Resolution Purchasing Motorcycle.

Earl S. Anderson requesting that applicants for City building permits
be requeste4to show that they have their State lioense as contractors.
A letter was received from S. J. Norton, San Jose, Californ1a,
protesting against the pr'oposed ordinance requiring ell milk to be
either pasteurized or certif1ed, ma~$n1ng that paste~tzat1on
destroys the vittnlins 1n milk.

The Council of the City of Liver-
more do ordain as follows:
Section 1: Ordinance No. 173 of
the City of Livermore entitled "An
Ordinance providing a milk inspection
divisicn for the maintenance of a milk
inspection service to inspect milk,
milk products, dairies and dairy herds
~md of plscrs where milk or milk pro-
ducts are procuced, handled or sold
and rc.gn'ating the> sale. possessi.on
Hnd handling of milk, cream and mIlk
prcducts in the Town of Livermore,
and providing- for inspection fees and
Denalty for violation of the provisions
thereof", is hereby ampnded by repeal-
ino- Sections 7 and is thereof, amend-
ing Sections 3, 11, 12, 17 and 27 th~re-
-f and tv adding three new SectIOns
thereto to he numbered 9a, 9b, and
9c.
Section 2: Sections 7 and 8 of Or-
dinance No. 173 of the City of Liver-
more are he>reby repe9.led.
Section ::\: Section. 3 of Ordinance
No. 173 is hereby amended to read as
follows:
Section 3. It shall be unlawful for
any person, firm. corporation or as-
ECciation. or agent or employee there-
of, to tring into the City of Liver-
more or to sell or exchange or offer
to Eoll or exchange, ,give or distribute,
or have in possession for sale or dis-
tribution, in the City of Livermore,
any m9.rket milk for hClman consump-
tion unless it conforms to the re-
quirements. definitions, s<rading a'Jd
standards of certified milk or Grade
"A" pasteurized milk. as provided
in the Agricultural Code of the State
of California, and the rules and reg-
ulations of the Department of Agri-
culture of the State of Cflifornia, and
the provisions of this Ordinance; pro-
vided that the provisions of this Par-
agraph shall not apply to market
creflm.
Section 4: Section 11 of 0 rdinance
No. 173. is hereby amended to read
as follows:
Section 11: It shall be unlawful for
any person, firm, corporation or as-
sociation to giVe, furnish, offer or ex-
pose for sale or exchange any Grade
"A" Pasteurized milk which has not
been pasteurized within a radius of
Five (5) miles of the City Hall of the
Citv of Livermore.
Section 5: Section 12 of Ordinance
No. 173, is hereby amended to read
as follows:
Section 12: No person or any em-
ployee or agent thereof, shall give,
furnish, sell, offer for sale or deliver,
any Grade "A" Pasteurized milk, cer-
tified milk or the by-products thereof
such as skimmed milk, butter milk,
sour milk, whey, or cream, except that
which is sold for immediate consump-
tion on the premises where sold in
cmantities of less than one gallon, un-
iess the same be kept, offered for
sale, exposed for sale, sold, or deliv-
ered in sanitary transparent glass
bottles; the same to be sealed with a
suitable cap or stopper.
Section 6: Section 17 of Ordinance
No. 173 is hereby amended to read as
fo1lows:
Section 17: It shall be unlawful
for any person, firm, corporation or
association to distribute, pasteurize,
handle, sell, deliver, give, offer or ex-
pose for sale or exchange in the City
of Livermore any market cream, cer-
tified milk or milk intended for Das-
teurization, unless said person, firM.
corporation or association shall hold
and possess an unrevoked Dairy Pro-
duct Manufacturer's and Distribu-
tor's Permit from the Health Officer
0f the City of Livermore, and unless
the producers of market Milk shall
have an unrevoked producer's permit
from said Health Officer. Any permit
herein required is revoc'tble for
cause at any tiille by the Milk Inspec-
tor.
Secti on 7: Section 27 of Ordinance
No. H3, is hereby amended to read
as follows:
Se8tion 27: There is hereby created
and established within ~llld for the
City of Livermore the office of Milk
Ins:pector of the City of Livermore,
and some fit and proper person shall
re apDointed by the City Councll of
the City of Livermore as Milk In-

