inspecting for drainage plan compliance based on the plans that were 5upplied to u5 by the

Based on the limited information on the plans and after a brief in5pection of the project, it

including final Stabilization in the form of sod.
The 5wale5 which are in place on the east and west 5005 are only half formed and are
centered on the property llne5 and the intent 15 to complete the 5wale5 when the adjacent

I wanted to snake you aware of a situation concerning a subdivision off of South
Campbell where the goals of tree preservation and stolmwater management have become in
conflict. The lots in the subdivision are on White Oak Lane and River Oak Lane.
The subdivision was approved in the Fall of 2004 and the minutes from September 9,
2004 and October 14, 2004 indicate that the developer at the time, Mr. Keitzman, was willing to
make concessions with respect to curving drainage lines and driveways in order to preserve trees.
While some of that may have been accomplished, when the economic problems impacted
development, some changes in ownership and other developments occurred. Now there are lots
that have been individually platted and an overall drainage plan was apparently not completely
installed. Downer Davis did not get involved in this process until pretty much after the fact
when the lots were already subdivided and the confusing plans by the original engineer, Mr.
Millikan, make interpretations of the plans showing compliance difficult, if not impossible.
Further, it is my understanding that the subdivision preceded the as -built requirements.
In any event, some lots are ready to be developed; however, problems have arisen with
implementing appropriate drainage on the property due to the presence of trees. There are three
trees on or near one particular lot that will have to be removed in order for the drainage to work
to be accomplished and there is insufficient room for curving the drainage lines or lanes. Under
these circumstances, I feel there is virtually no opportunity for preservation of the trees in
question.

As far as 1 know, the suggestions by council members dealing with preserving trees were
not directed to any particular trees on a plat. At least there is no record of such a designation of
which I am aware. It could be that on the particular lots in question, all efforts have been made
to preserve the trees but, under the circumstances, I do not believe the City could deny the
removal of the trees in light of the City insisting upon the implementation of appropriate
drainage.
I will be glad to discuss this with anyone. I did, however, want to let you know that the
issue has come up so that if trees were being cut, you would be aware of the situation and could
respond to questions with at least some explanation.

the reports. He said he plans on addressing the most critical items first and intends on reducing

Buelterman opened the meeting, asked for comments an ccs losed-the following public hearings
according to law.
Dick Smith, Chairman of the Planning Commission, presented a request for preliminary approval
for a major subdivision for Lots 6 & 7 to be divided into 8 single-family lots on S. Campbell
Avenue, PIN 4-0019-04-002, for Louis Keitzman. Smith said the application complies with all
requirements, the City engineer has approved the drainage plan and no variances are being
requested. Smith said PC approved the request after asking for additional information 3 times.
Sessions said she was confused regarding all of the different letters that she had received
concerning the approval of the drainage plans. Downer Davis, Engineer for the City, said there
had been concerns, which have been addressed, and the final approval letter was sent yesterday.
Sessions asked if the plans she had been given today had all the revisions. Davis answered yes,
the letter dated August 12th states that all of the concerns have been addressed. Pearce asked
Davis if he had any further concerns, and Davis said from an engineering standpoint, in his
opinion, there are no further concerns. Harold Yellin, speaking for the petitioner, said Bob
Millikan, engineer on the project was also here. Yellin said this request is to subdivide Lots 6 &
7 into 8 lots, it is in a R2 Zone, where the minimum lot size requirement is 4500 sq. ft. He said
the petitioner is asking for no variance and has made several changes to satisfy the concerns of
the Planning Commission. He said all of the lots are 60 feet wide, the roadway has been
increased to 18 feet wide, a fire hydrant has been added for safety reasons and we feel we have
met all of the concerns. Yellin said there are rumors that this area will be changed from R2 and
also that lot sizes might be increased. He said that is certainly in Council' s power, but this
petition is governed by what is on the books now. Sessions asked why are there requests for 2
subdivisions. Yellin said that combining the request was never an issue, and that Mr. Keitzman
wanted 2 different subdivisions. Yellin said when they come back with the final plat, the issues
of subdivision names and trees will be addressed. Sessions asked if Council could require that
information now, and Hughes said they were asking for a preliminary plan approval and not final
plat to be recorded. Rachel Perkins read from a memo she had written regarding concern for the
trees that would be lost in the plan that was presented. (Copy of this memo becomes a part of
these minutes.) Mayor Pro Tem Buelterman broke into the proceedings for a weather
update from the Fire Chief. Chief Sasser said the weather was getting worse and he
recommended that the meeting be adjourned and everyone goes home. Hughes said we
had advertised public hearings and if there was any way to complete them, he would advise
Council to do that. Sessions motioned to finish all of the public hearings and adjourn.
There was no second. There was some discussion as to adjourn or not. Crone motioned to
stay, Sessions seconded. Vote was 4, Wolff, Sessions, Crone and Pearce, in favor, and 2,
Buelterman and Youmans, opposed. Bob Millikan, engineer for the project, answered
concerns raised by Perkins and said they would redirect the drainage swales to save as many tree
as possible. Wyman Sharpe said he owned 5 lots on S. Campbell Avenue and had no objections
to the subdivision. Mr. Cantrell, Rusty Fleetwood, Denise Butler, a letter from Ruth VerBott, a
letter from Gail Brown, Roxanne Fleetwood, Sandy Major, Bill Walsh, and Dr. Jim Porter, all
residents who own property on S. Campbell Avenue, opposed the subdivision. These neighbors

