HomeMy Public PortalAbout12-18 Rezone 2070 Lincoln Avenue 1St Reading: July 25, 2012 2m1 Reading: September 12, 2012 Public Hearing: September 12, 2012 Adopted: September 12, 2012 Effective Date: September 13, 2012 Sponsored by: City Manager ORDINANCE NO. 12-18 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, TO REZONE 2070 LINCOLN AVENUE (FOLIO NOS. 08-2122-003-570), OWNED BY MAGNOLIA NORTH APARTMENT, LLC, FROM R-2 (TWO-FAMILY) ZONING DISTRICT TO THE MAGNOLIA NORTH REDEVELOPMENT OVERLAY DISTRICT (MNRO), WITH SPECIAL EXCEPTIONS; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY AND CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Magnolia North Apartment, LLC has requested that the City Commission of the City of Opa-locka rezone the property located at 2070 Lincoln Avenue from R-2 (Two- Family) to the Magnolia North Redevelopment Overlay District (MNRO), with special exceptions; and WHEREAS, in order to obtain re-occupancy of the property, it is necessary to rezone the • property; and WHEREAS, the City Commission adopted the Magnolia North Redevelopment Overlay (MNRO) to assist in the redevelopment of Magnolia North; and WHEREAS, at its July 10, 2012 meeting, the Planning Council reviewed an application submitted by Magnolia North Apartment, LLC to rezone the subject property; and ORDINANCE NO. 12-18 WHEREAS, the Planning Council at its meeting on July 10, 2012, recommended approval of the rezoning application for the subject property to the MNRO, with special exceptions; and WHEREAS, the City Commission of the City of Opa-locka wishes to approve Magnolia North Apartment, LLC's request to rezone the subject property from R-2 (two-family) Zone to Magnolia North Redevelopment Overlay District(MNRO), with special exceptions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City Of Opa-Locka, hereby approves the request of Magnolia North Apartment, LLC to rezone 270 Lincoln Avenue (Folio No. 08-2122- 003-0570) from R-2 (two-family) Zone to Magnolia North Redevelopment Overlay District (MNRO), with the following special exceptions: 1. City's Land Development Regulations; special exception. • Reduce the number of required parking spaces from 20 to 17 • Increase density from 9 units to 12 • Reduce the minimum size of the 1 bedroom units to 410 square feet • Reduce the minimum size of the 2 bedroom units to 518 square feet • Reduce the minimum size of the 3 bedroom units to 792 square feet • Reduce the existing non-conforming east side building setback from 5 feet to 4 feet 8 inches. Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. V JJ ORDINANCE NO. 12-18 Section 4. SEVERABILITY. If any portion, section, phrase or clause of this Ordinance is held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. EFFECTIVE DATE. This Ordinance shall upon adoption, become effective immediately. Staff Summary: The subject property currently has a 12-unit apartment building sited on 2070 Lincoln Avenue. Rezoning of the subject property is necessary in order for this apartment building to be re- occupied. On October 12, 2011, as a result of a request from Commissioner Barbara Jordan, Opa-locka Community Development Corporation, and Habitat for Humanity, the Mayor and City Commission adopted the Magnolia North Overlay District (MNRO) to assist in the redevelopment of Magnolia North formerly known as the "Triangle." Earlier this year, the Mayor and City Commission approved two rezoning requests to the MNRO at 15050 Duval Street and 2060 Lincoln Avenue both located in Magnolia North. These rezoning requests were the first to take advantage of the MNRO. On June 8, 2012, there was a pre-conference meeting with the applicant, Magnolia North Apartments, LLC to review their rezoning application to rezone property from the R-2 (two-family) zoning district to the Magnolia North Redevelopment Overlay District. At that meeting, it was determined that the applicant controls the property at 2070 Lincoln Avenue, which is where the actual renovations/rehabilitation will occur. The other properties 2057 Washington Avenue and 14911 Duval Street assist in meeting setback and parking requirements for this project; however, they are currently not owned by Magnolia North Apartments LLC. On June 11, 2012, the applicant, submitted Planning Council application No. 12-071001 to request that the three properties identified be rezoned from R-2 (two-family) zoning district to the Magnolia North Redevelopment Overlay District with special exceptions. On July 10, 2012, the Planning Council held a special called meeting. After the Planning Council reviewed the rezoning request and received comments from city staff, the Planning Council recommended approval of the rezoning application to the MNRO with special exceptions. There was no noted opposition at the Planning Council meeting. Proposed Action: Planning Council recommends rezoning of the subject properties to the MNRO with special exceptions noted in the staff report dated June 19, 2012 subject to the following conditions: 1. 2057 Washington Avenue (folio no 08-2122-003-0780): subject property will be acquired by the Applicant within 9 months of City Commission action. 2. 14911 Duval Street ( folio no. 08-2122-003-0790): subject property will be acquired by the Applicant within 9 months of City Commission action. 