This is to confirm that at the meeting held by the Town Commission on October 19,
2001, your application for a Variance to permit installation of a metal fabricated roof tile
and a Level 3 Architectural /Site Plan Review Amendment to replace the previously
approved wood shake roof on the existing two -story contemporary structure with
fabricated roof tile at the above address was considered.
Your requests were not approved in that metal roofs are prohibited in the Code of
Ordinances, and a hardship has not been proven in the variance request.

Basis for Recommendation:
Variance
The ARPB and the Town Commission have approved Wood Shakes as the roof material to be used in
the renovation of this property. The Wood Shakes meet the Design Manual standards for roof
materials.
Subsequently, building plans were submitted and approved using Wood Shakes on the roof.
The applicant does not meet all of the review standards, Section 66 -154 attached, in that there are no
special conditions or circumstances not applicable to others. A literal interpretation of Code
provisions would not deprive applicant of rights enjoyed by others or work a hardship. Granting the
variance would not be consistent with the general intent of the Code in that the Code prohibits metal
roofs.

Enclosed please find our application for a roof material variance for Mr. Safwat Fahmy
residence. After our approval of April 8, 2001 by Town Commission and at the request of
our client, we have conducted considerable research for an alternate solution to the
specified roofing material that would be safe, long lasting, and meet the intent of the site
appearance board of the Town of Gulfstream. What we are proposing meets all the
criteria and safety for a residence in the proximity of the Intracoastal Waterway. The
roofing material we wish to use is manufactured by Dura -loc Roofing Systems. It is
basically a metal roofing system with a granular coating over it.
The concept of the granular steel roofing materials was developed over fifty years ago in
England as the British used tar and sand to camouflage the galvanized bunkers from the
German pilots during WWII. Following the war, the concept migrated to New Zealand
where the progenitor of granular coated roofing was used to address the harsh climatic
conditions of the Australian subcontinent, including torrential rains, hurricane force wind
and torrid summer sun. The original product's composition was quite different from the
advancements of today. It incorporated a galvanized steel core, and crushed granite
granules embedded in an asphalt base. Over the next twenty -five years, the product
migrated to other continents, finally reaching North America in the late 1970's. While the
original design and composition worked well in its original markets, improvements were
required to perform in our broader climatic range. Dura -loc Roofing Systems, Ltd. was
formed as North America's first manufacturer of granular coated steel roofing in the early
1980's. New innovations were immediately introduced to enhance the product's
performance in the rigorous Canadian climate as well as Southern coastal markets of

Florida, Texas, and California. A galvalume coating with an ultraviolet resistant acrylic
was introduced with the product's initial product release, replacing the galvanized steel
and asphalt coating of the imported products. These innovations added superior
weathering and performance characteristics, thus allowing Dura -loc to develop the Fifty
Year Protection Plus Limited Warranty offered today on all its roofing systems.
Today Dura -loc's plant facility in Southern Ontario offers three system profiles. The
original Continental "S" the profile, a Wood Shake profile, and a shadow line profile,
all replicating time honored traditional roofing materials, but offering them in high
performance modern materials combining light weight and durability.
Dura -loc's Roofing Systems are being manufactured to meet or exceed the world's
highest standards for roofing systems and comply with virtually all the major model
building codes including Dade and Palm Beach counties. The overall size of the "S" tile
panel is approximately 16 inches wide by 50 inches long.
We are enclosing herewith all our building elevations and roof plan revised to indicate
our proposed new roof. We are respectfully requesting your support to approve our new
roof described above.

IV.G.4. Total Variance Requested:
To allow to be used as a roofing material in connection with an
approved home remodeling /expansion project a metal fabricated
tile having the appearance of rolling tile or, alternatively, wood
shake.
IV.G.5.
(1) Special Conditions /circumstances peculiar to the structure:
The remodeling project referred to in Sect. IV.G.4, above, involves
replacing the existing roof on the existing home, as well as putting
a new roof on the addition which has been previously approved by
the Town of Gulf Stream. Due to the roof system design of the
existing home, use of heavier, more durable and safer roofing
materials, such as cement tile, are precluded.
(3) Special privilege denied other buildings:
Other properties would be denied the opportunity to use a light
weight roofing system that looks like permissible roofing
materials, yet, due to its nature (metal), is safer, more durable and
longer lasting.
(4) How existing Code requirements work undue hardship on Applicant:
Applicant is precluded from using cement, rolling and S tiles as a
roofing material on his home in that the existing roof system of the
home is not designed to support the weight of such products. That
narrows Applicant's permissible choices to shake or asphalt tiles.
Shake tiles have a much more limited life than permissible cement,
rolling and S tiles, are inherently less durable and pose serious
safety concerns in high winds (wood missiles). Because the
Applicant intends to spend substantial sums of money for interior
finish work, furnishings, art and accessories, the Applicant desires
to use the most long lasting, durable and safe roof material
possible, which would be metal, and which, although available in a
form which looks substantially similar to wood shake and S tile, is
prohibited by the Town's ordinances.
(5) Is the variance requested minimal in impact?
Applicant believes that the granting of the requested variance and
allowing Applicant to use metal rolling or shake tile would have a
minimal or no impact on the surrounding neighborhood since such
a product would have, from adjacent roads and surrounding
properties, an appearance similar, if not identical to permissible
rolling or wood shake tile materials, while being substantially safer
and affording better long term aesthetics.
(8) Is the variance in harmony with the general intent of the Zoning Ordinance?
Applicant believes that the granting of the requested variance
would be consistent with the intent of the Town's Codes in that
such Codes relating to permissible roofing materials are primarily
concerned with style rather material. In the evolution building
materials, products have and will in the future be developed which
are lighter, more durable, and provide for a greater degree of safety
than "tried and" true products which look substantially the same.
While the Town of Gulf Stream might well decide to prohibit the
"Key West" look of a standing seam metal roof, same could be
accomplished without prohibiting all metal roofing uses.
Applicant would be allowed to remodel using a rolling tile or
shake metal roof would be in the best interest of not only applicant,
but applicant's neighbors.
