicycling, and walking. 4. To encourage formation of a well-designed, pedestrian-friendly activity center with commercial and residential development that increases choices for safe living environments for the citizens of the great City of Opa-locka. 5. To allow flexibility in development standards in order to encourage the design of innovative development projects that set high standards for landscaping, green space, urban design, and public amenities. 6. To promote a distinct, unified theme that will reinforce the branding process and improve the market attractiveness of the area for investments by the private and public sectors. 7. To provide the appropriate incentives to encourage reinvestment and renewal necessary to realize the potential of the 22nd Avenue and Magnolia North Subdivision, consistent with the City of Opa-locka Comprehensive Plan. Ordinance No. 11-17 8. To encourage a design plan that improves public safety and security throughout Magnolia North. B.Applicability The provisions of this map apply to all parcels designated within the Magnolia Subdivision and portions of 22nd Avenue corridor, south of N.W. 151st Street, and North of State Road 9 (EXHIBIT ATTACHED). The boundary of the district shall be shown on the Official Zoning map of the City of Opa-locka and all parcels contained within the zone, which meet the eligibility section below, are able to utilize the provisions set forth in this ordinance. All land uses and development, including but not limited to buildings, driveways, parking areas, streets, buffers, landscaping, and pedestrian / bicycle ways, shall be located and/or provided in accordance with the provisions of the City of Opa-locka Land Development Code and Miami- Dade County Subdivision,except as modified by this chapter. C.Eligibility Properties may use the MNRO ordinance if they meet the following criteria: 1. Can be served by public water and sewer 2. Identified in the applicability section 3. Have an R-1, R-2, B-O, B-1, B-2, or I-1 zoning designation D.Relationship to Existing Zoning Districts The Developer of property that falls within the area covered by this ordinance may choose to develop his/her property using either standards of the underlying zoning district or the standards as set forth under this ordinance. If the Developer chooses to use the standards set forth in this ordinance, then the standards of this section shall take precedence over those of the underlying zoning district and other sections of the land development code. E.Exclusions The following activities shall be excluded from the use of the MNRO requirements and. development review, although they may be reviewed under separate administrative procedures Ordinance No. 11-17 where noted in this section or in other sections of the city of Opa-locka Land Development or City Code of Ordinances. • Non Residential Properties - All lots/parcels that are zoned industrial, except I-1 (limited Industrial), are excluded from this ordinance, but shall comply with the provisions set forth in other sections of the City of Opa-locka Land Development Code. Compliance with these provisions shall be verified through the building permit process_ • Historic Properties -Properties that are contained or listed by the city now or in the future within a locally designated historic district are exempt from this ordinance, but shall comply with the land development code that pertains to the property. • Restrictive Use Areas —This area excludes the construction of single-family and duplex dwellings. F.Permitted,Uses 1. Mixed-use developments, provided that the subject property uses a mix of commercial and residential uses simultaneously 2. Accessory buildings and uses customarily incidental to any of the above permitted uses 3. Community Gardens and other public amenities 4. More than one principal use may be permitted on a lot of record,provided the use is a residential and commercial mixed-use and is utilized with administrative site plan approval. G.Principal Uses Permitted -Subject to Special Exceptions: The following uses may be permitted by the Planning Council subject to the conditions hereinafter imposed for each use, including the review and approval of the site plan by the Mayor and City Commission through its Planning Council in accordance with state public notification and hearing requirements. L All uses allowed under Magnolia North Redevelopment Overlay Ordinance a. Uses permitted under section F shall also comply with the following i. The Planning Council shall impose conditions on the operation of the proposed use including hours of• operation, outdoor operations and Ordinance No. 11-17 delivery and shipping of material that is necessary to ensure the uses compatibility with surrounding areas. ii. In proposed areas of the Magnolia North Redevelopment Overlay district, where residential and commercial predominate, any structural proposals for construction, redevelopment, rehabilitation, modification, or expansion, the exterior appearance shall remain consistent with the general character of the area, including scale and mass of the building, arrangement of windows, pitch of roof, and type of siding material. iii. The Planning Council shall reduce the minimum number of parking spaces required for the property involving two or more uses if their parking demand is anticipated to overlap. H. Restrictive Uses — The area identified as a restrictive use on the attached exhibit is prohibited from constructing a single-family home or duplex. I. Area and Bulk Requirements: I. Uses shall comply with Article V, VI, VU, and VIII of the city's Land Development Code regarding height, minimum size of lot, the maximum density permitted, and providing minimum yard setback requirements for the underlying zoning district. 