3. Effect of Approval The approval of a site plan shall be effective for a period of twelve (12) months beyond the date that the plan was approved by the City Commission. If this is not accomplished, then the approved site plan shall be deemed to have expired and shall become null and void. Revisions to Approved Site Plan Minor Revisions/Amendments— It is recognized that final architectural and engineering design may necessitate minor changes in the approved site plan. In such cases, the City Manager, or his/her designee, shall have the authority to approve minor modifications to an approved site plan and which shall be submitted as an "amended site plan," which substantially conforms to the previously approved site plan, provided that such modifications do not significantly change traffic circulation, building location(s) on the site, proximity of building(s) to nearby residential areas, increase the size or height of building(s), or any other conditions specifically attached as part of the City Council's approval of the site plan. Submission materials and requirements for approval of an amended site plan shall be as determined by the City Manager or his/her designee. If the City Manager, or his/her designee, refuses to approve an amended site plan, then the applicant shall re-submit the amended site plan as a "revised site plan", whereupon the revised site plan shall be scheduled for consideration by the Planning Council and City Commission Major Revisions-- In the event of revisions that are more extensive in nature and do not conform to the description for minor amendments above, a "revised site plan" must be resubmitted, reviewed by the City Manager, or his/her designee, and reconsidered by the Planning Council and City Commission. Ordinance No. I t-17 NOW, THEREFORE, BE IT DULY.ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The Land Development Code of the City of Opa-locka, Ordinance 86-8, is • hereby amended to create the Magnolia North Redevelopment Overlay (MNRO) Ordinance, as follows: Magnolia North Redevelopment Overlay Ordinance A. Purpose and Intent 1. To encourage the revitalization of underused commercial and residential areas into pedestrian-oriented developments that provide a complementary mix of uses, including a variety of residential options, within convenient walking distance. 2. To encourage efficient land use and redevelopment plans forming a live-work-play environment that offers residents the opportunity to fulfill their daily activities with minimal use of single-occupant automobiles. 3. To encourage contiguous development and maximize land use allowing for increased use of alternative transportation modes such as bus transit, rail transit, ridesharing, bicycling, and walking. 4. To encourage formation of a well-designed, pedestrian-friendly activity center with commercial and residential development that increases choices for safe living environments for the citizens of the great City of Opa-locka. 5 To allow flexibility in development standards in order to encourage the design of innovative development projects that set high standards for landscaping, green space, urban design, and public amenities. 6. To promote a distinct, unified theme that will reinforce the branding process and improve the market attractiveness of the area for investments by the private and public sectors, 7. To provide the appropriate incentives to encourage reinvestment and renewal necessary to realize the potential of the 22nd Avenue and Magnolia North Subdivision, consistent with the City of Opa-tocka Comprehensive Plan, Ordinance No. 11-17 8. To encourage a design plan that improves public safety and security throughout Magnolia North. B. Applicability The provisions of this map apply to all parcels designated within the Magnolia Subdivision and portions of 22nd Avenue corridor, south of N W. 151st Street, and North of State Road 9 (EXHIBIT ATTACHED). The boundary of the district shall be shown on the Official Zoning map of the City of Opa-locka and all parcels contained within the zone, which meet the eligibility section below, are able to utilize the provisions set forth in this ordinance. All land uses and development, including but not limited to buildings, driveways, parking areas, streets, buffers, landscaping, and pedestrian / bicycle ways, shall be located and/or provided in accordance with the provisions of the City of Opa-locka Land Development Code and Miami- Dade County Subdivision, except as modified by this chapter. C. Eligibility Properties may use the MNRO ordinance if they meet the following criteria' I Can be served by public water and sewer 2. fdentitied in the applicability section 3 Have an R-1, R-2, 13-0, B-1, 13-2, or 1-1 zoning designation D. Relationship to Existing Zoning Districts The Developer of property that falls within the area covered by this ordinance may choose to develop his/her property using either standards of the underlying zoning district or the standards as set forth under this ordinance, If the Developer chooses to use the standards set forth in this ordinance, then the standards of this section shall take precedence over those of the underlying zoning district and other sections of the land development code. E. Exclusions The following activities shall he excluded from the use of the MNRO requirements and development review, although they may be reviewed under separate administrative procedures • • Ordinance No. 11-17 where noted in this section or in other sections of the city of Opa-locka Land Development or City Code of Ordinances. 0 Non Residential Properties - All lots/parcels that are zoned industrial, except 1-1 (limited Industrial), are excluded from this ordinance, but shall comply with the provisions set forth in other sections of the City of Opa-locka Land Development Code. Compliance with these provisions shall be verified through the building permit process. 