raised concerns of density, water and sewer issues, marsh pollution, traffic, quality of life, as
well as some other issues. Shell Solomon spoke in favor. Sessions raised a concern of these
single-family homes being rented to as many as 20 people each.. Hughes said there is no
ordinance now but one is in the works to limit and control rental property in residential zones.
Most of the residents asked Council to table the petition for further study on the drainage,
pollution issues and density.
Smith presented the next request for a major subdivision for Louis Keitzman and James Stettler
for Lots 7 & 8 S. Campbell Avenue, PIN 4-0019-04-003, to be divided into 7 lots. Smith said all
of the requirements have been met and no variances are requested. He said the PC voted to
approve. It was noted that the comments heard on the previous request apply to this request as
well. Sarah Porter, who said she lives across the street, requested to speak to Council. Porter
said the garbage truck would not go down the private street and she did not want to see 15
garbage cans lined up directly across the street from her home. She also cited drainage as a
potential problem. Harold Yellin said the street is wide enough for the garbage truck, as well as
emergency vehicles, to drive on. Yellin asked Council to listen to the facts and not to fiction.
Keitzman said that several people, who were in favor of the subdivision, had left because of the
weather. Kathryn Williams also spoke against the subdivision.
Smith presented a request for a sketch plan approval for a major subdivision to divide 4 lots into
6 single-family lots for Jones Cottages LLC. at 1009 & 1011 Jones Avenue, PIN 4-0006-11-011
& 4-0006-11-012. Smith said that the petitioner had asked that this be changed to a preliminary
plan approval, which is how it was advertised. Smith said there are no variances requested and
the engineer has approved the drainage plan. He said the PC approved the request. Sessions
questioned the 10 ft. setback fronting Jones Avenue. Smith said this was the side setback and
that the front would be facing the access easement and the 20 ft. front setback would be located
there. Sessions had concerns regarding only having 10 feet next to a busy street, Jones Avenue.
Smith said the PC had a lot of discussion regarding this same issue and the zoning staff said the
front could be facing the lane. Smith also said the City just had a court case about this same
issue. Hughes said that as the Code is now, the property owner could declare his front for
setback reasons in the subdivision design. Sessions asked about safety and Hughes said safety
could be taken into consideration in the decision. Wolff said he thought the intent was for new
subdivisions and not established neighborhoods. Youmans said even in new subdivisions, 20
feet would taken off of 2 sides of the property, and in some zones another 20 feet would come
off the back. Youmans said this would leave very little of a lot left to build on. Richard
Guerrard, the property owner, said he was advised by the Zoning Department of what was
required and that is why this plan was done this way. Pearce asked Guerrard was aware that Lot
108 was wetlands, and Guerrard replied yes. Guerrard said he purchased that lot in order have
enough square footage to subdivide and meet the lot size requirement. Pearce said that the DNR
delineation line is missing and that State law, under the Sediment and Erosion Act, requires a 25
ft. setback or buffer. Guerrard said that you could canter -lever over the buffer. The footprint of
the house on the plat is not the actual footprint. Buelterman asked Dee Anderson to address this
issue. Anderson said the subdivision plat has to show the setback line and the EPD buffer line.
The construction plans actually show the footprint of the structure, with the delineation lines.
Guerrard said that you could set pilings inside the buffer if you do it by the EPD regulations.
Sessions asked if Davis, City Engineer, had approved the drainage plans, and Anderson said yes,