2. In addition, the Planning Council should recommend to the City Commission maximum front and street side lot line setbacks and minimum height requirements for any expansion, rehabilitation, redevelopment, or new development if they determine it is necessary to maintain the urban character of the neighborhood. 3. Where more than one principal use is allowed on a lot of record, setbacks between the buildings shall be based on the yard setbacks of the underlying zoning district, but may be modified by the City Commission if they are determine that adequate conditions have been included to address public health and adequate emergency access within the site. J. Standards 1. Any non-residential or residential zoned property within the Magnolia Subdivision recorded by subdivision plat or deed, using the proper municipal or county processes at that time, prior to July 27, 2011, is deemed a buildable lot for mixed-use Ordinance No. 11-17 development, even though the lot may have less than the minimum area for any residential or non residential zones. Lots developed in this fashion shall use standards as set forth in this section. 2. Lot size and density - Lot size should not apply. Density shall not exceed fifteen (15) dwelling units per acre. 3. Lot width -Minimum lot width shall not apply to parcels using this ordinance. 4. Building Height-Maximum building height should be 35'. 5. Floor area- Minimum floor area shall be 1000 square feet per residential unit. 6. Building Coverage - Maximum lot coverage shall not apply to parcels using this ordinance. 7. Minimum front setback- No less than ten (10) feet. 8. Minimum side (major and minor) setbacks - No less than five (5) feet or as determined by Florida Building Code. 9. Minimum Rear Setback- No less than fifteen (15) feet. K.Architectural Standards: While the city encourages that all new developments adhere to the Moorish architectural guidelines, all new development created under the MNRO may be exempt and shall have the option to include a number of minor design and site planning elements to ensure quality and compatibility with general housing trends within the city. L.Application Procedures All applicants submitting for development approval through the MNRO ordinance shall follow the following procedures: 1. An original and seventeen (17) copies of site plan, supplementary data, and architectural renderings, shall be submitted to the Community Development Department for review by all relevant city staff. Once staff has reviewed the information and deemed this information to be complete and in compliance with the standards set forth in this ordinance, the proposal and staff comments will be transmitted to the Mayor and City Commission for review. 2. The Mayor and City Commission shall review and approve, deny, or modify its approval through ordinance. Ordinance No. 11-17 3. An application may be withdrawn without prejudice prior to the public hearing. Section 3. All ordinances or Code provisions in conflict herewith are hereby Section 4. If any section, subsections sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. PUBLIC HEARINGS: 1. 0 & E EAST COAST INVESTMENTS LLC. 2527 OPA-LOCKA BOULEVARD, OPA-LOCKA, FL 33054; LOTS 24 & 25, BLOCK 151, COMMUNITY GARDENS, PB 31-5, LOT SIZE 14, 148 SQ FT; FOLIO #0821220110420; ZONED B-1 REQUEST: CITY COMMISSION APPROVAL TO OPERATE A CHILD CARE ACADEMY Chairman Russell mentioned that this item was heard before and it was approved with conditions and forwarded to the Commission. He did not know why it was coming again and did not know what to do with it. Attorney Rodriguez said that when it went in front of the Commission the Planning Council had given the conditions that they meet the parking requirements by showing a site plan showing the parking spaces. There was no clear evidence whether the conditions were met with what was presented to them; therefore they had two options, to deny or send it back to the Planning Council to review and assure the parking requirements are met according to code. Chairman Russell asked if the parking issue was met. Mr. Brown said the condition has to be addressed prior to them going again before the Commission. They will have to come into compliance in order to return to the Commission and prior to getting an occupational license. Chairman Russell then asked how many parking spaces they have. Ms. Aixa Serra, owner of the child care academy, 985 N. E. 116th Street, Biscayne Park, FL 33161, said they have 24 parking spaces. She did not know why she was back at the Planning Council because when she came July 12 she was approved. In October she called to find out what happened because she had not heard anymore and the secretary told her that the Commission did not approve it but sent it back to the Planning Council because of the parking conditions. Chairman Russell then asked Ms. Serra if she had anything to show that she came into