that said wood be placed in its custody for distribution to the
needy residing within the City of Livermore; now, therefore, be it
aesolved, that sald woOd be placed in the custody of the.said
Alameda County Charity Association tor distribution wlthout charge

the members of the Council are undecided as to whether they can attend,
but will be present if possible.

for the costs of operating said motorcycle;

statutes of 1929 of the Legislature of the State of California and
Ordinance No.l83 of this Council, the President of this Council

Planning Commission for the respective terms as hereinafter indicated,

A regular meeting of the City Council was held in the Council
Chambel"s at the City Hall on Monday evening, April 1st. 1935. The
meeting was called to order at 8:l0 o'clock.

Minutes Approved.
The minutes of the last meeting were read and, on motion of
Councilman Bothwell, seconded by Councilman Fiorio, and by vote of

A letter was received frDm the Pacific Gas and Electric Co.
explaining their reduc,tion of about ten per cent in their rates for
street lighting service supplied throughtfacilities owned by that

A letter was received from the League of California Municipal-
ities, San Francisco. California, concerning various bills pending
in the Legislature.
A clroular letter was received from the University of Southern
California, Los Angeles, inviting public officials to attend the
Seventh Institute of Government, to be held there on June loth to 15th.
A letter was received from the Midtown Association, Los Angewso,
california, suggesting that Legislators be urged to support certain
bills pending befor~ the Legislature which provide th~t jafety illu-
mination is a function of street maintenance and is therefore a

proper charge against the gasoline ~ax funds allotted.
'All these communications were ordered filed, and the Clerk was
instructed to write letters to Senator Knowland and Assemblyman'
Cassidy stating that the Council earnestly requests them to support
these bills.

Communications.
A letter was received from State Highway Engineer C. H. Purcell
~gesting that the City Council make application for~Federal
Emergency funds for construction of a railroad and highway grade
separation at crossing number 4-48.2 on East First street, the
City to assume the costs for purchase of right of way and payment
of any property damages and the City's share of the i cent gas tax
money to be used to assist in providing the right of way.
The Clerk was instruced to reply that the City is ready and
willing to go ahead with its pp.r~ttin.'th1s proposed projilrct bt'
making of an under~ass ot the East First-street crossing of the
Western Pacific Railroad Co.; also, that if this project is under-
taken, the Council would reconlmend that a similar project be arranged

is needed fully as much if not more; also, that a bridge be built at
the Holmes street crossing of the Arroyo Mocho, on California State

A letter was received from Tax Research. Inc.. Los Angeles,
California. presenting a request by Paul E. Opperman for refunds of
,taxes paid during the past three years to the amount of 50%, on
account of his property being partly occupied by the Pacific Greyhound.
The matter was referred to the City Assessor for survey and
report.

A regular meeting of the City Council was held in the Council
Chambers at ~he City Hall on Monday evening, May 6th, 1935. The
meeting wass called to order at 8:00 o'clock.

Minutes Approved.
The minutes of the last meeting were read and on motion of
Councilman Clarke, seconded by Councilman Fiorio, and by vote of

Flag Donated.
A large American flag for the City flagppiliewas received from
the Woman's Improvement Club, being presented by President Anne
Wagoner and Mrs. Annie McDonald of the Club.
The Clerk was instructed to send a letter of thanks and
appreciation to the Club.
Mayor Selected.
Councilman Bothwell nominated Councilman Fiorio for Mayor;
Councilman Clarke nominated Councilman Tubbs, and, on motion of
Councilman Bothwell, seconded by Councilman Fiorio, and by vote of
the Council, nominations were closed.