Mayor Pro Tem called the meeting back to order, and opened the meeting for business legally
presented.
Hughes told Council that they had before them the ordinances that control the subdivision
process and the approval of subdivisions. Hughes said those would be considered in making the
decisions regarding subdivisions. He said that the ordinance regarding variances, as well, should
be considered.
Wolff said that based on Sections 10-080, 7-035 and 5-040, he would motion to table this
petition for a major subdivision of Lots 6 & 7 S. Campbell Avenue for Mr. Keitzman, pending
further study of the water issues, significant trees and drainage. Sessions seconded the motion to
table. Youmans said we are paying good money to an engineer to study these things and he has
said these things are all right. Youmans said if we are not going to listen to him, he recommends
we not use him any longer. Pearce asked if Wolff was referring to Rachel Perkins' s issue with
the trees. Wolff said yes and that the ordinance states that reasonable effort should be made to
preserve the large trees. Wolff said that he also would like to suggest that Mr. Keitzman
consider combining these 2 subdivisions and put in a horseshoe road, thereby saving more trees.
Vote was 4, Wolff, Sessions, Buelterman and Pearce, in favor, and 2, Youmans and Crone,
opposed. Pearce said he thought that this petition met all of the requirements but he wanted to
make sure the issues mentioned in the motion, which pertain to the density, is done right.
Wolff motioned to table the petition for a major subdivision of Lots 8 & 9 S. Campbell Avenue
for Mr. Keitzman for the same reasons as in the previous petition. Sessions seconded the motion
to table. Youmans said he states the same discussion as he did previously. Vote was 4, Wolff,
Sessions, Buelterman and Pearce, in favor, and 2, Youmans and Crone, opposed.
Dick Smith, Chairman of the Planning Commission, asked Council if they were sending these
petitions back to the Planning Commission. Buelterman said it would come back to Council.
Wolff said he was not trying to delay this any longer than necessary.
Pearce motioned to table the major subdivision for Jones Cottages, Inc. at 1009 & 1011 Jones
Avenue because of the unresolved issue of the wetlands and he would like to have the most
recent plans so he could study the drainage ditch that crosses the property. Wolff seconded the
motion to table. Youmans said the engineer and the Planning Commission said everything was
fine. Sessions said she was not sure of the reasons for tabling. Pearce the wetlands issue had not
been addressed and a new set of plans was presented tonight. He said he felt that he needed
more time to look at the most recent plans. Sessions said she thought this was an issue where
Davis expertise came into play and asked him to address the wetlands issue. Davis said he had
spoken with DNR and looked at the plans very carefully. Davis said that DNR said you could
canter lever over the buffer and if the builder wanted to put in pilings, DNR, in all probability,
would approve it. Davis said, in his opinion, the plan meets the requirements. Pearce said he
was concerned about the DNR delineation line and that it had not been marked. Davis said it
was shown on the plans. Pearce said no flags were on the property delineating the line and he
spoke with the person who does this and she said she had not delineated the property. Mr.
Guerrard said she had and the flags were there, and that she may have been referring to the lot

