HomeMy Public PortalAbout3195-1977- AMENDING ORDINANCE 2823-1973 WHICH ALLOWED SPECIAL USE FOR RESEDENTIAL PLANNED UNIT DEVELOPMENTORDINANCE NO. 3195-1977 AN ORDINANCE AMENDING ORDINANCE NO. 2823-1973, WHICH ALLOWED A "SPECIAL USE" FOR RESIDENTIAL PLANNED UNIT DEVELOPMENT IN AN R-2 SINGLE-FAMILY RESIDENTIAL DISTRICT, ADOPTED ON NOVEMBER 5, 1973. BE IT ORDAINED BY THE COMMON COUNCIL of the City of Richmond, Indiana, as follows: Section 1. WHEREAS, the final plan marked Exhibit B was adopted as part of the Ordinance and filed with the Department of City Planning and pro- vides for a 120' buffer area along the west boundary of the Country Club Apartments, and Section 2. WHEREAS, it is the intent and purpose hereof to alter those development plans to incorporate tennis courts within the 120' buffer zone pro- vided on the west boundary Section 3. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 24th day of May, 1977, at which time remonstrances were heard from all parties, interested or affected by this Ordinance, and Section 4. WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending this passage. NOW THEREFORE: Section 5. It is hereby ordained that Ordinance 2823-1973 be amended to allow the construction of a tennis court. Section 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Rose, Indianapolis; Agent Lawrence Simkins, Attorney, requesting to amend Special Use to allow the erection of one tennis court on the back portion of property located at 950 South 23rd Street Dear Mr. Carter, Members of the Council and Mrs. Trimble: The Richmond City Plan Commission held a public hearing on Tuesday, May 24, 1977, at 7:30 P.M. in the Council Chambers of the Richmond Municipal Building to hear the request of Irwin R. Roses represented. by Lawrence Simkins, asking to amend Special Use to allow the erec— tion of one tennis court on the back portion of property located at 950 South 23rd Street. All parties interested in or affected by this request were heard. No one spoke in favor of this request and four (4) persons were present who spoke in opposition. The Plan Commission voted seven (7) to two (2) to deny this peti- tion. Those voting in favor this petition were Commissioners Meredith and Webb.