8 Historic Properties - Properties that are contained or listed by the city now or in the future within a locally designated historic district are exempt from this ordinance, but shall comply with the land development code that pertains to the property. ® Restrictive Use Areas — This area excludes the construction of single.family and duplex dwellings. F. Permitted Uses 1 Mixed-use developments, provided that the subject property uses a mix of commercial and residential uses simultaneously 2. Accessory buildings and uses customarily incidental to any of the above permitted uses 3. Community Gardens and other public amenities 4. More than one principal use may be permitted on a lot of record, provided the use is a residential and commercial mixed-use and is utilized with administrative site plan approval. G. Principal Uses Permitted - Subject to Special Exceptions; The following uses may be permitted by the Planning Council subject to the conditions hereinafter imposed for each use, including the review and approval of the site plan by the Mayor and City Commission through its Planning Council in accordance with state public notification and hearing requirements. I• AN uses allowed under Magnolia North Redevelopment Overlay Ordinance a Uses permitted under section F shall also comply with the following • i. The Planning Council shall impose conditions on the operation of the proposed use including hours of• operation, outdoor operations and • • • Ordinance No. 11-17 delivery and shipping of material that is necessary to ensure the uses compatibility with surrounding areas, ii in proposed areas of the Magnolia North Redevelopment Overlay district, where residential and commercial predominate, any structural proposals for construction, redevelopment, rehabilitation, modification, or expansion, the exterior appearance shall remain consistent with the general character of the area, including scale and mass of the building, arrangement of windows, pitch of roof, and type of siding material. The Planning Council shall reduce the minimum number of parking spaces required for the property involving two or more uses if their parking demand is anticipated to overlap, H. Restrictive Uses — The area identified as a restrictive use on the attached exhibit is prohibited front constructing a single-family home or duplex. I. Area and Bulk Requirements: I. Uses shall comply with Article V, VI, VU, and VIII of the city's Land Development Code regarding height, minimum size of lot, the maximum density permitted, and providing minimum yard setback requirements for the underlying zoning district. 2. In addition, the Planning Council should recommend to the City Commission maximum front and street side lot line setbacks and minimum height requirements for any expansion, rehabilitation, redevelopment, or new development if they determine it is necessary to maintain the urban character of the neighborhood. 3. Where more than one principal use is allowed on a lot of record, setbacks between the buildings shall be based on the yard setbacks of the underlying zoning district, but may be modified by the City Coirunission if they are determine that adequate conditions have been included to address public health and adequate emergency access within the site. J. Standards 1. Any non-residential or residential zoned property within the Magnolia Subdivision recorded by subdivision plat or deed, using the proper municipal or county processes at that time, prior to July 27, 2011. is deemed a buildable lot for mixed-use Ordinance No 11-1 7 development, even though the lot may have less than the minimum area for any residential or non residential tones. Lots developed in this fashion shall use standards as set forth in this section, 2. Lot size and density - Lot size should not apply. Density shall not exceed fifteen (I5) dwelling units per acre. 3. Lot width - Minimum tot width shall not apply to parcels using this ordinance. 4. Building Height - Maximum building height should be 35' 5. Floor area - Minimum floor area shall be 1000 square feet per residential unit. 6. Building Coverage - Maximum lot coverage shall not apply to parcels using this ordinance. 7. Minimum front setback - No less than ten (10) feet. 8, Minimum side (major and minor) •setbacks - No less than five (5) feet or as determined by Florida Building Code. 9. Minimum Rear Setback - No less than fifteen (15) feet. K. Architectural Standards: While the city encourages that all new developments adhere to the Moorish architectural guidelines, all new development created under the MNRO may be exempt and shall have the option to include a number of minor design and site planning elements to ensure quality and compatibility with general housing trends within the city. L. Application Procedures All applicants submitting for development approval through the MNRO ordinance shall follow the following procedures: 1, An original and seventeen (17) copies of site plan, supplementary data, and architectural renderings, shall be submitted to the Community Development Department for review by all relevant city staff. Once staff has reviewed the information and deemed this information to be complete and in compliance with the standards set forth in this ordinance, the proposal and staff comments will be transmitted to the Mayor and City Commission for review. 