PROFESSIONAL SERVICE CONTRACT FOR LEGAL SERVICES
WHEREAS, there exists a need for professional services for the condemnation of
certain property in connection with development of the landfill contained in the
Landfill Reclamation District; and
WHEREAS, legal services are a professional service exempt from the requirement
of public bidding pursuant to NJSA. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that the cost of said professional
services shall be directly borne, pursuant to the attached letter, by Bellemead
Development Corporation which has been designated as the Redeveloper of the
Borough of Carteret Landfill Reclamation District by Ordinance No. 95-346.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Gary Platt, of the firm
Ullman, Furhman, Platt and Koy, at a maximum cost of not to exceed $50,000.00
billable per attached contract.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT IS FURTttER RESOLVED that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.

and certified as a true copy of the
original on July 9, 1997.

Dear Mayor Sica and
Members of the Borough Council:
This shall confirm that Bellemead Development Corporation,
heretofore designated the Redeveloper of the Carteret Borough
Landfill Reclamation District, hereby consents to the appointment
of Gary R. Platt, Esq. as special counsel to complete all legal
work associated with the condemnation actions to be undertaken in
conjunction with the development of the Landfill Reclamation
District. This shall further confirm that Bellemead Development
Corporation shall be responsible for payment of the legal and
appraisal fees and other reasonable and necessary fees and costs
associated with the aforesaid condemnation actions.