compliance. She replied yes and that she showed having 24 parking spaces. There are two churches and her day care. The twenty four parking spaces are used by them Monday through Friday and the two churches are there only on Saturdays and Sundays. Member Kelley said the letters sent from Ms. Serra mentioned there is only one public school in the area and no day cares; there's only two public religious schools and there are 3 or 4 charter schools in the area and several other day cares. He mentioned that staff recommended approval but wanted to know how they are going to address the parking if they are sharing the space with two churches. Mr. Brown said a condition was placed where they have to comply with the off street parking requirements; a site plan showing Planning Council Minutes 12/06/2011 Page 2 of 8 the off street parking spaces would be sufficient. At the Commission meeting there was discussion about playground and parking spaces. There may have been some confusion as to what is off street parking. To clear this matter they have to show the off- street parking spaces on a site plan prior to obtaining a business license. Chairman Russell said he is very familiar with the area and there are other people who occupy the same building, and due to that fact they cannot claim to have 24 (twenty-four) parking spaces. Attorney Rodriguez explained that the application presented was incomplete because according to the Land Development Code the off street parking requirements for a day care is one parking space for each 500 (five hundred) gross sq. ft. of floor area. Ms. Serra notified that there are 1800 (eighteen hundred) sq. ft. Attorney Rodriguez said forl 800 (eighteen hundred) sq. ft. 3 (three) or 4 (four) parking spaces are required, 24 (twenty four) parking spaces have to be divided between the day care and the two churches. If there is an understanding that the uses are only going to be Saturday and Sundays, and the day care Monday through Friday there may not be an issue. Mr. Lee added that in a particular site shared parking often means there are formulas that allow for multiple uses at certain times. They are saying that most of the time they are operating the churches are not operating. It doesn't preclude that the churches could be operating at other times, but generally they will have 3 (three) parking spaces. Another thing if they have enough parking for staff, when kids come and go, their parking is momentarily, like a retail shop. Attorney Rodriguez then explained the code requirements for parking spaces for churches. Without a shared parking agreement if there is an understand that church uses are going to be Saturday and Sunday and the day care uses are Monday through Friday, and there is not going to be any overlapping, that may not be an issue. However, it may become an issue in the future. Chairman Russell then opened the public hearing. Mr. Eddie Rodriguez, 6200 SW 67 Avenue, Miami. 33143. He is an engineer and does many site plans and is bringing one tonight before them. He suggested that if it was already approved she could submit a site plan to the Planning Council with the parking requirements; she can have an engineer do it for her and submit it. Attorney Rodriguez said that is what the Commission had decided. Ms. Serra said she did produce the site plan. Member Kelley asked the staff if the requirement that the Commission and Planning Council recommended to the applicant was adhered to? Mr. Brown said his recommendation is that if it's the pleasure of the Council to approve it subject to site plan review by the office and present to Commission for ratification or table the item until they can bring it back to the Council. Member Kelley interrupted by telling him that was already done. Based on the attorney and chair the requirements haven't been met. If they have not been met the Council cannot be asked to pass something that was sent before with the same challenge. The applicant has to be told that she did not meet the requirements. If she did it would have been passed by the Commission when it went before them. Planning Council Minutes 12/06/2011 Page 3 of 8 Chairman Russell then asked for a motion. Member Kelley said he will not support it because he does not have a site plan, he would move to table it to the next Council meeting in January, 2012. Chairman Russell then informed Ms. Serra about what would happen. Member Guerrero made a motion to table it and Member Kelley seconded the motion for discussion. Chairman Russell said that would only send them back to the same situation, and he would not support that. Ms. Serra was upset because she felt it was not fair that she would probably have to wait another six months. She had been waiting since July for this approval. Attorney Rodriguez explained the situation to Ms. Serra about the code requirements and the reason of the Commission deciding to deny the recommendation and send it back to the Planning Council. She must meet the minimum code requirements for parking on a site plan, otherwise she will be in violation of the code. That has not been met and she should consult with a professional in order to provide a proper site plan because the Council cannot approve or recommend approval to a user site that is inconsistent with the code. There were concerns with the Planning Council and with the Commission