2. The Mayor and City Commission shall review and approve, deny, or modify its approval through ordinance. Ordinance No. 11-17 3. Brown, Jr. Present were Chairman Calvin Russell, Member Elio Guerrero, and Member Joseph Kelly. Also present was City Attorney Oliver Gilbert III, Community Development Director Howard W. Brown, Jr. and City Planner Gerald J. Lee. Absent members were Steven Barrett & Lillie Odom. II INVOCATION AND PLEDGE: Member Joseph Kelly said the invocation and the Pledge of Allegiance followed. III APPROVAL OF MINUTES: June 14, 2012 Member Elio Guerrero made a motion to approve the minutes and Member Joseph Kelly seconded the motion. REQUEST: REZONE PROPERTY FROM R-2 TO THE MAGNOLIA NORTH REDEVELOPMENT OVERLAY DISTRICT. Page 1 of 10 Attorney Gilbert asked staff if there would be a swearing in of anyone who would be providing testimony for the first item. Mr. Brown asked the audience if anyone was present to give testimony or provide public comment to please raise their right hand. Mr. Willie Logan came forward and took the oath. Attorney Gilbert read the application information and request. Logan introduced himself as President of the Opa-locka Community Development Corporation (OLCDC), the parent company of a subsidiary that owns 4 apartment complexes in Magnolia North. He said last year, the Planning Council and City Commission passed legislation that allowed for building permits to be issued for structures that were in compliance with the allowed use. In order to pull permits the item above, the property would have to be rezoned. Logan said 15050 Duval and 2060 Lincoln Avenue have been rezoned; and he's here for 2070 Lincoln Avenue. He said 2070 Lincoln Avenue is an apartment complex that is being gutted and rehabilitated. He said that the remodeling would have fewer units in the building however, the additional units would be larger. There would also be a larger courtyard and parking area that would be relocated to the in front of the building with the exception of handicap parking. Chairman Russell asked if staff, council members, or the public had any questions. Member Kelly asked if Logan could specify the location. Logan told him it was 2070 Lincoln Avenue, where the unfortunate death of a child occurred in a drive by shooting. Kelly said that he was familiar with the location. Apparently, the lot size was 20,000 sq ft. and the plans are proposing 26,000 sq ft. He asked Logan how the extra square footage was going to be worked in. Logan said that the building had not changed. In terms of parking, the overall project included two additional lots that are on Washington Avenue that are currently owned by Habitat for Humanity. The County Commission is taking the property back from Habitat and deeding it to Opa-Locka CDC. There is a burnt down house in back of that building, and that lot is also part of this particular project which will be parking for the Community Gardens. Logan said that he's not here for rezoning of those 3 houses because OLCDC doesn't have the site control of those parcels. The current issue is the rezoning of the apartment complex which they have site control over. Logan said at this time he's trying to get building approval. Chairman Russell asked the panel if they had any more questions, and thanked Logan for his presentation. Russell asked staff if they had a recommendation they wanted to submit. Brown said that there were 3 parcels they were considering, and staff's recommendation is that all lots be rezoned, subject to property ownership, site control and other standards they've recommended. Russell said from what he understood, they were here to review one of the parcels and come back and review the other ones at a later date. Attorney Gilbert reminded the panel that the board has to consider the item(s) before them. The applicant is asking for rezoning. What's he's asking in this particular application is an approval for rezoning. Brown reiterated that staff is asking for an approval of rezoning with conditions listed. Lee stated that staff's recommendation is to rezone the entire site and make it a condition to obtain site control of the other two parcels within a certain time frame. If they don't comply within the time period, they would have to come back to the Council. Page 2 of 10 Kelly said we don't want to go too far ahead until the applicant is ready to move forward. He felt comfortable with the project as a whole because change was necessary. He supported the project as it continues to forward. He noted that he was hesitant in approving something that the applicant may not be ready to do immediately. He asked the staff, if the applicant asked to rezone 2070 Lincoln Avenue. Mr. Logan said that when he met staff, it was made clear to him because OLCDC didn't have site control; the only thing that they could rezone was 2070. Logan said he didn't understand and he apologized because he did receive the e-mail. Logan said regardless, he'd be happy either way to do 2070 Lincoln Avenue and would be elated if he could proceed with the conditional zoning. Logan stressed that his primary concern was that the NSP Money be used by February 2014, in order to complete the project regulations. In order to complete the project,building permits need to be pulled. Those are the issues that he'd like to get resolved today. Russell said that he felt comfortable and he would support it. Attorney Gilbert replied that he was uncomfortable with the board going beyond the application. Chairman Russell wanted to know if the Planning Council was indeed going beyond the scope of the application. Mr. Brown stated that the site plan submitted indicated three folio numbers; 08-2122-003-0570, 08-2122- 003-0790, 