Communications.
A letter was received from state Highway Engineer C. H. Purcell
of the state Department of Public Works, Sacramento, stating that
the~,rebommendations of the Council in re grade separation projects
will be given consideration in case sufficient funds are allotted
by the Federal Government for the purpose.
A letter was received from Dr. F. Leslie Herrick, Parade
Director, extending an invitation to the Councilmen to ride in
one of the stage coaches in the Centennial Parade on June 8th.
A letter was received from the Committee for Gross Receipts
Tax Measure, Huntington park, California, inviting criticism and
suggestions in regard to its proposed constitutional amendment.
A letter was received from state Senator Wm. F. Knowland,
Sacramento, acknowledge receipt of~ the Council's recorrunendations
of April 5th iil<1regard to certain bills.
Merchant Classification.
On motion of Councilman Fiorio, seconded by Councilman
Bothwell, and by vote of the Council, a merchant classification
as of the first class was granted to Valley Motor'Sales'for its
show room to b~ opened at 1194 West First street.

Fifty-four claims, amounting to a total of $3,606.86, were
audited and approved by the Finance Committee and, on motion o~

RESOLUTION NO. 1106
Vfuereas, the City Council has been requested to close
south Livermore avenue to traffic from the north line of the right
of way of the Southern Pacific Railroad Co. to the north line of
East First street; and
Whereas, the Committee requesting that this street be closed
has agreed to furnish this Council with a written permission for
closing to be signed by the proprietors of businesses abutting on
said street; now, therefore, be it
Resolved that said street be closed to traffic on June 7th,
8th, and 9th, 1935, after the hour of 6:00 p. m. each day, provided
that said written agreement is furnished to this Council prior to
June 7th, 1935.

A letter was received from President M. R. Henry of the Board
of Library Trustees, stating that the Board had determined that the
sum of $2500 would be necessary for the Library for this fiscal year
and also; stating that the terms of Trustees M. J. Clark, M. R. Henry
and H. W. Hupers had expired.
A letter was received from Executive secretary Ernest Schween
of the Fiesta Del Vino at Pleasanton, inviting the Councilmen to
participate in the program on September 7th and 8th and especially
in the parade on the latter date.
A similar invitation was received from Dr. F. Leslie Herrick
and R. p. Bernhardt as the Livermore Committee for the Fiesta Del
Vino.
A letter was received from the State Board of Equalization,
Sacramento, stating that the property assessed by it in the City

ofLi vermore had been equalized by adding 34% to the County assessment
and that a hearing on the matter had been set for lO:OO a. m. on Tuesday,
August 27th, 1935.
A letter was received from the League of California Municipalities
stating that September 16th had been set as the dead line far receiv-
ing in the State PWA offices applications on projects out of new PWA
funds. .
A letter was received from the State Department of Public Health, f
sacramento, urging that every Health Officer in the State attend the
annual meeting to be held in San Francisco, september 23rd to 26th.
A letter was received from the Internation Association of
Electrical Inspectors, Los Angeles, requesting that the Electrical
Insp~ctor be instructed to attend its annual meeting at San Diego
Hotel, San Diego, on September lOth to 12th.

In Ite Compensation Insurance.
The Clerk was instructed to write to the state Compensation
Insurance Fund, aSking for an explanation as to why the average
weekly earnings of the General Utility Man are figured as 95% of
his actual weekly eannings.
Resolution Fixing Tax Rate Adopted.

of Chapter 356, statutes of 1935, limiting expenditures by cities.

Firemen, oakland, California, stating that the association comprises
all of the other fire departments in the County and urging that the
Livermore Fire Department~oin their organi~ation, paying dues of
fifty cents a year per member.

A letter was received from John H. Skeggs, District Engineer,
Division of Highways, San Francisco, California, enclosing three copies
of a Memorandum of Agreement providing for the expenditure of the t-
cent Highway Fund allocated to Livermore for the 1935-37 biennium and
the balance remaining from the 1933-35 a.llocation.
A letter was received from the San Francisco Century of Commerce
Celebration, inviting the Council and the people of Livermore to visit
the celebration during the week of October 14th to 19th.