because they were not adequately responded. There are no assurances that she met the minimum requirements. Member Kelley asked if there was a site plan. Mr. Lee said yes, but it was incomplete. The site plan addressed parking but not adequately. Member Kelley asked if the applicant was told that the site plan did not show the parking requirements. Mr. Lee responded positively, that the secretary had told him before she retired that she had conveyed the information to the applicant and had not received any updates from the applicant. Chairman Russell asked if this was the same as the request on the last meeting. Mr. Lee said that this request was similar to the other requests that were on 32 Avenue and Cairo Lane. This area is outside of the I-2A zoning district but west of 32 Avenue. Member Kelley said this is like all the others who wanted zoning change. He wanted to clear whether it is or not a vacant lot. Mr. Rodriguez responded that it is not and it's dated back to 2001. Member Kelley asked staff if it's vacant or not. Mr. Brown answered that he does not have that information but knows Mr. Rodriguez said there's a business and there must be a reason for him filing for a zoning change. Then he asked staff if they know if there is something on the property. Mr. Lee replied yes there is a business, a salvage yard. Member Kelley then requested that something be sent to the Commission from the Planning Council addressing how they are going to proceed with the 1-2 to I-2A because from here on there will be more applicants having to come into compliance with the way the code is situated. Mr. Brown said staff is recommending approval. He informed that there was an ordinance adopted in 2001 that clarifies procedures for this type of uses in any areas off 135 Street, 32 Avenue and 129 Street. The intent of the ordinance is to allow those types of businesses by conditional use. The applicant submitted an application for a rezoning to I-2A which if he gets rezoning it's less restrictive. Therefore, the staff is recommending that he be allowed to have a conditional use to operate with conditions, as numerated in the recommendations that are in the packages. It would be in consistence with 2001 guides from the commission. The Commission wanted to allow junkyards in close proximity from Cairo Lane. With a conditional use staff will be able to address certain things like off street parking, paved parking, permanent buildings, restrooms, etc. Chairman Russell then opened and closed public hearing. At the pre-application conference, the applicant may be represented by his or her land planner, engineer and/or surveyor. Zoning Requirements A property within the City's corporate limits that is being proposed for development must be properly zoned by the City prior to submission of an application for approval of any site plan. In addition, the proposed development layout or design shown on the proposed site plan must be in conformance with all standards and requirements prescribed in the City's Land Development Code City Ordinance No. 86-8 and Miami-Dade County Subdivision Regulations adopted by City Ordinance No Completeness of Application Site Plan applications which do not include all required information and materials, as outlined below and per other City policies which may change from time to time, will be considered incomplete, shall not be accepted for official submission by the City, and shall not be scheduled on a Planning Council agenda until the proper information is provided to City officials. Applicability Administrative Site plan review and approval shall be required for all nonresidential, mixed-use, townhouse, single-family attached and multi-family residential projects and structures and for any condition of special exception or conditional use as required by the Mayor and City Commission. Exceptions Site plan review shall not be required for single-family residential developments, unless the proposed subdivision will include a private amenity, facility or a golf course. In these instances, site plan submission and approval will be required for the private amenity or facility, or the golf course clubhouse/hospitality area. Site Plan Checklist The proposed site plan shall show the following information (other physical and engineering data shall be included in the engineering plans or as separate documents): m m m a o ce z a 1. Topography(contours at two-foot intervals)with existing drainage channels or creeks including the 100-year flood plain, if applicable 15. Any other important natural features, such as wetlands, wildlife habitats, and all substantial natural vegetation 16. Proposed strategies for tree preservation including showing individual trees or tree masses that will be preserved, and the techniques that will be used to protect them during construction 17. The layout and width (right-of-way lines and curb lines) of existing and proposed thoroughfares, collector streets and/or intersections, and specific configuration of proposed streets 18. Lot/tracts and blocks 19. Proposed driveways including driveway widths and distances between driveways 20. Proposed median openings and left turn lanes on future divided roadways and existing and planned driveways on the opposite side of divided roadways must also be shown for coordination and sharing of future median openings 21.