08-2122-003-0780. Member Kelly asked Chairman Russell why Council would go so far if the applicant wasn't ready to go that far into the project yet. He said that Logan was here for what he initially said. He doesn't have a problem with regard to what they're doing; they sent him an e-mail saying it can be done. Kelly's concern was not with Mr. Logan. His concern was with staff, and the Council as to why they were doing this with the conditional use attached. Kelly said he was not a huge fan of conditional use and the deliberations that come with conditional use. Kelly said we can approve and move to the next phase. We can bring it back and we can approve it at a later time. Kelly reviewed the last part of the staffs determination and followed staff's recommendation of what must be imposed, etc including the variances. He asked staff if part of the determination was including the variances on the parking, units, etc. Lee said without rezoning to this overlay, it would require all those things to be listed as variances. With the rezoning to the overlay, those variances become special exceptions and will then be approved as a part of the entire site plan. Kelly responded that he knew but it needed to be stated for the record. Chairman Russell asked if the folio numbers listed above were three lots that were included in Mr. Logan's application. Logan replied that they were in the application. Russell stated that he had staffs recommendation so he'll open up the forum for a public hearing. Russell opened the public hearing and invited members of the public to come forward. After no response, Russell closed the public hearing. Russell asked the attorney if they were going to open this matter for discussion or move it. Attorney Gilbert replied that he'd never seen it done quite this way before. With that said Gilbert let the panel know that it is still possible to do. Legally if they are listing it as a special condition, they are not rezoned until the condition is actually met and satisfied. So it probably can be done, however he would have preferred that they had site control first. He knew the project was time sensitive. If the board wishes to go forward, he wouldn't offer a legal impairment to that. Russell said the conditional use is based on the fact that Mr. Logan will attain permanent control over these lots. And if he doesn't then it will not be rezoned. Russell asked for a motion to approve with the conditions on this project so the project can move forward. Guerrero made a motion to approve with the special exception. Kelly was about to provide a second motion Page 3 of 10 however wanted to discuss some issues before doing so. Kelly stated that he was always leery of conditions and felt it set a bad precedence. Not necessarily for this project,but for others that are going to come down the road. He believes it can be done but feels that it isn't the best precedent to set. Kelly then said he'd support the item. Chairman Russell said he was trying to get these areas ready for revitalization. Russell felt that if anything good can come out that area he'd support it. Chairman Russell felt that"special exception"has been a way of our"Great City" to get things done. He felt that he'd help this project in any way move forward. Russell asked the members if they would provide a second after the discussion to move forward. Kelly gave a second motion. Attorney Gilbert stated to the Chair if staff could state for the record what the conditions were. He read the staff determination and he believes conditions 1 thru 6 were not actually all conditions; some of them were actually requirements. Gilbert noted that this was not clearly drawn out. He asked staff to specifically state for the record what the conditions are. Lee itemized the following conditions that would be imposed; 1. 2070 Lincoln Avenue building permits should be issued immediately upon zoning approval of the MNRO by the City Commission. 2. At 2057 Washington Avenue, the subject property will be acquired within 9 months of the City Commission action. 3. At address 14911 Duval Street subject property will be acquired within 9 months of the City Commission Action. 4. Once the developer or the applicant acquires site control and property ownership of 2057 Washington Avenue and 14911 Duval Street, the city may issue appropriate building permits. 5. The developer or application may request modification of any condition on or before the expiration date of the last City Commission action. 6. Unity of title will be required. Attorney Gilbert stated 1, 4, & 5 are not appropriate conditions. Gilbert made clear about what this board has the ability to do. Gilbert stated that staff cannot compel the building department to issue a building permit. They can assist in the removal any legal obstacles from issuing a building permit, but that's the end of their power. Gilbert suggested that 1, 4, & 5 and the rest which appropriately stem from this to be considered. 