A letter was received from ~esident George J. Davis inviting
the Council to attend the San Mateo County Products and Floral Fiesta
at Bay Meadows on october 11th to 13th.
A letter was received from Pacific Coast Building Officials
Conference at Los Angeles, requesting that the City Building In-
spector be authorized to attend the meeting in Pasadena on October
8th to 12th, inclusive.
Officials' Reports.
The report of the Chief of Police for the month of August, 1935,
and a special report from Milk Inspector Dr. R. R. Root submitting a
laboratory analysis of milk samples collected from dairys and stores
distributing milk in the City of Livermore, were read and ordered
placed on file, on motion of Councilman Fiorio, seconded by Council-
man Bothwell, and by vote of the Council.
Resolution In Re state Highway Contract.
The following resolution was read and was introduced by Council-
man Clarke and, on motion of Councilman Clarke, seconded by Council-
man Fiorio, and by the following called vote, was adopted: Ayes--

RESOLUTION ~O. 1115.
VffiEREAS, under and by virtue of a Resolution heretofore duly
passed and adopted by the Council of the City of Livermore the
routing of State Highway No. 108 through the City of Livermore was
approved and said City agreed to resume jurisdiction over said
City streets or portions as may not be included in said State
Highway, and
WHEREAS, in the future it will become necessary for the City
of Livermore to enter into a contract with the Department of Public
Works of the State of Californ~a and/or the State Highway Commission
of the state of California for the maintenance of siad Highway Route
No. l08; and
WHEREAS, the Council of the City of Livermore by Resolution No.
l082 passed and adopted by said Council on the 25th day of June, 1934,
authorized the Mayor of the City of Livermore to sign said ,contracts
for and on behalf of said City;
NOW THEHEFORE, BE IT RESOLVED, that Resolution No. 1082'be and
it is hereby rescinded and be it further resolved that L. E. Wright,
City Engineer of the City of Livermore, be and he is hereby author-
ized to sign said contract for and on behalf of the City of Livermore.

A regular meeting of the City Council was held in the Council
Chambers at the City Hall on Monday evening, October 7th, 1935. The
meeting was called to order at 8:20 o'clock.

Communications.
A revised bid'was rec$ived from the Judson-Pacific Company,
San Francisco, to furnish lintels, reinforcing steel and two
marquise frames for $255 deliveeed at the City Hall. It was ac-
cepted.
A contract was received from the Standard Oil Company of
california, for furnishing gasoline for one year commencing
september 24th, 1935, and accepted.
, A letter was received from Mayor Wm. J. McCracken of Oakland, '
and from General Chairman E. P. Zollner of the Armistice Day Committee,
oakland-,' ) inviting the Council and the people of Livermore to attend
the Celebration of Armistice Day in Oakland. The Clerk was instructed
to reply that the City would make every effort to have a Livermore
representation in attendance.

on Tuesday evening, November 12th, 1935. The meeting was called to
order at 8:10 o'clock.

A letter V'ws received from the Alameda County Building Trades
CounciL'requesting that the prevailing wage scales be paid on all
WPA projects.
A circular letter was received from the League of California
Municipalities calling attention to the provisions of the civil service
enabling act and stating that gas tax projects may start immediately,
without waiting for money to 8ccumulate in that special fund.
They were ordered placed on file.
Two Claims Allowed.

A letter was received from the state Board of Equalization,
Sacramento, California, stating that the City's application for
per>mission to exceed its ordinary expenditures, os provided by law,
for the current fiscal yenr h8d been granted, on condition that the
excess shall not be treated as an expenditure of 1935-36, but is
allowed only as'an emergency expenditure.
A letter was received from Director Walter P. Koetitz of the
Works progress Administration, ODkland, California, enclosing copies
of a project proposal to'ttndex and file books and records."
A bulletin rTf'S received from the teague of C81ifornia r.Iuni-
cipalities, San Francisco, in regard to hearings to be hel~b~fore
the StGte Railroad COl1'1'11ission on December 19th in re rates to be
chcrged for hauling sand, rock, etc., over public highways.