property management companies. Gay said that all of the rental agencies that he knows of
have parking requirements in their agreements. He said some of the rental properties, not
handled by agencies but by the owners, do not have requirements, do not pay hotel/motel
taxes. He said if this were passed, who would enforce, will it be based on complaints, what
would the penalty be and who would pay the fine, the owner or the agency. Hughes said it
would be based on who the violator is. Gay said he agrees that parking is a problem but there
has to be another solution. Gay said he is against placing another unenforceable law on the
books. Henry Levy said that he has had problems in the past at his residence with cars
parking everywhere. He said some of the owners couldn' t even get to their residences
because of renter' s vehicles blocking the drive. Stacye Smith said that all of us love Tybee.
She said if anyone has a problem with one of her renters to please call her. Smith said part of
the problem is that the City did not require adequate parking when building permits were
issued. She said as a property manager, she takes pride in providing adequate amenities to
her renters. John Major said if anyone has a problem, they should call the agent. He asked if
they were supposed to get rid of bedrooms so they would have enough parking. Pam O'
Brien said that she thought legislation was not the answer to the parking problem.
Smith said that City Council had asked the Planning Commission to consider the pros and
cons of rezoning South Campbell Avenue from R2 to RIB. He said the PC was asked to
recommend whether to go forward with this action. Smith said they had discussed this issue
thoroughly, listened to residents, both of S. Campbell and other parts of the Island. He said
the PC recommends that City Council take the appropriate action that they feel is warranted.
Pearce asked Smith when the Planning Commission would make a proposal in regards to the
Growth Control Ordinance that they have had for some time. Smith said the PC hopes to
make a recommendation at the next meeting. Smith said they have asked repeatedly for
information from the City and have not yet received that information. Smith said they have
asked for the number of buildable lots on Tybee. Smith said he hopes that information would
be available at the agenda meeting Monday night.
Mayor Parker said that additional information was requested at the last meeting on several
requests and he would like to hear those issues at this time.
The first of these is 2 major subdivisions for Lots 6,7,8 & 9 S. Campbell Avenue for Mr.
Keitzman. Harold Yellin, Agent, spoke to Council and said the changes and issues Council
had, have all been addressed. He said they had redesigned the drainage to save more trees,
and Davis Engineering has written a letter approving the plans. Yellin said no variances were
being requested. Pearce asked if they would be willing to curve some of the drainage lines
and driveways to preserve more trees. Yellin said absolutely, they would. Rusty Fleetwood
said the issue here was density. He said there would be 8 lots on 1 of the subdivisions and 7
lots on the other. He said that issue still exists. Rachel Perkins said the plans show 2
drainage ditches side by side on the 2 subdivisions and asked why couldn' t they be combined
into 1 to serve both subdivisions. She also suggested that the required number of trees per lot
be upheld and mitigation is by lot. Several residents spoke in support of subdivisions.
Roxanne Fleetwood spoke in opposition. Pearce asked if the developer would be willing to
mitigate on a lot -by -lot basis, and Mr. Keitzman agreed. Sessions said that for the record and
to answer Shell Solomon' s statement that Keitzman was asked to provide more than anyone
else in his subdivision request, that a recent request on Bay & Byers was sent back several
times.

