APPROXIMATELY .14 ACRES (5973.10 SQ. FT), AT THE
REQUEST OF RUDG-TOWN CENTER, LLC, TO `
ACCOMMODATE A FOR SENIOR CITIZENS AFFORDABLE
HOUSING DEVELOPMENT; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR
CODIFICATION AND SEVERABILITY;PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS,on May 15,2012,RUDG-Town Center,LLC requested that the City vacate the
alley between 551 Fisherman Street and Aladdin, to accommodate an affordable Senior Housing
Development; and
WHEREAS,the City must vacate the alley way in order to accommodate the construction of
the affordable Senior Housing Development; and
WHEREAS, the Code of Ordinances provides that the Planning Council and the City
Commission are authorize to approve such requests; and
WHEREAS, on June 5, 2012, the Planning Council recommended approval of the
applicant's request to vacate the alley; and
WHEREAS, the City Commission of the City of Opa-locka desires to approve the
Ordinance No. 12-23
applicant's request vacate the alley to accommodate the construction of an affordable Senior Housing
Development.
NOW, THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA,AS FOLLOWS:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true, and the
same are hereby made a specific part of this Ordinance.
Section 2. The City Commission of the City of Opa-locka hereby approves the request of
RUDG- Town Center, LLC vacate the alley adjacent to Aladdin and Fisherman Streets, for the
purpose of constructing an affordable Senior Housing Development.
Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed.
Section 4. If any section,subsection,sentence,clause,phrase or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,such portion
shall be deemed a separate, district and independent provision and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 5. This Ordinance shall be codified in the Code of Ordinances when the code
is recodified.
Section 6. This Ordinance shall,upon adoption,become effective as specified by the City
of Opa-locka Charter and Code of Ordinances.
