AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN AN M-1 LIGHT INDUSTRIAL
DISTRICT, OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED DUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana,
as follows:
SECTION 1. As provided in Article 22, Section 22.01 and more speci-
fically provided in Article 48 of Ordinance No. 2325-1968, commonly
known as the Zoning Ordinance of the City of Richmond, Indiana, the
following described use of the following described real estate is
allowed as a Special Use for a Restaurant located at 815 Northwest
5th Street, in the City of Richmond, Indiana; more particularly described;
to wit:
TRACT I:
Part of the northwest quarter of Section Thirty-two
(32), Township fourteen (14), Range one (1) west,
containing 0.27 of an acre, bounded as follows:
Beginning at an iron pin in the County Road or West
Fifth Street in Richmond, Indiana, 1787 feet south
of the northwest corner of said section; thence
south 70 feet to an iron pin; thence east at right
angles 170 feet; thence north parallel with the
west line 70 feet; thence west 170 feet to the
beginning.
TRACT II:
A part of the northwest quarter of Section thirty-two
(32), Township fourteen (14), Range one (1) West,
bounded and described as follows, to wit:
Beginning at a point in West Fifth Street in the City
of Richmond said County and State at the southwest corner
of a lot formerly owned by Justus S. Clapp, running
thence south along said West Fifth Street 40 feet;
thence east parallel with south line of said Clapp's
lot 170 feet; thence north 40 feet to the southeast
corner of said Clapp's lot; thence west along the
south line of said Clapp's lot 170 feet to the place
of beginning.
ALSO, commencing at the southeast corner of above
described real estate running thence east 15 feet;
thence north 40 feet; thence west 15 feet to the
northeast corner of said above described real estate;
thence south 40 feet to the place of beginning, the
same being for purpose and use of an alley.
SECTION 2. WHEREAS, A study of this Ordinance was conduc`t^ed by the
Richmond City Plan Commission on the a� day of //_ 1
1977, at which time remonstrances were heard from all parties Interested
in or affected by this Ordinance, and;
WHEREAS, the vote of the Richmond City Plan Commission was to
b in favor of/opposad=to the passage of this Ordinance No.
3193-1977.

SECTION 3. As a condition of the aforesaid "Special Use" and as an addi-
tional restriction in said use, the following requirements shall hereafter
and at all times be met by the owner, leasee or any person, firm or corpora-
tion using such real estate:
SECTION 4. The Zoning Administrator of the City of Richmond, Indiana, is
hereby authorized and directed, upon enactment and publication of this
Ordinance, to record and approve the issuance of a permit for the estab-
lishment of the use herein allowed.
SECTION 5. This Ordinance shall be in full force and affect from and after
its passage and approval by the Mayor, and publication is by law required.
PASSED AND ADOPTED by the Commo ouncil of the City of Richmond, Indiana,
this 664 day of , 1977.

Re: Ordinance No. 3193-1977 - Plan Commission Case 77-5,
Albert M. Jackson requesting Special Use for a restaurant
in an M-1 Light Industrial District
Dear Mr. Carter, Members of the Council and Mrs. Trimble:
The Richmond City Plan Commission held a public hearing on Tuesday,
May 24, 1977, at 7:30 P.M. in the Council Chambers of the Richmond
Municipal Building to hear the request of Albert M. Jackson, repre-
sented by Robert O'Maley, asking for a Special Use for a restaurant
in an M-1 Light Industrial District for property located at 815
N.W. 5th Street.
There were no remonstrators in favor of or against this petition.
Eleven (11) letters had been sent to adjoining property owners and
no responses were received.
- It was the unanimous vote, nine (9) to zero (0), of the Plan Commission
to allow this Special Use in an M-1 Light Industrial District:
