The regular meeting of the City Council was called to order by Mayor Nunamaker at 7:30 P. M. 2. Rev. R. E. Schulz, of the Lutheran Church, 9123 Broadway, . Temple City, gave the invocation, following which Mayor Nuna- 3. maker led the Pledge of Allegiance to the Flag; 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nuna- maker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford & City Manager Woollett. 5. APPROVAL OF MINUTES: City Manager Woollett corrected the minutes of the regular meet- ing of the City Council of August 12, 1963, as follows: Item 17, part 4, 4th line as follows: "and discuss the Compre- hensive General Plan report with the Whitnalls." Item 17, second paragraph correct to "Councilman Fitzjohn moved to approve, Councilman Merritt seconded, and carried. Page 3 under Public Hearing, Annexation 6 -A, 4th line should read " a total of 68.94% of the assessed valuation of property' owners "in the area who had signed the petition. Page 6, 4th paragraph regarding denial of entertainment license instead of seconded by Councilman Fitzjohn, should read "agreed to" by Councilman Fitzjohn. Councilman Fitzjohn moved to approve the minutes of the regular meeting of August 12 as corrected, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen-Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None. UNFINISHED BUSINESS: 6. ORDINANCE NO. 63 -111: controlling installation of bus benches within the City. City Attorney Shatford read title to Ordinance No. 63 -111 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE MUNICIPAL COUE'BY ADDING PROVISIONS ESTABLISHING CERTAIN REGU- LATIONS WITH REFERENCE TO BENCHES IN PUBLIC STREETS. Following discussion the following changes were made: Section 3917 should read : safe construction approved by the City Engineer, Section 3921, sub - section c, line 5 should read "After 60 days, the City Council may sell," Section 3922, sub- section a, 4th line should be "approved by the City Manager and City Attorney" Section 3923 should read "the Street Superintendent shall keep and maintain an index file of all permits granted or renewed under the provis-fon of this ordinance and furnish the City Li- cense Collector - - -" Section 3924, second paragraph, eliminate "The City Engineer" Following discussion Councilman Tyrell moved to waive further reading of Ordinance No. 63 -111 as corrected, Councilman Fitz- john seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading of Ordinance No. 63 -111 no further action was taken. 7. RESOLUTION NO. 63 -304: granting zone variance to Frank Harbert, 9518 E. M. CURB, GUTTER & SIDEWALK a. Agnes, west side, Miloann to La Rosa, curb and gutter b. Golden West, west side, Longden to Craiglee, curb, gutter & sidewalks c. Golden West, west side, Garibaldi to Longden, curb, gutter & sidewalks d. Golden West, east side, Wendon to Flaherty, curb, gutter & sidewalks e. Longden Ave., south side, Golden West to City limit, curb, gutter and sidewalks The City Manager presented the above petitions signed each one by at least 60% or more of the footage (front) of the property owners. The City Attorney ruled these may all be considered in one Public Hearing as long as people speaking identify themselve: as to area they represent. Councilman Fitzjohn moved to open the Public Hearing, Councilman Merritt seconded, and carried. Mayor Nunamaker asked if anyone in the audience desired to speak for or against any of these petitions. Flo Kelly, 5429 N. Welland spoke in opposition to item "h ". Also Jacqueline Comstock, 5319 Welland, spoke in opposition. Mr. Cross, 5403 Welland, and Mrs. Joyce Hill, 5427 Welland, both spoke in favor of item "h." Councilman Tyrell moved to close the public hearing on Welland, (item "h ") Councilman Fitzjohn seconded, and carried. Councilman Tyrell moved to determine the improvement to be in the public interest and to instruct the Road Supt. to cause the work to be done, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Dorothy McGee, 6252 N. Golden West, spoke in opposition to item, "e ". Councilman Tyrell moved to close the public hearing on Golden West, items "b, c, d, e," Councilman Dickason seconded and carried. Councilman Tyrell moved to find the improvements to be in the public interest and to instruct the Road Supt. to cause the work to be done, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Mr. Fox, 6204 Golden West, advised the storm drain installed re- cently is approximately one foot back of the present curb line and wanted information regarding correcting this and who is to 509 Council Minutes, August 26, 1963, page 3 pay for it. The City Manager advised that in a case such as this in no case will the property owner be asked to pay for 1t. Item "I ". Florence Fraley, 9805 Val, and protested against this installation. Robert Raines, 6438 Golden West requested the names of the petitioners on item "i" be read. Jas. R. Merritt of 6233 Golden West, advised he circulated the petitions and the east side of Golden West petition was from Longden to Val and the west side from Longden to Craiglee, which would not effect the property of Mrs. Fraley, 9805 Val. M. P. Kettle of 6362 Golden West on the east side opposed the installation. Also Mrs. Rufner, 6406 Golden West spoke in opposition. Coun- cilman Tyrell moved to close the public hearing on item "i" Councilman Dickason seconded, and carried. Councilman Tyrell moved to determine the installation in the public interest and to instruct the Road Supt. to cause the work to be done, Councilman Dickason seconded, roll call vote to carry as follows; AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to close the public hearing on the bal- ance of the petitions ( "f, g, & j "), Councilman Dickason second- ed and carried. Councilman Dickason moved to determine these improvements to be in the public interest and to instruct the Road Supt, to cause the work to be done, Councilman Fitzjohn se- conded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None It was explained to the audience that if 60% or more of the lin- eal front footage in each block petition for these improvements according to the California Government Code the cities must ac- cept and approve these installations. (Highways Code). Also that this City had instituted a policy two years ago where the City will contribute 50t per foot if everyone signed up in the block. The City also assumes the cost of engineering and the pave =out costs. Also if the City causes the work to be done the property owners are given 60 days to do so, and if not done the city goes ahead and takes bids on the project. Also that the Council de- sires to save as many trees as possible and this is given consid- eration when the plans are made for each individual petition. Regarding ownership of the parkways the City Manager advised the City has an easement over a portion of properties called the parkway for road purposes and which is owned by property owner but no taxes are paid on due to easement, but property owner is responsible for upkeep and improvement. Mr. John Netzel, 9863 E. Olive requested information regarding the 50Y refund if the City handles the installation and was ad- vised they get their reimbursement anyway. 9. RESOLUTION NO, 63 -305: denying request of Hal Broadhead on behalf of the Jolly Coachman for an entertainment license. City Attorney Shatford read title to Resolution No. 63 -305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESPECT ING DENIAL OF ISSUANCE OF ENTERTAINMENT LICENSE TO HAL BROADHEAD FOR USE AT PREMISES KNOWN AS THE "JOLLY COACHMAN ", LOCATED AT 9151 -9153 LAS TUNAS DRIVE, TEMPLE CITY, CALIFORNIA. Councilman' Fitzjohn moved to adopt Resolution No. 63 -305, Councilman Dicke- son seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Nunamaker NOES: Councilmen -None ABSTAINING: Councilmen- Merritt, Tyrell PUBLIC HEARING: 7:45 P. M.- REQUESTED ZONE CHANGE EAST SIDE ROSEMEAD BLVD., BETWEEN HERMOSA & GARIBALDI FROM R -1 TO C -2, B.L.MEEK etas The City Manager requested this Public Hearing be scheduled for 7:45 P. M. on Sept. 9, 1963, as all of the legal notices requir- ed could not be gotten out prior to the required ten day period. PRESENTATION OF PLANS FOR NEW CITY HALL: Mr. Gene Fickes of Fickes & Fickes, Architects for the Library and the modification of the existing library into a new City Hall, presented the plans and explained the various details in- volved. Following discussion Councilman Tyrell moved to instruct the City Manager to request bids and to present a recommendation to the City Council for the meeting of Sept. 23 to award the contract, the contract not to be awarded until payment is receiv- ed by the City from the County, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None RESOLUTION NO. 63-301: setting a "No City Tax Rate" City Manager Woollett presented Resolution No. 63 -301 and read title A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY INDICATING NO CITY TAX RATE FOR THE FISCAL YEAR 1963 -1964. He advised this is the fourth year of no city tax rate. Councilman Tyrell moved to adopt Resolution No. 63 -301, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. REPORT ON PROPOSED POLES FOR CHRISTMAS TREE LIGHTS: The City Manager reported on the permanent poles for Christmas tree lights as well as being used throughout the year for vari- ous banner displays. He advised the recommendation was putting in new poles, galvanized which would not require painting for at least ten years, includes electric connection with a meter at the back of the building, which would be activated only when in use. He requested. the Council to determine where they would want these poles placed to initiate the program which to complete could be budgeted for several years. He suggested they consider the four at the main intersection, one each in the middle of the block on north, south, east & west side, and one each block in the center of the block from city limit to city limit. By indi- cating where and how many you proposed to consider at this time the staff can get a better figure worked out. Councilman Merritt moved that the staff come up with a recommendation of the plan retaining the existing facilities at Temple City Blvd. & Las Tunas Dr, with a single string in the center of each block on Las Tunas Dr. from one city limit to the others and a single string a block north of Las Tunas and south of Las Tunas on Temple City Blvd., Councilman Fitzjohn seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker. NOES: Councilmen -None ABSENT:Councilmen -None 13. ACCEPTANCE OF ROAD IMPROVEMENTS, TRACT #26554. City Manager Woollett advised we had a letter from the Road Dept. recommending the City accept the street improvements in the above tract and that the faithful performance bond covering same be cancelled. Councilman Tyrell so moved, Councilman Dickason seconded, and carried. 14. APPEAL FROM TRAFFIC COMMISSION DECISION REGARDING REQUEST FOR OVER -NIGHT PARKING PERMIT: JAMES M. CARLISLE, 9234 KEY WEST. Following discussion and in the absence of Mr. Carlisle from the Council meeting, Councilman Tyrell moved to dismiss the appeal, Councilman Dickason seconded, and carried. 15. APPROVAL SPECIFICATION 1958 STORM DRAIN BOND ISSUE #524. City Manager Woollett presented a letter from the L. A. County Flood Control requesting Council approval of the above. Council- man Tyrell moved to approve the plans and specifications, and to authorize the District to proceed with construction as described therein, and to grant permission to occupy and use public streets in the City of Temple City to construct, operate and maintain 511 Council Minutes, August 26, 1963, page 5 said installations, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 16, RESOLUTION NO. 63 -302: Warrants & Demands Councilman Tyrell moved to adopt Resolution No. 63 -302, warrants and demands in the sum of $17,403.87, Nos. 2932 through #2958, Councilman Fitzjohn seconded, roll call vote to carry following: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 17. PLANNING COMMISSION RECOMMENDATIONS: a. ORDINANCE NO. 63 -112: ZONING ORDINANCE Planning Advisor Cushman advised the Planning Commission in over 40 meetings had gone through the initial draft of the proposed zoning ordinance prepared by the Planning Consultants word by word, and then a second draft was made and re- checked making sure all corrections, and ideas suggested by the Council, staff and Commission were incorporated in this. This draft is presented to you tonight. The City Manager advised the Council must hold a public hearing on this matter, and if the Council desired to have it introduced tonight we will advertise the meeting of Sept. 9 which will be the second reading. He also advised it is the intention of the Planning Commission to start public hearings on the new zoning map starting on Sept. 17. Councilman Dickason moved to waive further reading of Ordinance No. 63 -112, Councilman Merritt seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading no further action was taken. b. ORDINANCE NO. 63 -110: Establishing interim zoning in area bounded by Las Tunas Dr, to Woodruff and Cloverly to Temple City Blvd. City Attorney Shatford read in full Ordinance No. 63 -110 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING AN IN- TERIM ORDINANCE IN CONFORMITY WITH GOVERNMENT CODE SECTION 65806 ESTABLISHING AN INTERIM ZONING ORDINANCE FOR THAT CERTAIN AREA LYING BETWEEN CLOVERLY AVE. ON THE WEST, TEMPLE CITY BLVD. ON THE EAST, LAS TUNAS BLVD. ON THE SOUTH, AND WOODRUFF AVE. ON THE NORTH. The following people spoke in opposition to this Ordinance: Mrs. James Morris, 5946 N. Cloverly B. L. Meek, 9556 Woodruff Ave. Myrtle Sherwin 59062 N. Cloverly Estella Meek, 6004 N. Rosemead There followed a lengthy discussion regarding this ordinance following which Councilman Nunamaker moved to adopt this ordinanc No. 63 -110 correcting the number of days to 90 days in Section 1, in Section 4 line 5, "shall remain in full force and effect for three months" and line 8 same section "prior to the end of ninety days ", Councilman Merritt seconded, and adopted as•an urgency ordinance by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: .Councilmen -None c. ORDINANCE N0. 63 -109: establishment minimum public street frontage on a residential lot as 35 ft. First reading. City Attorney Shatford read title to Ordinance No. 63 -109 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING: ORDINANCE NO. 63 -107 TO CLARIFY AND MAKE CERTAIN NO LOTS SHALL BE DEVELOPED OR CREATED HAVING LESS THAN 35 FEET MINIMUM FRONT- AGE IN CONFORMITY WITH ORDINANCE NO. 63 -103, Councilman Tyrell moved to waive further reading, Councilman Fitzjohn seconded, roll call vote to carry as follows: 512 Council Minutes, August 26, 1963, page 6 AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading no further action was taken. 18, PARKS & RECREATION COMMISSION RECOMMENDATION: Recommend granting fee free use of Live Oak Park for American Field Service on Sept. 15, 1963, between 3 and 5 P. M. for a reception for our first American Abroad student and our new exchange student. Councilman Dickason moved to grant, Council - man Tyrell seconded, and carried. 19. TRAFFIC COMMISSION RECOMMENDATIONS: Item 5. Placement of capitalized "NO STOPPING ANYTIME" parking restriction west side of Sultana. The City Manager recommended this be held over as we do not have a report necessary to act upon the recommendation. Councilman Tyrell moved to table, Councilman Dickason seconded, and carried. Item 7. Approval of proposal to straighten "S" curve on Longden and Encinita. Chairman Sale of the Traffic Commission advised this recommendation will not require obtaining additional right of way. Following considerable discussion Councilman Fitzjohn moved to approve, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Item 9. Placement of boulevard stop sign on McCulloch north approach to Freer. Councilman Fitzjohn moved to approve, Coun- cilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Item 10. Restriction of parking west side of Salter between Ex- trella & Longden. Item 11. Placement of additional 19ft. red curb markings on west side of Temple City Blvd. south of Woodruff. Item 13. Re- painting of existing red curb markings east side of Reno St. to white, Councilman Dickason rnoved to approve items 11, 13, and 10, Coun- cilman Tyrell seconded, roll call to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen-None ABSENT: Councilmen -None 20. SET PUBLIC HEARINGS, CURB, GUTTER & SIDEWALK The City Manager recommended a Public Hearing be set for Sept. 9, 1963, at 7:30 P. M. for the following: a. Golden West, east side Flaherty to Garibaldi, curb, gutter & sidewalk b. Longden Ave., north side Golden West to Salter, curb, gutter & sidewalk c, Rancho Real, north side, Sultana to Loma, curb & gutter d, Rancho Real, south side, Sultana to Loma, curb & gutter e. Longden, north side, Salter and east city boundary, curb, gutter and sidewalk Councilman Fitzjohn so moved, Councilman Merritt seconded, and carried. The City Manager also requested a public hearing be set on Curb & Gutter assessment for 8:00 P. M. on Sept. 9, 1963, Councilman Fitzjohn so rnoved, Councilman Tyrell seconded, and carried. COMMUNICATIONS: 21. Welcome Wagon International, Inc. request permission to establis themselves in our City, The City Manager presented the above letter and following discussion the Council felt this should be handled by the Chamber and moved to file by Councilman Tyrell, seconded by Councilman Merritt and carried. 513 Council Minutes, August 26, 1963, page 7 2. Los Angeles Union Label Council: The City Manager read a letter of request that the first week in September be proclaimed as :Union Label Week ". Councilman Merritt moved to so proclaim Councilman Fitzjohn seconded, and carried. 3. L. A. County Boundary Commission: proposed annexations #323, #325, #332A, #338. City of El Monte. The City Manager presented these proposals. Councilman Fitzjohn moved to receive and file, Councilman Tyrell seconded, and carried. TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK: 22. Russell Edwards, 5674 N. Loma, requested information regarding installation of curbs, gutters and sidewalks. Mrs. Bertha Rains, 6438 Golden West, commented on the dinner meeting of the Council, Planning Commission and staff to receive and discuss the Comprehensive General Plan Report with the Whitnalls, which was held at Eatons, and expressed her disapprova of this type of meeting. It was open to the public per City Manager Woollett, and one of the reasons it was held at Eatons was that they had a room available large enough to accomodate any of the public that might wish to attend. That this was open to the public was stated in the minutes of August 12, 1963. Charles Oakly, 6164 Rosemead, claimed the conditions to be met by Gabriel Janus of 6156 N. Rosemead, within two weeks after the granting of the variance had not been complied with. The City Manager advised he had a report from the departments involved that Mr. Janus had complied on all requirements within the two weeks specified that they should be done. However he has to Jan. 1, 1964 to comply with the balance of the requirements. Also he advised Mr. Oakley any damages to his property is a civil suit between Mr. Janus and himself. In view of the comments of the City Manager the Council felt there was no complaint and suggested Mr. Oakley at his convenience make an appointment with the City Manager for further discussion if he so desired. Mr. Von Dusen , 9344 -48 -52 Lower Azusa, stated he was in the building business, and asked if Ordinance No. 63 -109 was to knock lot splits out of Temple City. He was advised that this ordinance was only clarification of an existing ordinance passed last April controlling lot splits, and this new ordinance only clarifies sections of the new subdivision ordinance. 1 1 MATTERS FROM CITY OFFICIALS: The City Manager advised that they had conducted a walk- through final inspection of the library and in the next few days will be officially accepted, and the City Manager will accept as agent for the City Council. He advised he had received a request from Mr. Phillips of the County Library requesting permission to commence moving into the new library, and recommended he be granted this ermission. They are trying to be in there complet ly by Sept. 2b the day of the dedication. Councilman Merritt so moved, Councilman Tyrell seconded, and carried. Mayor Nunamaker read a letter of resignation from Walter E. Griesmeyer, as of Sept. 15, 1963, as City Treasurer due to additional duties in connection with his position at the Secur- ity 1st National Bank. Following discussion Councilman Tyrell moved to accept with regret, and that the proper plaque be pre- pared commending him for his services, Councilman Fitzjohn se- conded, and carried by the following called vote; AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None The City Manager recommended the Council set up an executive session to appoint a new City Treasurer and Deputy City Treas. Following discussion it was agreed that such a session would be held at 7:00 P. Following a lengthy discussion Councilman Tyrell moved to let the City Manager determine what bank to use until we appoint a new City Treasurer, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen-None 24, ADJOURNMENT: Councilman Dickason moved to adjourn, Councilman Tyrell seconded, and carried.