2070, the building permit#1 is clearly not a condition, #4 once the developer acquires site control over the property, 2057 Washington Avenue and 14911 Duval the city may issue may building permits again clearly not a condition. Number 5, the developer application may request if you're giving him he option to do something that's clearly not a condition that you are imposing for the requirement of something so. Just from a substantive standpoint, those need to be removed. Brown stated that he has no objection to it. Russell asked how we take them out of the conditional use. Are 1, 4, & 5 which are going to be stricken from the conditions of this proposal? Lee replied yes. Attorney Gilbert stated to Chairman Russell also Number 6 should definitely have unity of title,but it doesn't specify when unity of title is required. Chairman Russell said when you get complete control of the property. Attorney Gilbert stated unity of title is required within 6 months of obtaining control of the property. Russell reminded the panel that it was 9 months. Member Kelly said that in the future, he'd hope that we're going to do this that staff would get with the applicant to iron out these challenges beforehand. Chairman Russell commended the Community Development&Planning Department in putting forth effort to help revive this community. Russell said if we have to make corrections in the process we'll do that. That's the way we're all going to grown and learn Page 4 of 10 to operate and function. Russell asked members if they would make a motion to approve with special conditions removal 1, 4 & 5. Attorney Gilbert said that we've removed 1, 4, & 5 and amended 6, to read that unity of title will be required in 9 months of controlling the property. Russell asked if everything that's required after he's had 9 months after total access to the property. He asked the panel if it was necessary to make another motion. Kelly said since we're making substantive changes we have to make sure that the applicant doesn't have any problems with this either. The applicant agreed and Member Elio Guerrero made a motion to approve the item with new conditions and exception. Member Joseph Kelly seconded the motion with noted changes that the attorney made for the record. Upon roll call the minutes passed 3-0. Folio Numbers: 08-2128-007-0351 and 08-2128-007-0350. REQUEST: ZONING CHANGE FROM THE I-2 DISTRICT TO THE I-2A DISTRICT Chairman Russell asked applicant to introduce himself. The engineer who spoke on behalf of the applicant came forward and stated his name as Mr. Rodriguez, 6200 SW 67th Avenue. The owner, Henry Guerrero introduced himself. Rodriguez said that what you have before you is a zoning application to change the zoning from I-2 to I-2a district. It's at the end of Alexandria Drive on the southern end next to the canal. That entire area is either scrap metal yards or junkyards, and the proper zoning should be I-2. Rodriguez put together a proposal which he states meets all of the land use codes, the tree ordinances and parking regulations. Russell asked members if they had any questions on the rezoning. Kelly asked what was on the site as of now. Rodriguez replied that it was a used truck and junkyard where they dismantle trucks and sell the parts. He also noted that the location is surrounded by scrap metal yards and junk yards. Kelly asked if as of now the zoning for the area is I-2. Rodriguez said yes, and they're trying to take it from I-2 to I-2a. There is a move to for several of the business owners in the area to rezone the area into I-2a district,but we've been asked to come forward individually. Kelly said he understood but he wanted to clarify that the area in question was I-2. The applicant Page 5 of 10 replied yes. Kelly asked the applicant what they intended to do, did they want to remain in the property doing the current use. Russell replied that the applicant probably wanted to continue to do what they've been doing all along, now they want to formally comply with regulations. Russell said the Planning Council reviewed several items similar to these in September. He said the Council is trying to halt reviewing applications with special conditions. Rodriguez stated that the business does have occupational licenses with the county and state and that he has another property that has been rezoned to I-2a. The entire area is all junkyards, we're just trying to get in it order so when we go up to the city they'll request our occupational license again so there is no confusion. Russell said that the confusion already exists because you are operating in an area that is not properly zoned for the current use; this is about the 3rd or 4th request. Russell doesn't see the Council continuing to flip these areas to make it convenient for business. Rodriguez noted that there was an ordinance passed in 2001 that allows for all properties south of 135th Street, and west of 32nd Avenue to remain junkyards, salvages yards. Anything outside of that would be treated as not being in conformity with the surrounding areas. Rodriguez said the area has an ordinance already which is something we are trying to overcome. Kelly mentioned that one of these items came up previously. Kelly said that issues like these should be sent to the commission and they may deal with this however they like. He asserts that every so often, issues like these come up and it puts the Planning in a tough position. On one hand you have ordinances that say one thing and then you have the "will of the city" attempting to clean up the neighborhood. You have these businesses that are there and/or existing caught in the middle of this. It's putting the Planning Council in a tough predicament. Kelly said on several occasions, they've approved or denied an item and then when the Commission needs to make a decision on how they want to deal, it's a different story. Kelly wanted clarification if there has been legislation by the Commission with regard to junkyards, salvages yards,body shops, doing some kind of moratorium. Mr. Brown replied that it passed on first reading it's going on second reading. Attorney Gilbert said the first thing is that it did past from