firm would address that in their study and whomever is interested, could work with them on
this issue. Youmans motioned to deny the proposed Text Amendment for parking
requirements for rental property, Buelterman seconded. Buelterman said he would like for
the planning firm to look into this and come back with some proposals. Buelterman asked
what a citizen could do if someone parks on their property or blocks their access to their
property. Chief Price said they could call the police and have the car towed. Parker said
for anyone interested in working with the planning firm, to get their name to him. Pearce
said he acknowledges the problem and thinks that we need some kind of ordinance, but not
necessarily this one. Vote was unanimous to deny the amendment.
Pearce motioned for approval for the major subdivision of Lots 6 & 7 S. Campbell Avenue
contingent on the developer working with staff to improve plans to save as many trees as
possible and curving the drainage lines, Buelterman seconded. Wolff said he still thought
this should be done as 1 major subdivision. Youmans said he had talked with some of the
neighbors and they were happy that the lots would be 4500 square feet for single-family
and not any larger for duplexes. Pearce said he still had some density concerns but under
current ordinances could not vote to deny. Vote was 4, Youmans, Buelterman, Crone and
Pearce, in favor, and 2, Wolff and Sessions, opposed.
Crone motioned for approval for the major subdivision of Lots 8 & 9 S. Campbell Avenue
with the same contingency as in the previous request, Buelterman seconded. Vote was 4,
Youmans, Buelterman, Crone and Pearce, in favor, and 2, Wolff and Sessions, opposed.
Crone motioned for approval of the major subdivision at 1009 and 1011 Jones Avenue,
Buelterman seconded. Buelterman said his concern was the issue of 10 feet from Jones
Avenue. Buelterman said we couldn' t force this on Mr. Guerrard but we could change the
ordinance to reflect if the property is on a well -traveled street, 20 feet is required. Sessions
said she thought the intent of the Code is a matter of interpretation. Vote was 3, Youmans,
Buelterman and Crone, in favor, and 3, Wolff, Sessions and Pearce, opposed. Mayor
Parker voted in favor and broke the tie vote.
Crone motioned for approval of the variance for Holloway and Vining at 5 2nd Place,
Buelterman seconded. Vote was unanimous.
Sessions asked how the noise ordinance is enforced now and how we could keep the noise
more contained. She said she had talked with several residents who voiced concerns about
this on Highway 80 and Butler Avenue. Chief Price said they enforce the ordinance against
loud music and that doesn' t seem to be a problem. He said they are ticketing speeders and
will continue to enforce the speed limit.
Chief Price said he would like to address the golf cart issue. He said he is afraid this would
open up a lot of problems. He said he would like to only allow the carts from sun -up to
sundown. Hughes said that restriction has been added to the ordinance. Hughes said that
signs, stating what the regulations are, have to be put in place. Price said when people
come in for the permit, they would be given a copy of the ordinance, read it and sign,
stating that they have read the ordinance, so that they would know what the rules are.
Parker asked what designates a handicap decal. Price said he is going by Georgia State
Law and the people would have to go to the driver' s license office to get one. That would
have to be shown when they apply for a golf cart permit. He said this permit is a lot more
restrictive than a handicap -parking permit. Hughes said there is a State law that designates
who can get a handicap drivers license.

The issue of the skate park was also postponed.

Sessions said she attended a meeting to discuss the establishment of a Cultural Affairs Committee.
Sessions motioned to approve a list of people (this list is attached and becomes a part of these minutes)
who attended the meeting, to become members of this committee. She said they would elect officers and
bring recommendations to Council. Sessions read the list of nominees and they are: Maria Watts, Bonnie
Kaar, Bob Hearn, Jack Boylston, Paul DeVivo, Sonjia Dittmar, Susie Morris, Amy Gaster, Cullen
Chambers, L. F. Rumpel, Joe Roachfort, Bob Thomson, Claire Price, Paul Wolff, Jason Buelterman, and
Shirley Sessions. Wolff motioned to establish this committee and appoint the people named, Pearce
seconded. Youmans said we had people from many cultures on the Island and we need people from all of
these cultures on this committee. Sessions said everyone is encouraged to participate, and asked everyone