Section 8: Ordinance No. 173 of
the Citv of I,ivermore is hereby
amended by adding- a new Section
thereto, to be numbered 9a.
Section 9a, Pasteurization as ap-
p'ied to market milk is hereby defined
as tl'e heating of said milk to a tem-
perature of not less than 1420 FRhr-
enheit nor more than 1450 Fahrenheit,
and holding it between these temper-
atures for not less than thirty (30)
min'ltes and thereupon immediately
cooling said milk to a temperature
cf les1'1 than 500 Fahrenheit.
Section 9: Ordinance No. 173 of
the City of Livermore is hereby
amended bv adding a new Sedion
thereto, to be numbered 9b.
Section 9b. On and after the day on
which this ordinance shall take effect,
all bovine animals from which milk
is drawn for sale as milk within the
corporate limits of the City of Liv-
ermore shall be free from tuberculo-
sis as determined by the Tuberculin
test which shall be applied semi-an-
nually on infeoted herds and annually
on uninfected herds, and shall be free
from all other diseases as determined
by a physical examination performed
semi-annually, Any cattle which react
to the tuberculin test, or which are
shown by any other examination to
be suffering from any other disease
or condition which might render the
milk drawn therefrom dangerous for
human consumption shall forthwith
be excluded from the dairy herd, and
the milk taken or drawn from such
cows or cattle shall not be sold there-
after in the City of Livermore. No
bovine animal or animals shall be in-
troduced into a dairy herd until said
animals have been tested by the tu-
berculin test and proven free from
tuberculosis and examined and found
in good health.
The tuberculin tests and' physical
examinations provided for in this sec-
tion shall be made by a licensed grad-
uate veterinarian .acceptable to the
Health Officer of the City of Liver-
more and shall be made in accord-
ance with such rules .and regulations
as the Health Officer of the City of
Livermore and the State Department
of Agriculture, Division of Animal
Industry, shall make, covering such
tests and examinations.
Where reactors are found within
a dairy herd, they must forthwith be
excluded from the premises" follow-
ing which the entire premises on
which such reactors are found shall
be thoroughly disinfected under the
supervision of the Health Department
of the City of Livermore, or the State
Department of Agriculture, Division
of Animal Industry.
Fraud or deception of any kind in
connection with any tuberculin tests
or examinations required by this Sec-
tion shall be cause for the immediate
revocation of the permit of the dairy-
man to supply milk to be sold within
the corporate limits of the City of
Livermore, in addition to any other
penalty or penalties prescrib.ed fOf
the violation of this ordinance,
Section 10: Ordinance No. 173 of
the City of Livermore is hereby
amended by adding a new Section
thereto, to be numbered 9c.
Section 9c: Pasteurized milk shall
contain less than 50,000 bacteria per
cubic centimeter before pasteuriza-
tion and less than 10,000 bacteria
per cubic centimeter at the time of
deliverv to the ultimate consumer.
Section 11: All ordinances and
pa rts .of ordinances in conflict here-
with are hereby repealed,'
Section 12: This ordina.nce shall
take effect and be in force at the
time provided by law.
Section 13: This ordinance is here-
by ordered to be printed and pub-
lished in the Livermore Herald, which
newspaper is hereby designated for
that purpose.

Section 3. Such notice shall be
given by posting In a conspicuous

in front of or upon which sald weeds,

A copy of a letter sent to' Joseph < S. Concannon from Acting
Fourth Assistant Postmaster General F. J. Buckley, Washington, D. C.,
was also received, stating as follows:

A recent Federal building survey has been made at Livermore,
and complete information concerning the needs at that point is on
file with the Post Office and Treasury Departments. Th1s was one
of.the places included in the list of eligible projects submitted
to the Committee on Appropriations of the House of Representatives
when hearings were held recently on the item for public building
construction o~tslde of the District of Columbia.
Is is the intention of the Post Office and Treasury Departments
to give very careful consideration to a project for Livermore in con-
nection with any funds that may be authorized for public building
construction 'during the current session of Congress.
In Re Securing New Post-Office Buildin~.
Discussion of the matter of how best to aid in securing a new
post-office building for Livermore was invited by Mayor Tubbs, and
remarks on the subject were made by Dr. F. L. Herrick.representing

Telephone & Telegraph Co. to replace one pole on the east side of
Holmes street south of College avenue and to place four ,poles and two
anchors on the no~th side of Mocho street west of Holmes street, as

Sign Permit Granted.
on motion of Councilman Bothwell, seconded by Councilman Jensen,

Electric to erect an electric sign six feet high by about three feet
wide to extend over the sidewalk in front of its place of business'
in the Bank of America building at 56 South Livermore avenue.

RESOLUTION NO. 1176.
Vfuereas, the County of Alameda is the third largest county in
the State of California; and
Whereas, the First Agricultural Board has recently been re-
organized and at present is in aHpo$ition to hold a County Fair and
to have the same financed by the State of California from the money
derived from the pari-mutuel receipts; and
VIlhereas, it will be necessary to meet the preliminary expenses
in order that this money may be available; therefore be it
Resolved by the City Council of the City of Livermore that
we endorse the holding of a County Fair during the year 1938 and
hereby request the Honorable, the Board of Supervis9rs of Alameda
County, to include in their next budget at item to cover the premium
necessary for holding, a County Fair, the total amount of' which will
be returned to the County after the Fair is held, from..:trle pari-
mutuel receipts. ~