first reading. The fact that they have an occupational license is of no real consequence to this body. Occupational licenses,business tax receipts issued in error or incorrectly, do not bind you to allow you to continue that use. I believe that is recommended by staff is that the entire zoning to be changed. They are requesting that the entire zoning of that area being changed. Staff is recommending denial of that request. The use needs to be a continued use as a"conditional use", allowed through an ordinance that the Commission did pass. They allowed this use to be accepted as a conditional use with certain criteria. That's what's before this board currently. Now whether you want to prove it as a conditional use is a decision made by the board. Kelly told the applicant that it put the unfamiliar unwanted discomfort on this board because they don't know the direction the Commission is going to determine the allowance of conditional use, however your real intention was to rezone. With that said, don't want to go forward with that. Then we have to have more meetings, special meetings because the Commissioner says take it back because we went something down they want to see. You won't have those problems. Rodriguez said he understood the ones that we passed in September have still not been heard by the Commission. He asserted that due process allowed us 30 days and that is an ongoing issue that the owners have taken up with an attorney. Hopefully it's going get resolved. We're here because it was put on the agenda; unfortunately I did not receive notice until yesterday. We're Page 6 of 10 here hopefully to pass since the other 4 have been passed. I don't know if it will ever get to the Commission. Hopefully, it'll be settled with the City. I don't know maybe it'll work; I can't speak for the other owners. Russell said this board supposedly works hand with hand with the city commissioners. Kelly stated that he was not in favor of rezoning. We need to get a clarification what the Commission envisions for this whole issue. Some of it deals with conditional use, however what's being done here is rezoning which would change the whole scope and I wouldn't be in favor of that. We need to get some kind of definitive answer of with the city and Commission plans to do with those kinds of problems. Kelly reiterated that he wouldn't be in favor of rezoning. The bigger question is to get some kind of definitive determination of what the city wants to do with this whole issue. Their request is rezoning. It's not just to get a conditional approval to do what they've done in the past. Their request is rezoning. Russell asked staff what their recommendation was. Brown said the application is for rezoning from an 1-2 to an I-2a district. He said staff's recommendation was a denial. The applicant is talking about previous applications that the board approved rezoning 1-2a. Currently, our city attorney's office and the attorney for the applicant are negotiation a conditional land use change to exactly what staff is recommending in their packet. Our recommendation is what it is conditional land use change. The applicant knows our recommendation and has known it for a while. We're waiting for his attorney to amend the application and some other things. We haven't heard anything back of yet. Elio Guerrero suggested if the tabling of the item be more appropriate? Brown replied that if you make a decision that is a denial, there is a time period in which it can come back. If that's what they want to do, or if you let the applicant talk to you about what he'd like to do that's fine. Our recommendation speaks for itself. Russell stated that he can't support the rezoning, due to all of the uncertainty with what's going on. Brown said the applicant's attorney has been speaking with our city attorney Joseph Geller and has been working with him through in's and outs about the land use changes and what the conditions would be; he's been part of those negotiations but cannot elaborate further. Russell said that's why he wanted to know what's before us today. Rodriguez said the attorney was hired by the 4 owners that were approved by the planning board. They came for zoning change because they received violations for the current property use and were told that they were unable to renewal their occupational licenses. Some of these properties already had a conditional use since 2001. Their attorney took the city to court, and the property was approved for the use. However applicant claim's they are still received fines in lieu of violations. What the owners are saying is why are we getting violations if we are in compliance where 1 out of 4 was in compliance? The applicant said that they wanted to eliminate the confusion the best way they knew how, and the best way would be to request for a rezoning. Rodriguez said that this Planning Council and commission have done so in the past for several other properties and he's request that they eliminate the confusion with the I-2, and I-2a districts considering the city has already embraced the use. Chairman Russell said to the applicant that applicants who are granted a"conditional use" are required to come back to the board every 2 years to be reheard. He informed the applicant that the last one we had it was a scrap yard,but we didn't approve that applicant to continue to operate their junkyard. The applicant asked the Council of they would be able to table the item it if possible for the next month or 2 months down the line. Page 7 of 10 Attorney Gilbert said that he doesn't know why the issue was even brought to the Planning Council considering the applicant's attorney and city attorney are with staff are in negotiations. He doesn't understand how negotiation issue came up. They can either remove the structures altogether or seek appropriate variances through the zoning board of appeals. They remove any stature that is violation of setback requirements and/or obtain appropriate setback variances through the zoning board of appeals. As a practical matter, they would have to do that any as a requirement, not a condition but they would be following the law. Russell responded that due to the uncertainties he couldn't support it tonight. As far as the setback,he'd be willing to sit with staff and table it to the next Planning Council meeting in the next 60 days. Russell called for a public hearing for the item. After no response, Russell closed the hearing. Kelly said that he's uncertain about the issue but would like the Commission; otherwise it's going to keep coming back to us. Staff would approve the automotive salvage part with conditions. Lee said the properties around the site are either junkyards or salvage yards. Kelly asked staff if the other ones that have come before the Council have been coming to get the conditional use etc. Lee replied yes, the Commission in 2001 and they didn't want to have the continuation of what you see on there. Kelly said that they really didn't have a total,but the idea was to have to put all those types of businesses in one place. Unfortunately, that didn't happen because you see them all over the city. Brown recommended that the 4 applications we're talking about have been the ones we have been discussing. This one came later and it is related. His recommendation was to table the item till September 4th, which will give the city attorney, the new city manager, staff, the applicant and his council, and the developer time to draft some recommendation and come back Elio Guerrero, made the motion to table to the next Planning Council Meeting, Kelly seconded that motion. He noted it'll give the Commission time to discuss and to deliberate how they are going to address items such as them. Kelly said he I don't want to see any of these. APPLICANT NAME: OPA-LOCKA COMMUNITY DEVELOPMENT CORPORATION ADDRESS: 2121 NW 135TH STREET,OPA-LOCKA FLORIDA 33054 REQUEST: THE CITY OF OPA-LOCKA COMMUNITY CHALLENGE GRANT 2011 PRESENTATION BY OPA-LOCKA COMMUNITY DEVELOPMENT CORPORATION. Page 8 of 10 Willie Logan came up before the panel to present the Opa-locka CDC Community Challenge Grant. He introduced the project that he was working on. The project included a new comprehensive plan new, new zoning laws, and land use laws. The project involves collaboration with the city and the OLCDC to apply for a challenge grant administered by HUD for the city to do what it just stated. The grant will help to provide for resources to what is necessary to make legislative improvements for the city such as amending and rewriting land use laws, zoning regulations and development a new comprehensive plan. To carry our various tasks as funding is necessary. Consultants will help to carry out concerns with the grant. They Deliverable date have been met. The Downtown Design Charette has been completed. Other reports that have been drafted will meet deadlines such as the conditions report, economic strategy report, the Zoning Analysis Report and the housing strategy report. All four of those reports will be complete before the September 16th Due date. Kelly asked if the reports that have already completed and the deliverables have been delivered. Logan responded no and that the only one that has been delivered has been the Downtown Charette, the others are in draft form. They're not due until September/October 2012. When this is all said and done the city will have modern zoning and land use codes, ordinances that will help to develop the city. V. OTHER BUSINESS—STAFF UPDATE No other business was discussed. NW 22nd Avenue Truck Traffic Projections • Traffic Analysis for Magnolia North Apartments 2070 Lincoln Avenue June 2012 Narrative Summary Current Traffic Data: The attached FOOT Florida Online Daily Traffic and Truck Traffic Maps show that SR9 and NW 22nd Avenue are the nearest roads to the proposed rehabilitation of the 12-unit apartment building at 2070 Lincoln Avenue that have sufficient traffic for FOOT to track the traffic data. Traffic data for smaller roads is not currently available. 10-Year Traffic Projections: SRS: The FDOT Florida Traffic trend for the past ten years was examined to calculate traffic projections using the FDOT traffic projection template that incorporates the formulas used by FDOT to calculate traffic volumes and projections. The attached ten year traffic history for Passenger Vehicles on SR9 shows slight increases and decreases over the past ten-year period resulting in overall passenger traffic declining at an annual rate of a negative 1.32%. The projections for the next ten and twenty years show a continued passenger traffic decline. Truck traffic projections, however, show traffic remaining relatively stable over the past ten years with a modest average annual increase of 1.05%. The projections result in a projected modest increase in truck traffic on SR9 over the next ten and twenty-year periods. Mil 22nd Avenue: Again, the FDOT Florida Traffic trend for the past ten years was examined to calculate traffic projections using the FOOT traffic projection template that incorporates the formulas used by FDOT to calculate traffic volumes and projections.