Crone motioned for approval of the subdivision for lots 5 & 7 South Campbell Avenue for Louis
Keitzman, Youmans seconded. Pearce asked that Mr. Keitzman take care in the development around the
drip line of the trees. Vote was 4, Wolff, Youmans, Crone, and Pearce, in favor, and 1, Sessions,
opposed.
Crone motioned for approval of the subdivision for lots 8 & 9 South Campbell Avenue for Louis
Keitzman, Youmans seconded. Vote was 4, Wolff, Youmans, Crone, and Pearce, in favor, and 1,
Sessions, opposed.
Pearce said Mr. Rhangos is considering applying for a land trust and has applied for a permit. Pearce said
this discussion is premature as he has not been given the permit.
Pearce said the requirements for tree removal mitigation has a cap of $1500.00. Pearce said he would
motion that this be sent to the Planning Commission to consider that this fee if for every lot in
subdivisions and not the entire subdivision. Hughes said it doesn' t have to go to the Planning
Commission nor does it need a public hearing. He said the fee is not part of the ordinance, but this falls
under the resolution we have with the RDC. Hughes said you have to have 1" and 2nd readings if it is
going to be part of an ordinance. Hughes said hopefully the RDC would have their recommendations
soon. Hughes said he would prefer that the mitigation be put in as an ordinance. He said there has been a
lot of confusion over the mitigation fees and fines, and it should be clarified. Hughes said fines are the
courts' department and not the zoning department' s.
Wolff said he appreciated everyone' s patience regarding recycling and thanked everyone for
participating. Wolff said we are currently out of bins but items may be placed in any type of container
and they will pick it up.
Parker asked who had the authority to name new streets. Hughes said if it were a City street, the City
would name it. He said if it is a subdivision, the developer names the streets and it is part of the
specifications on the plat.
Wolff said he would like to propose a real estate transfer fee to be used to acquire green space. Wolff
said he had a letter from the metro Atlanta mayors stating they are doing a similar resolution, asking for

Mike's plans show the side swales conforming to the 1' depth & with 5:1
side slopes, but not the rear ditch/swale. Milikan's plans call for both to be
the same. We can bend on the side not being quite that deep, but not the
rear.
Also, Mike's included a part of the drainage plan that shows the trees
overlaid. He hasn't provided the drainage plan that showed the design
Swale inverts. You and I identified the correct one in your office.
To end this cycle, I offer the following thought. The subdivision design is
still in effect until Tybee approves changes. Tybee could advise Mike
Sharpe that he's entitled to a permit using the drainage plan currently in
effect for this subdivision. Datum change to '88 shouldn't be a big issue
but it'd be best if an engineer provided the conversions.
I concur with the E&S design except for the absence of sediment barrier
across the front. I previously overlooked the front not having sediment
barrier from the corners to the construction exit. As Bruce will be
inspecting this, if he's ok with a markup on the plans, that's fine with me.

I offer the following comments on the E&S and grading plans.
I concur with the E&S portion.
The drainage design is not accepted. As shown on the 2nd sheet of
Michael's plans set (Millikan's design on which the subdivision permit was
issued), the subdivision was designed and permitted under the condition
that there be a rear lot ditch extending from South Campbell eastward to
the marsh / tidal waters. This ditch was never fully installed.
Michael, the Engineer & Owner, proposes a drainage plan on ST -5 that
appears to be of the same drainage pattern, but with less detail than
L
Millikan's other than to show a shallower rear ditch. You will have to
refer to other sheets of Millikan's to see that the rear ditch was deeper.
If a drainage pattern other than Millikan's is to be followed, a revised
drainage study and more detailed plans, meeting current standards and
considering all affected lots, will need to be provided for me to issue
concurrence on a new drainage plan to the City If reference to any new
drainage plan is removed and the intent to follow the old one is stated,
then there I could concur with the drainage plan. However, the presence
of the large oak near the rear commons side lot line of Lots M & N would
need to be removed to allow installation of the rear ditch required for this
subdivision. There may be other trees requiring removal for adherence to
the approved drainage plan.

At the request of the Contractor/Owner, we have inspected the project referenced above
for compliance with the approved site plan.
Please keep in mind that we were not the original design engineers for the site but are
inspecting for drainage plan compliance based on the plans that were suppled to us by the
contractor and the City of Tybee Island.
Based on the limited information on the plans and after a brief inspection of the project, it
is our opinion that the project is in substantial compliance with the approved site plan
including final stabllization in the form of sod.
The swales which are in place on the east and west 5ide5 are only half formed and are
centered on the property Imes and the intent is to complete the swales when the adjacent
properties are completed.
